How did you open Infopass on aug 5th, because once SR is created they say wait for 45 days before opening infopass, as in the page where we open infopass it asks for SR#?
Can you please share what option you selected in the web page when you tried to open a Infopass appointment.

What's wrong happening in PD porting case ?? Original beneficiary is able to get a visa allocated to him by claiming he was or is eligible for EB-2 ? Where is fraud in this and as you said if law allows it and what's wrong... The point was about abusing the system to get ahead in the line. In that way labor sub shares similarity with PD porting. If a person who landed yesterday fits the job profile and the law allowed it , then what's wrong.
On the other hand if those labor are sold for a price then it is serious problem. And thats why Lab Sub was eleminated. Now thats what is going to happen (and happening) in PD porting case.

I have a question on your solution#4) "granting citizenship to people who have stayed in US for 10 years by rules to pay taxes". The 10 years ----are you talking about several years of study plus several years of working in US in H-1B visa ONLY or for any people who have legally stayed in US for 10 years??? I raise this question because I am curious to know whether I will fit this category. I was a foreign student in US for 10 years and pay foreign student tuition fee in full for 10 years. The first 6 years in several degrees and then back home and then come to US again for professional doctorate degree in 4 years. Originally I find employer to file me the H-1B visa but the quota for Master degree or above is full and then I back home until now. I am sure someone has similar situations to me!!
From other forum, someone said that it is extremely difficult to legalize the illegal aliens due to recent huge economic recession. But if each illegal aliens give non-refundable $5000 immigration entry fee to the country, the country will have about $60 billion fixed income. Then I immediately have thought about if our international students who have stayed in US for 5 years or above give more immigration entry fee to the country, the country will have tremendous cash flow into the economy and may help the economic crisis. Thanks for the compliments, I'm happy but we will be thrilled if apart from compliments, if you've said that you have just written to change.gov or to atleast one or two reps. Just spend a $10 on postage stamps. Dont think the reps dont read our letters.

Answering my own question. According to my lawyer if I use EAD, I can not use H1/H4 stamp in the passport for travel as it is no longer valid.

I also have the same question as bindas74. We both have our H1 stamped till July 2009, only my son does not have it stamped.
So if we don't apply for AP now and start using EAD and then travel outside of US can I still come back on my stamped H1 visa?

There are 37275 applications with PD of 2004 or earlier. Can we make an assumption that about 20 to 30% of these would try to port once economy turns around in the next 18 to 24 months? How will this impact wait time for a EB2 with PD Jan 2006?
I am really disappointed in the info provided via the foia effort. It told me that there are only 4118 applications before me. 4118 vs 28074. Worst kind of sick joke.
Based on the PD on my 140 Approval Notice (May-2004) there are 28074 applications before me. This is the correct date.
Based on the PD on my 485 Interview Notice (Aug-2007) there are 53192 applications before me.
I do not know how my application was counted when the data was put together.

I am upto 14 letters signed, sealed and mailed to the President. I am waiting on a few more to come....It took probably an hour over the past week. Guess what...in the process I educated over 20 Americans about our issues. Guys this can have a cascading effect if we talk to people we know and get these letters. We all need to step up and actively talk to all Americans we know and get these letters. They are our support bank when its time for larger fixes and we need Americans to call their Congressman & Senators to help us.
Talk to EVERYONE you know and get a letter signed. It would be great if everyone mentioned the number of letters they have got when they put out posts on this thread. Lets not just talk the talk but WALK the TALK!!!:D

So then we all need to agree that the person foreclosing has no right to blame the lender. It is people like you and me whose tax money will be used to bail out banks that have the right to blame them AND the borrower! :)
100% with you. What is so irritating is that these guys (both bank and the individuals) are getting away with 'nobody saw this coming'. I have been begging my friends not to get into this mess for years. If I can see this, I am sure the banking professionals, economist would have seen this too. They just wanted to make money (greedy %&*^%^&*). Probably they thought the government will bail them out since all the banks are doing it anyway. After this mess is cleaned out, no one will again talk about flipping house for a long long time:D

If you decide to apply multiple 485s with each other as dependents, then file just one first. Wait. Gets its A number and put that number in the other application. This way you will cover one pitfall of multiple filing. It will not cause confusion at USCIS end.
one thing to consider though: with the number of 485 filings that are expected in July, receipts are probably going to take 8 weeks or longer to come through (just ask teh H1B filers this year). By then the PD for the other spouse would have probably retrogressed. Another thing to keep in mind...

