you are partially correct about this statement worldwide level = 140000 & EB3 = 28.6% of
but there is another rules that screws us
per country limit is 7% of the total, hence
140,000 * 0.07 = 9800 per country limit
9800/3 = 3266.66 per category if we assume that there are 3 categories. If we include EB4 & 5 the number is less than 3k per country. I think that this number is more accurate because most of the other blogs mention the fact that EB3 1 will get maximum of 3k per year if there is no spillover. My PD will be current if they set 5.5k per country for EB3 I, having been stuck in every step of this !@#!@ process i feel that the number will be around 2.8 (consular processing etc).
I am not considering any spill over etc...
here is what says on visa bulletin
Visa Bulletin October 2009 (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html)
The worldwide level for annual employment-based preference immigrants is at least 140,000.
EMPLOYMENT-BASED PREFERENCES
First: Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.
Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employment-based preference level, plus any numbers not required by first preference.
Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second
preferences, not more than 10,000 of which to "Other Workers".
worldwide level = 140000
EB3 = 28.6% of 140000
can you please clarify ?

Hmm interesting.
So if I buy a gas guzzling SUV/Truck and the price of it goes down to 1/4 because of soaring oil prices, I guess dealer should pay me back the 3/4 because it is not my fault. Right ?
And if I bought used Hybrid which is now selling like hot cakes and I make a profit I must redeem it to the car dealer. Because I made money I didn't anticipate. Also, my 401K losses should be returned back because it isn't my fault the stocks are loosing value. The price of gas I paid this summer was twice what I am paying now, so I must get back the money I spent this summer, because it is not my fault that there has been fluctuations in the oil prices.
Well, if only it were that simple. That's not how the system works, although you would want to be that. When you sign the dotted line you are in the binding contract and from then on profits, losses and fire sale is all yours.
You have to live up to what you have signed or next time around you signature will not be honored.
Dude, then why are we blaming people like punjabi.........it is not his fault that the supply was abundant and demand receded..........I would still blame the banking system for the housing failure.......they landed out money which they knew would stop coming back at one point in time........and again, it's not that he cannot afford his monthly payments...........he just cannot sell his asset - to me that is a problem on the part of the lender and not the borrower. No wonder banks are re-adjusting the home loan amounts (to a much lower value than originally specified in the agreement) for people who cannot pay the normal mortgage (due to whatever reasons). Go and teach the same lesson to these greedy banks and lending institutions.
Again, I am not saying that foreclsosing (escapism) is a good route to take, as there are other ways to keep the paying the mortgage without hurting your mobility but at the same time it is not prudent to blame it entirely on the borrower - lending institutions are responsible for major part of this mess.

Lou Dobbs Hears Radio Calling (http://www.nytimes.com/2007/12/05/arts/05arts.html) By JACQUES STEINBERG | NY Times, December 5, 2007
The way Lou Dobbs sees it, people shouldnt need basic cable to hear him sound off at length on issues like immigration and free trade. Mr. Dobbs said yesterday that he was creating a daily three-hour talk radio show that would run in the afternoons and conclude an hour before his nightly program on CNN, which begins at 7 p.m. on the East Coast.
My interest is in bringing a voice of reason, rather than the partisan and ideological poles that define talk radio right now, he said in a telephone interview. Mr. Dobbs vowed that neither the right nor the left would be able to lay claim to him, with some conservatives who support his hard-line take against illegal immigrants breaking ranks with his opposition to free trade. I consider both political parties to be tragic failures, Mr. Dobbs said.
United Stations Radio Networks, a private company that syndicates one-minute financial updates by Mr. Dobbs, is producing the program. Asked if any station had committed to carry it, a company spokeswoman said that it was only now starting its outreach.

Thank you for your recent correspondence to the Office of the Citizenship and Immigration Services Ombudsman (CIS Ombudsman).
We greatly appreciate your comments regarding issues concerning AC21 processing at the Service Centers. As we have received several inquiries such as yours, we are currently discussing these issues with USCIS and reviewing their policies and procedures regarding these petitions.
If you have evidence of a specific I-485 case that you feel was erroneously denied due to USCIS not adhering to AC21 guidelines, we kindly ask that you please forward us a copy of your denial notice or provide further detail as to the reasons for the immediate denial.
Please submit information via email to cisombudsman@dhs.gov with the subject AC21 Evidence of Immediate Denial. In addition, for protection of privacy we ask that you please omit any personally identifiable information such as names, a-numbers, case numbers, etc.
Thank you for your cooperation.
This is good. Seems like now they are aware of the issue. Cheers guys for step 1.

