i have three question please please anyone answer ....
1 - i have previously applied but was returned due to pd not current , what to file in the form where it say if u have appllied before ? ( i am filing on my own this time )
2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN

The employment letter should state the salary and should also say the job is full time and permanent. Also include general job description and job title matching the labor cert.
You should include your A# wherever it is asked for. You do NOT put the taxpayer ID # instead of SS#, leave it blank.
Regarding your first question. I would suggest the truth is always the truth and check the yes box to an application being filed before and add a short explanatory note with it.

yes enter till 2010 , if u can see on the left of yr 797 the i94 number might be same as yr white card ( provided u have not gone out of country ) .... that will mean that yr white card validity have been increased till 2010

After hearing your case details on the automated system..you will have to Press 3 and then you can do it yourself. Explain to the customer service rep that your case is outside of normal processing times..etc. Keep us posted what happened.

I do not remember the predictions of last year but the fact is , last year it jumped from Jan 2005 (in Feb/March) to May 2006 (in September). That definitely is a BIG movement.
You are absolutely right. More precisely, last year with a grant of >19000 visas EB2 India PD jumped an impressive ~450 days. This year's available visa is not definitely known but is for sure >9000 and may be as much as ~36000. Just keep those numbers in memory. And we wait on...

I Have opened an SR on Aug 6th and then sent an email to TSC followup . I got a response from them on friday " We are currently researching this situation and will contact you with an update." HAs anybody this kind of response?

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.
How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.

This is a very simple calculation. Following are the numbers before Oct -2006. These total to ~ 12K.
EB2-C - 3521
EB2-I - 9345
The dates will move further if more than 12K numbers are infused into the system. I would say that the dates should be in Oct - Nov 2006 range with these 12K numbers, having Nov as buffer as they may issue RFE's to folks.

current Visa bullettin does not give any info about next months...its talks about other workers..can you point to the sentence where it says it going to be april01-nov 01??..

The current visa bulletin says EB3 PDs may go back to the level that was in June 08 visa bulletin or worser. So it is very likely that EB3 will be anywhere between Apr 2001 to Nov 2001. Personally I would be happy if it remained at least beyond May 2001.
I dont see EB3 moving to 2002 unless USCIS wants to agressively move it forward, so that they can continue their unfair trend of procesing some out of order low hanging fruit cases in EB3 category, just because they are sitting on the top of their applications pile, even if they had much later PDs. Just like they are doing with EB2
What will unite people is to fight against the common pain point... *Unfair advantage given to out of order applicants* , whether it be EB2 or EB3, who are much later in the queue, but some how are on the top of application piles, and easily accessible to IOs- who are making DOS move the PDs, just so that they can clear of their tables by approving these cases, rather than trying to access applications in FIFO and follow a fair process.
The whole EB2-EB3 divide arose out of this unfair practice of USCIS. Which just on their whim move PDs forward , be it EB3 or EB2. It just happened, that EB2 date has been moved more aggressively, probably because there is less backlog there. But looking at all the EB2 people still waiting with 2003, 2004 PDs while 2006 are getting approvals, indicates that the real problem is USCIS not doing due diligence to identify the right cases to be processed next and get the exact count of such cases.
Just asking them to recapture visa numbers or cyring foul against wasted numbers etc will still not solve the problem unless we also FORCE them to follow FIFO and process cases FAIRLY. And do their due diligence to spend some time and put their application piles in proper order. Otherwise USCIS will continue to use these recaptured visas and use them to approve FU***&G Out of Order cases and manipulate & play the system to achieve that by jumping around the PD up/down/'U' and what not, just so because it is *convenient* for them to do so.

My wife had her first time H1 visa appmt at chennai on Jan 22, 08...she got her passport back the next day at the VFS counter.
I had my visa renewal appointment at Toronto on Jan 23, 08, but I had to wait for 4 business days after interview to get my passport back. I got it only on Jan 29th.

This bill recaptures all the unused visa numbers that have been lost since 1992 due to processing delays in Employment based category and Family category. It is estimated that 216000 green cards will be recaptured which would help to eleviate the employment based backlogs.
Please use the instructions provided below to make the phone calls.
(1) Call the congressman/woman office and request to speak with the aide who handles Legislative and Immigration matters
(2) If they are not available leave a VM for them -

family have any district-based connection with any of them, please reach out to these members (phone, email, fax, etc), let them know how important it is to get the bill passed this month and urge them to vote YEA on the bill. Constituent interest/support from key individuals, health care providers, recruiters and other organizations is critical at this stage.

If the HJC successfully passes the measure it will allow the full House to act on HR 5924, giving half million talented legal immigrants a ray of hope for action in 2008. Sure a very good step for USA.
The House Judiciary Committee intends to markup HR 5924, the Emergency Nursing Supply Relief Act, on Wednesday, September 10. Several other measures will also be marked up, including HR 5882, Congresswoman Lofgren's recapture legislation, HR 6020 (military), and HR 5950 (medical care for immigration detainees).