OK, DOS buffer issue.
A. LAW. If there is no inventory in EB2 I/C (meaning demand). Theoretically DOS should make EB2 I/C CURRENT. DOS/CIS are not that dumb, or at least as dumb as before. I would say, they are very competent now and we should appreciate their work, pre-adjudicate, publish demand data (DOS), inventory data (CIS) processing time (DOS). THEY know, from PERM, I-140, there are at least 2K demand permonth from EB2 I/C. SO they will just safely move a couple of month of PD to make sure there is demand >2800 for India/China, so they don't have to make it CURRENT (per law)
B. LOGISTICS. There could be denials, RFEs, although most (I believe almost all 100% pre-07/2007 EB2 I/C) should be pre-adjudicated now (THANK DOS CIS specifically did this so no processing time, and no waster numbers hopefully). That is why DOS has to consider that in their demand, and CIS has to consider that in inventory numbers
C TIMING. Charles is shooting a moving target as well (his job is not easy as he cannot predicate future 100% and has to follow law, and use all visa numbers, we should appreciate that). Charles has no control on CIS number accuracy (I am sure CIS is trying hard as well), how fast EB1/EB2ROW/EB2I-c pre-072007 could come in, hey even some CIS employees need vacation in summer. So he has to make sure things can be done before August, so August could be only a month for fine tuning, not massive approvals, new applications (CIS wont look at them any way but takes man power), to use up all numbers and have some new applicants to keep the inventory (demand) at decent level.
I am July 2007 PD, and we all have hopes, dreams, life, etc, can can distort our judgement. We can discuss, but may to suppoert each other, and those warriors in DC. I had a very smooth H1 stamping experience at US consulate in New Delhi on February 19. Everyone around us (atleast 4-5 people) had "PIMS Found" written on their D-156. We were sent to the premium processing line as I was revalidating the visa through the same employer. I was just asked how long I have worked for my current employer. I received my passport within 2 business days.

Thanks for your wishes. As much as I feel it as a journey I still consider myself lucky seeing so many people with PDs earlier than me both for EB2 and EB3 still languishing. We all consider FIFO to be fair and it is hard for us to decipher why it is not followed by DHS.
My suggestion to you all is that if you are told that your case is with an IO ask him or her if an email can be sent to that IO that you are concerned. This is exactly what I told Janet on Friday, one of the good CSRs from TSC. I had told her that knowing a case is with an IO is of no help to me if that IO is on vacation or is sick or is not aware that the case is current.
Also if you guys had followed my never ending streak of mails, I had mentioned that my wife had got a call from a CSR at DC probably in response to her SR that I opened or my concerned and frustrated mail to Napolitano...she was told that her case is with an IO and that since the case was transfered her Biom had not been uploaded and that she is ordering new Biom request and she should get it done...I had told her that by the time we receive it the visas may be over and also how come I am approved....moral of the story is "THEY KNOW NOTHING" as Jim Cramer used to say.
The only person I found reliable was this Ms Beck at TSC who I was fortunate to get hold of exactly 2 weeks back and she had told that we don't need new FP and Biom it just needs updating by the IT dept and she is sending a request to that effect...I had asked her how long should it take and she had told me 2 weeks..she also told me you will get your card b4 your wife.....and she may be a bit delayed but will get approved.
So guys from TSC keep trying and hope to get this Ms Beck...you can alway ask the person's batch number and name and don't waste your time if you get someone else.

50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?
I'm wondering why you ask this question. It's not your or my perception of "fair" that will drive the DOS or USCIS but the letter of law. The law is not easy to change but the interpretation of the law which shows up in the US Code (USC) can be changed. Therefore the DOS changed their interpretation to match the INA better and my or your perception of "fair" will not change anything. On the other hand it will only lead to heartbreak and destructive discussions that lead nowhere.

DECT devices made for use in the U.S. and Canada use the term DECT 6.0 to distinguish them from both DECT devices used elsewhere and U.S. cordless equipment operating in the 900 MHz, 2.4 GHz and 5.8 GHz ISM bands. It is a marketing term coined by Rick Krupka, Director of Cordless Products at Siemens, when he was pushing the FCC to accept DECT in the US and is not a spectrum band reference. The term "6.0 GHz" for DECT 6.0 phones is incorrect as they operate at 1.9 GHz, but the term DECT 1.9 might have confused customers, as they may solely interpret larger numbers as signifying a better (or later) product.