If USCIS wants to do bad regulations, they will do it - with or without IV campaign for reform. What is the gaurantee that Michael Aytes will not issue a memo tommorrow restricting job movements further? They always keep doing that every now and then, on their own.
Given the current volume of changes 350,000 apps, regulations are bound to change, one way or another. Whether you want it or not. If USCIS officers (not the top brass) feel overburdened with EAD/AP work they'll start issuing more, and more, random RFEs, NOIDs etc. to reduce their burden ( passing the burden to you). They also might introduce labor market and other restrictions to reduce the backlog by eliminating all AC21 users. What is stopping them from doing it on their own?
Evading activity under the pretext of imaginary fears will not stop USCIS tommorrow if they decide to pass tough regulations. By requesting the 'right' changes, we are making sure 'wrong' changes don't happen. For that to happen we need to get involved in the decision-making process and influence the decisions in the right direction.
Agreed. Positive intervention is always better.

They look for criminal hits, why do they care about foreclosure or credit history. The scope is to look for undesirable elements who are a National Security risk. It has nothing to do with credit history.
The sad part is that we have no criminal history and we still get stuck because of a problem with their process, there is no recourse, you can write to any one you want. WOM can work but thats about it...if people continue filing WOM they might come up with something else to block WOMs too. The term 'national security' is pretty powerful, credit history would mean that half of this country would not be eligible to stay here
Would appreciate if anyone can reply to my question....

Is it possible to change category to EB2 with same employer/same job?
I have the same question as I think, it is not possible. How can you re-apply for the same job you are in currently, in EB2?

I didn't get the phone# for USCIS compaint dept. But some one(may be ashres11) posted one phone#18003238603 for DHS. I called that number and it turned out Inspector General office. As i reported earlier. He told me to call regular USCIS 800. I said it's useless. He took some note and asked to call this new number 877-246-8253.

I've seen many job ads asking for US citizens or GC holders only. That implies that EAD and H1B holders cannot apply. And at the same time at the end of the ad, u can see a text that says "xxx is an equal opportunity employer". Though both the statements are contradictory, companies post such ads. Not sure though if companies are allowed to have such policies. If so, why?
Pls refer the link from DOJ posted above. It clearly states that "US citizen and "green-card" (i.e., permanent resident) only policies are generally prohibited, unless required by law, regulation, or government contract"

wonder why are we not writing letters to Michael Aytes?
We are writing to the highest authority (President) and then contacting all top administrative officials who will be deciding and advising on our provisions.

No need to worry.
People write letters all the time to the president and first lady, FBI, USCIS, etc etc when they are stuck in namechecks.
The thing is why should be force ourselves to write letters when we are in deep sh** like namechecks ourselves.
Why can't we do it when we can do it as a large group of people and not being selfish for once. I think this is our chance to stop being a lone voice when nobody hears us. In this campaign we can show how important our issue is and how desperately we want it to be fixed.
BTW I am going to post a handwritten letter. I have heard it works better.
Very good idea. Hand written letter - way to go. Everyone can do this.
Maybe we can write with blood(just kidding)

We should send emails to Jon Stewart, Stephen Colbert, Jay Leno, David Letterman, Conan O'Brian, Jimmy Kimmel etc.
They have tremendous amount of viewership and seems like a perfect material for these shows. I will send email to these guys but if more and more peple can make them aware of this development, this news can potentially snowball. :D
I have been sending emails, as and when I see email addresses, I think we need a YOUTUBE video recorded tomorrow. Anyone in DC?>

Hi,
My company's attorney filed for my PERM and I-140. After I-140 approval the attorney kept the original I-140 and sent me the courtesy copy of the approval. I am now going to file for my I-485 on my own.
My question is -
Can I make a photocopy of the courtesy copy of this I-140 approval and use it to file my I-485?
P.S: Courtesy copy is NOT the photocopy of the original I-140. It is a copy that USCIS sends in addition to the orinial approval.
I am in the same situation, and I plan to include photocopy of my courtesy copy of my I-140 with other docs, as I am filing AOS by myself. If anyone else had the same issue, please share your exp.

I have just upgraded my existing Vonage plan from Premium to World plan without any cost. As few guys said earlier, I remember paying $0.89 per min for India call a decade back when I was a student here - really great to experience fruits of VoIP innovation :-)
For someone who has Vonage account and want to upgrade, they can login into vonage web account, goto Billing section and click on change current plan.

You are right on the approval notice sent - cards sent
1. It took me 5 working days to receive the cards. (3rd status changed to card production ordered and on 11th the cards are in my mail box)
nrk, how long did it take after the status got updated to "Approval Notice Sent" to the cards received by you? I am assuming that "Approval Notice Sent" on 485 is actually mailing the cards out to the applicant. ( That is what happens on 765 (EAD) application all the time).
