why do you keep parroting the pro USCIS, pro -antiimmigrant line all the time?
there are times when your realism makes sense, then there are others when it's plain silly.
this was not a mistake. this was not an accident.
civil servants do not show up on weekends by accidents. and they do not do 6 mnths of work in 15 days by mistake.
it was intentional, directed and planned.
you can believe whatever motives you want and you can sympathize with uscis till kingdom come. but pleaaasee don't tell me it was a random event, some act of god that is our destiny or such crap. please!

Right but the here problem is that how to come up with written evidence of discrimination? These jerks do not send you an email "Hey, we do not consider EAD". Their pattern is generally as under.
I understand. For an analogy consider theft. You might not know who did it but you lodge a complaint with the police. Its their job to investigate. Sometimes they are successful, sometimes they are not.
In this case if the govt gets lot of complaints, and find a pattern they will investigate and find the dirt.
All I and a few others are saying, discriminating EADs is illegal, and there is a govt. agency to deal with these things. So, if anybody is a victim contact the govt. agency. By being quite we are not helping ourselves.

There are some positive news regarding this bills.
(1) As some one mentioned despite tight dead line and pressure for Energy bill House committe is attempting to Markup bill which tells lot. They must have seen light at end of tunnel so they are taking risk. They will not touch if chances are less than 99 % becasue there are lots of bills pending needs action.
(2) As per NumberUSA Senate leader is doing some thing in back door. Means there must be deal going on between dems and some reps to pass Everify- recapture bill before end of sep.
(3) Last time when (9/10 ) when bill was about to discuss NumberUSA has big RED bar for action iteam . This time it is coming back and with no of co-sponser / favor increase , number USA is missing that red bar. Means they have accepted that bill will pass.

Not true. This was the most successful media campaign so far. The flower story was in the top 5 most viewed articles today on Washington Post, and is still number 4 in the most emailed. That counts a lot. A record number of media outlets and blogs have picked it up. Even USCIS posted a statement on its home page in response.. Of course there are going to be other stories to compete in the media... it is a big and eventful world after all..

Hard to tell. FBI nor USCIS has ever published demographic information on name checks. Out of 1 million USC and and 1 million or so green cards some of them get stuck in name check. Indians and Chinese don't make up more than 10% of these people yet, most of the name check complaints on the web are from these two groups. It is hard to say if this means these are the most affected groups because many family category immigrants may not be very educated and articulate and may not be petitioning the government and being proactive. So it is very hard to say if one or the other group is more or less affected. You can however look up the below link and form an opinion yourself from the 4000 odd signatures of people stuck in name check:

All I 94 - does this mean all the I 94's you ever had or the I 94 that currently is in your possession.
I do not have copies of all the I 94's that were issued to me since my stay in US .. any body any thoughts?
Be ready with the following supporting documents. My attorney asked the following:
1. Personal Details -
(Travel Plans in the next 3 months, Moving Plans in the next 6 months, Contact Information, Passport and I-94 info, Employment Hisotry - Last 5 years+ Last job ouside US, Residence History - Last 5 years + last residence outside US, LC, I-140, EAD and details, and a few other questions, etc)
2. Passport copies- all pages, current, all old.
3. All I-20, I-94, I-797, LC, I-140 copies
4. Birth Certificates or Birth Affidavits
5. Marriage Certificate or Marriage Affidavits -
6. Sealed Medical Exam Cover - I-693

Lets treat good news for EB2 as good news for EB3 also.
If not today, some of us EB3 folks may want to port. So it will help more people to port and also to compensate to some extent the #s coming into EB2 pool from EB3.
Overall its a good news, and looks to be possible we see this on Murthy site also. Lets be happy.
Hoping for the best. Can't see waiting for another half a decade to get our GC.

Dear Sirs/Madams,
Good morning!! With reference to your previous e mail talking about "living in US for 5 years, pay taxes and get a green card". Also, " living in US for 10 years get a citizenship". It reminds me that a few days ago, from the other forum, I see someone talking about the bill "HR264", there is several items in this bill. However, there is only one section in this bill mentioned about "granting green card to people who have stayed in US for 5 years or more". I do believe the chance to pass this bill is very very small because right now the economic recession is so deep that no one knows when it will be recovered.
Also, I know some people who have won the diversity visa lottery and get the immigrant visa to US to be the permanent resident and then stayed in US for another 5 years and get the citizenship.
But some people (for example like my situation) who have stayed in US and fully paid foreign student tuition fees as a foreign student for 10 years (6 years in several degrees then graduate and then back home and then come back to US to study another advanced degree for 4 years and total 10 years as foreign student) still cannot get the green card. After I finish my doctorate degree, I got a company sponsored me the H-1B visa but the quota is full and I pack all things back to my home country until now. So I just wonder when will "granting green card to people who have stayed in US for 5 years"and whether it will be true!!!!!!!!!!!!!!!!!!
I wonder whether this 5 years only for people who have worked here for 5 years in
H-1B visa or not?????????

Sad to see how much you had to struggle, but I know and I'm one of them who are here for close to 10 years and paid taxes etc.. If 100,000 of us make the right noise, then we may be heard.
As someone here is saying, following a GC step before Citizenship makes BS to me. You have done whats needed to be a citizen (dont go by the book, doesnt even appear there is one). They have delayed it for no fault of applicants. So this is the way to correct it.
Lets say I am 10th grade student who invented a cure for cancer. Will you oppose if MIT gives me a hon. Doctorate. That may be an extreme example but what we are asking for is something much smaller and well-deserved. After 10-15 years, the only rule should be to look at the paystubs and criminal record. Not which company you worked for or how much you were **ed by X employer. The case must just be yours independent on any employer. PERIOD.
Current economic situation.. SHOW how you can contribute. There is something called timing,. so THIS is the timing to ask for Citizenship so that you can BUY HOUSES AND START COMPANIES.. and thats how you help America to come out of this.

I am looking for a Project Manager in a Tri-state area, who is extremely Hands-on with CRM and ERP Technologies. At least 3 years of experience with CRM & ERPs. Has to be able to communicate well, excellent verbal & written skills.
Knowledge of Infopath and Sharepoint is a HUGE PLUS!!! As well as any Accounting experience.
Must have a valid American Passport or American Green card!
( unfortunately on this position we cannot work with H1B or Third parties, or any other visa-status )

Heard the same from my lawyer, she has changed her tune completely in 2 days. Now she says that she is hearing the same thing and is possible. They are working through the weekend and has asked me to keep my blackberry on me at all times as they will be providing emails updates every 4 hours or if and when the said bulletin is released.
Will USICS will release on the weekend?If they have any thing it should be today or they will do it on monday evening . They will do it on monday so that they are safe and cover their skin ( always say they received 100000 Applications and they are good enough for the dates to go back)

We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I stay pretty closer to Harrisburg, PA ...thanks

Big companies like TCS cannot split or start another company as everything is associated with Brand name and other stock market regulations. They will be forced to hire citizens/GC holders with H1bs if this bill is passed in same form. USCIS will take care of small Indian bodyshoppers by RFE and asking client letters etc if they start multiple companies. Of course there will be loopholes our Indian companies will find in any law but still it will clean up H1b and L1 atleast for some extent.
They refer to ads on Sulekha and other similar portals
On another note - consulting companies will workaround by creating multiple companies and applying h1b through various companies
