One of the iv member, has stated that the I485 has been denied for his friend, upon withdrawl of 140 by his ex-employer. His ex-employer has informed USCIS, that the employee left the job on his own. Also, he quoted that "USCIS denied I485 because, ac21 can be used in case of layoffs only , not switching for jobs"
In your letter you are requesting to give RFE/NOID before denial, but the fundamental reason for denial is different in the above case. what is use of getting RFE/NOID, in that case?

From IV: IV commends the initiative taken by it's members nk2006, pd_recpaturing, ItsNotfunny and others. As these members have observed, we all know that any one who has filed for AOS/I-485 can potentially be hit with this issue, especially in the current job market situations. If you believe in the old adage prevention is better than cure, this is an action item you have to subscribe to. It will be only a matter of time the number of such denials is going to spike.
In recent weeks there has been a spate of I485 denials by USCIS in the AC21 cases. In most of these cases, the underlying I-140 has been revoked by previous employer. But AC21 regulations and related memo�s require that I485�s should not be denied based on that � provided I485 has been pending for more than 180 days and the applicant has changed to a new job that is same or similar. USCIS has been rejecting cases without even issuing a NOID � again required by AC21 regulations. So USCIS is not following AC21 regulations and related field memo�s for whatever the reasons.
Obviously this will have a very bad impact on us � in addition to tremendous amount of stress it can have very bad economic implications including loss of job. In the current economic conditions we cannot afford to lose the job change flexibility provided by AC21 regulations. IV has started a campaign to fight this.
After a brief campaign to write to Ombudsman, it has been decided to intensify this campaign and write to various officials in USCIS hierarchy. IV core members have been actively involved in coming up with a strategy and are actively supporting this effort. By sending large number of letters we can draw their attention to this issue and resolve as quickly as possible. There are other strategies that are being discussed and will be underway soon to tackle this issue. This is the first and the most important step up on which other steps depend.
I request all the members to start sending the following 4 letters. For your convenience the letters have been completely written including addresses to be sent � all you have to do is download following 4 google documents � add the date, your name and address � and send it to the address provided on each letter.

I am really surprised by the meek response...what is wrong with everyone?? We have just abt 54 letters so far and almost 200 members online right now !!!

My Wife - EB3 Labor and I140 approved (PD Dec 2006)
What should I do? Thanks in advance.

If her lawyer is quick to respond then you can keep everything ready including medicals and anytime date is retrogressed should apply immediately or the second option is apply for EAD and AP and I-485 case and go tense free and use EAD if you want to change jobs and don't worry about EB2 and EB3.

I can't believe this is happening to me. My priority date became current as of June1. My attorney has sent my wife's petition to Chicago instead of NSC. He got the petition returned this afternoon. I got my I485 approved on June 25. My wife is currently out of status. If the rumor is true, I'll be totally screwed. After 10 years in this country, a dumb mistake pretty much ruined my life.

To quote it in a much broader sense, America is not the end of the world - period! Just take it easy and enjoy life...don't freak out if the visa bulletin updates and you don't get to file your 485...we are all in this country by our free will..if we feel the rules of the land are not fair to us..each one of us is free to leave....
On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...
Agreed it is not the end of the world... but no monetary sum can reimburse the stress we've gone through and going through, the number of years worrying, the numerous decisions we've deferred, the immobility of career we've gone through... just in anticipation. They just brought all these people to the well to quench their thirst only to find out that it's but dried up.

I can send all the details .. including the evidences, can u assure me of anonymity and protection under whistle blower category ??? Dude r u kidding me ... we are talking about a complaint against a Billion Dollar firm and its resources.. do u expect me to give the details in this open forum ... Does anyone have an answer or idea as to the job title employer verification letter question ? I didn't see any response as yet so I thought I'd repost the question. So far I've only seen some suggestions on other forums that suggest filing anyways without the letter and waiting for an RFE which might then coax the employer to do the necessary then, waiting for I-140 to be approved and then filing with W-2's (or paystubs -- I don't recall) or waiting 180 days, filing without the letter, switching to a new employer after the 180 days pass and then submitting the new employer's letter.
I think you can go ahead to the HR and just ask for a letter stating that your position xxxx is still available for you and that you are paid xxxx. If not, you may receive a RFE for the letter. I have seen some people not getting a RFE for letters if they attached most recent pay stubs showing they are paid prevailing wage.
This is the letter I got for support of my I485:
Please be advised that Mr. XXXXXX is currently employed by our company. He has been employed with us since XXXXX.
His position is that of a XXXXXXXXX. His annual salary is $XXXXX per year. The position of XXXXXXXXXXXX is still available for him. We intend to continue with the permanent residency process on his behalf at this time, according to all of the terms and conditions set forth in the approved PERM application. XXXXXXX salary will be at least $XXXXX per year once the permanent residency is granted.

In form G325A and 765 there is a question which ask all other name used , what should we write as our name is same as we have written in first and last name ( my maiden name and name after marriage is same )
also if there is no middle name should we leave the space blank or write N/A

My colleagues and friends are sending e-mails to Judiciary committee members. I am preparing draft for this mail. I am going to divide this mail into sections. One section describing what H.R. 5882 is (recapture, justice against discriminatory treatment based on country of birth, USCIS efficiency) and another sections would describe what it is not (not amnesty, not an increase in numbers). I want a link to the testimony given by USCIS director in congress confirming the wastage of green cards. Can someone quickly direct me to that link?
I just got about 50 posters double the size of our regular 8x11 that have the Americal flag background. I will be putting some simple messages to support 5882 to consider immiedate recapture of visas. Also clearly asking to support EB2 AND EB3 INdia. And that we are unable to buy houses cos of this limbo.
In your messages, please suggest atleast one reason how we help the country, apart from our regular x,y,z qualifications. I will be saying It helps fixing housing crisis.
