If the Immigration Officer is kind enough you can ask if the Name Check is cleared. If he/she says No, you can ask him/her the date it was sent to the FBI.

I am really surprised by the meek response...what is wrong with everyone?? We have just abt 54 letters so far and almost 200 members online right now !!!
If you are reading this but have not written a letter yet, please answer one question for me:
What is the least effort that you can put towards your immigration?

I personally do not travel through a country that are biased and requires a transit visa for specific countries only. If you think about it, most of the international flights are full of us, Indians. If everybody (including Indians with GCs, that do not require a transit visa) start boycotting such airlines/country transits, then they will have to change this policy.

I've been current since July, 2010 and got RFE on Sept 10, 2010. I don't have letter with me as yet to know about RFE.
Before REF, I waited for few weeks then tried followings:
1) Took infopass : Officer sent email to expedite.
2) Wrote to Senator: got reply they would get reply in 60-90 days
3) Sent an email via attorney to TSC: got automated response.
Then I got RFE after about 2-3 weeks of these attempts.

Thank you for admitting most of what I stated here true. Actually all of what I stated here as “skills” are based on my experience in IT management over the last decade. If you suddenly found my post to be stereo typing, you were blind to the stereotypes propagated in this forum for a long time.
You are wrong here. Do you know that companies like TCS/INFY/Wipro offer “blended rates” in the range of $20+/hr for keeping over 70% of staff offshore? Client directly benefits here. I have seen hypocritical companies that took tax benefits from local governments like cities and counties (which came at the expense of property taxes paid by residents of those localities) for job creation and then turned around and outsourced the very same jobs that they were supposed to create to TCS/Wipro/INFY etc., often dismissing the existing contractor pool/employees which involved people of all nationalities including H1-b workers like “TN Man” who couldn’t compete with the $30+ rates for the on-shore workers even if something was available from these vendors. Now to dump people at $30/hr rate, even though talent is locally available - like "TN Man", these vendors will abuse H1 and L1 by securing as many of these visas as they can( which were intended to bring the best and the brightest for american companies), causing Bill Gates to advocate for unlimited H1-bs when in reality, what he needs is a few thousand H1-bs which should be available in normal circumstances, had these companies not been poaching those visas.
So these offshore companies circumvented the prevailing wages through an industrial practice that should be considered “dumping”, where they dumped green-horns for the greedy clients, because the green-horns don’t have to go through any interviews in exchange of the very low rates. In this case, the people dismissed from the company/contractors were a lot more skilled, yet managers like me would be forced to start from scratch with the new pool, often resulting in delays for strategic initiatives at these companies, but the bean counters at the top never care, since their horizon is the next quarterly earning release, not what the company would do 2 years down the line (and some of these companies are the culprits behind financial crisis today with their very myopic thinking, just a sample was illustrated above)
The only jobs that were created in those localities due to such corporations in exchange for tax credits often were Indian Grocery shops opening in that locality to cater to those folks from offshore vendors. :D BTW, I don't have anything against them, I like Indian food.
I have worked with companies where I managed a 50+ member team to execute a project which at another company employing local workforce may have been done with a 12-15 person team (I have managed it both ways and hence I know that as a fact). Now the company employing the 50+ member team will often massage the numbers to show that they saved $x differential per person* 50 for the bean counters and would have secured bonuses for the higher ups because of those paper savings.
Now I think as a result of people like me interacting with US law-makers, they are getting the true picture of the abuse going on with the current processes. I understand many of you here are concerned about your own career and eventually settling in US, but once you become a permanent resident or US Citizen, you are going to face the same realities. I have seen Indian-americans who went through the GC/Citizenship process becoming some of the the fiercest critics of the current system, because (like "TN Man"), their livelihoods also are threatened by the current process. They suddenly understand that it has nothing to do with the so-called "skill" or "talent" shortage, it has everything to do with what your hourly billing rate is.
Finally your post is sensible and it paints 100% reality. Btw, do you think there will be changes in system. Heck NO. People get used to cheap $*** who can work 22 hours a day including weekends without pay or working $5 an hour. In the name of market rates, they made IT field less respectalbe than the oldest profession!!

How do we tell them to reform green cards. How do we contact them ? What channels we have? Being stuck in the EB3 conundrum, I usually find it hard to bring myself around to feeling good about the turn of fortune for folks in other categories. Yesterday was a very eventful day for me...in the afternoon my wife got approved and 12 hours later we had to call in emergency 911 to take her to the hospital as she was having such strong chills and violent shakings..we all got scared and we have a 2 and half month baby on top of that.....but with strong dose of antibiotics and drips she is better and back.....wow what a day and night.....
In any case I'll answer all your queries....I feel the option 4 is the best way to get to TSC...I have always used that....congressman's office has discretionary powers and you should use that.....use strong words it is your right......they are here to serve you unlike in India where they are there to get pocket your money....no pun for my motherland but unfortunately it is true....
Try a time frame of 4:30-5:30 EST to call the TSC or NSC for that matter...ppl are in a better mood at the end of the day and on thursdays and fridays.....ping your lawyer and ask him or her to intervene......if you know for sure your case is preadjudicated write it strongly in your mails to DHS and others.

Its a little hard to understand how the issue of 'work authorization' cannot be raised during interview or hiring process.
The details escapes me... at some point in the long past I was looking into what kind of questions employers should and shouldn't ask. If I come across anything again then I will surely post.
As far as EAD is concerned, the employers shouldn't discriminate. Especially if more than 90 days are left on it since that's the time-frame govt promises to issue a new EAD. The employer might feel better to work with a citizen or GC or a person of certain ethnic background or national origin. However, thats the kind of decisions the employer is not allowed to make. Employer has to accept EAD, everything else being equal. When the law is not followed and it harms us, we have to fight it back.
I realize employers sometime end up asking questions that they shouldn't like the obvious ones such as age and marital status.

I've sent the letters to the WH and IV. Hoping for the best.
I, however, have some questions for the senior members of the IV team. Especially for the ones who are active in the lobbying efforts in Congress and the White House. How realistic are the chances for Green card visa numbers relief, even for the longer term? It seems like there are immigrants from 2 countries - India and China who are adversely effected by the low visa numbers. If one is an immigrant for any other part of the world, it actually isnt that hard to get a Green Card thru employer sponsorship. That being the case, do you think Washington would consider this an issue that needs expedient resolution or for that matter an issue that needs a resolution at all?
Dont want to sound like a downer in this inspiring thread, but at the same time, any answers to my question will be greatly appreciated.

Emirates is good. No TV hassels. JFK to HYD trip is good because it starts at 11pm but on the way back it was little painful because you start your journey at 4 am in the morning and if you are a person like me who can't sleep at irregular hours, then it can become painful sitting for long time in the flight.
We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I stay pretty closer to Harrisburg, PA ...thanks

He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.
If anyone come across in this situation then please reply to my question.

The way I look at your story is that you want to get back at your company in some way. You were employed as L1 by your company all this while and you did not care about fraud at that time ? You were enjoying the benefits so you did not care. Now since your company is going to send you back to India anyways, you want to do everything possible to get them in trouble.
I dont support fraud in any way and I do think such companies should be punished. But you dont have my sympathy either since you think fraud is ok as long as you are benefitting from it.

To me it seems a genuine demand, We need to bring this arguement/demand forward in very rational way keeping emotions aside.
Remember, This is in addition to whatever we are doing to expedite the GC.

In my case, the first four working days of August were very difficult...as it's very hard to sit around and not do anything. I did open an SR by calling USCIS on the 5th, but I am not sure if it mattered since we received the magic email the very next day.

When I filed my I-485, the letter/job offer of my employer stated that the job will be open for me as soon as I get my green card. So when I get my EAD in 3 months, what am I going to do with it if I will not be working for my employer yet.
This is because the "green card" (GC) is based upon a future job offer. The person is not required to have worked for the GC-sponsoring employer prior to filing or obtaining the GC.

If an employer files for your green card and you do not work for the employer, it is considered a visa fraud. Also, you have to wait for 180 days after applying for I-485 to be eligible to work for an employer other than the one who filed your labor.
Since you are in the country illegally, it would probably be faster for you to get permanent residency if the new immigration bill passes.

Hi Gurus,
Please advice on the following situation. If you file a 485 thru company B as future employment(used substitution labor) and if company A for which i am currently employed agrees to file labor and assuming the dates would be current and labor is approved. Can i cancel the 485 applied thru company B and apply thru company A for which i am currently workin?

My colleagues and friends are sending e-mails to Judiciary committee members. I am preparing draft for this mail. I am going to divide this mail into sections. One section describing what H.R. 5882 is (recapture, justice against discriminatory treatment based on country of birth, USCIS efficiency) and another sections would describe what it is not (not amnesty, not an increase in numbers). I want a link to the testimony given by USCIS director in congress confirming the wastage of green cards. Can someone quickly direct me to that link?
