My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.

She was very much interested in talking to them. ( I had mentioned this in my previous post, but would have got lost in the barrage of posts in the last few days)

Also, take a point to note that after August 2007, the overall volume has decreased drastically. Economy was good from Sept. 2007 to Aug. 2008, but still countries who were current, did not file as amany EB1s and EB2s compared to previous years.
Also, another point to note is that government came out with this data at this moment, because this will instill a ray of hope in every EB individual on their future prospects due to reduced filing from Sept. 2008 onwards.
If, the government came out with the same data, one year back, we would be VERY depresssed, won't we?
So, there is a ray of light at the end of the tunnel.

We are only being shown data which shows pending applications from USCIS. If USCIS releases data of how much demand by priority date they were getting then its a different thing. Because if you are then you are probably wrong. This data only tells you pending data as of Aug 2009 by priority dates. The only way you can do it with some degree of success with current public data is by looking at PERM Filing data.

Nobody is suggesting that you drop your job search, drop everything, and file a law suit. What do you do? You go and find a job elsewhere, of course. You are right, the reality is that employers may ask you questions about your visa/immigration status. But there is a better way to handle such situations. Mark had posted some great tips on that. Even after all that, you may end up in a situation such as yours - where you mentioned that 5 employers told you that they will not hire somebody on EAD. You can remain quiet about it and go about your life, or you can do something about it. Its up to you.
Think about the visa delays, retrogression, etc. You could have stayed quiet and let the lawmakers, employers and the government deal with it or you could have done something about it. There is nothing "illegal" that the government is doing by making you wait years for a green card. But you did not sit quiet about it, did you? You joined the cause of IV, you wrote letters to the President, right?
Employers have the right to make a policy or a hiring decision that they want a person with certain skill set or experience, etc. They can find a tons of reasons not to interview or hire somebody. But race, gender, immigration status, etc. CANNOT be one of the reasons or criteria. This is my understanding of the law. I believe it is written in simple English that an employer CANNOT discriminate or make hiring decisions based on immigration status unless mandated by the job requirement (such as security clearance).
You are blindly assuming that whatever the employers are doing is within legal bounds, without questioning, even when the documents (see I-9 form, or DOL's web site for example) clearly state that such practices are illegal. (I am not a lawyer, this is my understanding of the law.) All I am saying is that if I were in this situation (denied on EAD), I would write to the heads of HR, ask a lawyer if this constitutes discrimination, call the OSC hot line, ask in the forums for employment law, contact ACLU or other civil rights groups. Heck, I am not affected by this (yet), and I still did some of the above because I have the urge to find out if this is indeed discrimination as viewed by the law and if so, do something about it. You don't need written evidence for any of these.

It is not that I do not want to fight or somebody do not want to fight. How could you make the base for fighting? This other guy, with his sheer luck (And with Capital One's stupidity) could get written evidence and so he has a valid base to fight against. And without evidence, whatever you write to whomsoever authirities, it would just be a blabbering. Even as one platform if IV decides to fight against this, IV team (Or lawyers whom we appoint) will ask the evidence first to make the case. Other thing, do not forget, what we could achieve in July 2007, the base was definately a first screw up from USCIS ( That is an evidence...). Once that screw up happened we could right away make it a reference and could make it a battle point.. Do you still understand or you do not want to understand?

Hey Buddy, as far as I know when you use AC21 you loose your non-immigrant status but start working leagally. So changing H1 to the new company is not needed.
And as far as I can think, if you change your H1 to a new company at that pont it might even affect negatively on your green card process. Please check that with a lawyer.

what you said is quite possible; though the person seem to be aware of vonage deal and was little worried of possible impact on teleblend's business. (They have $49.99 unlimited India plan - simply doesn't make any sense now...) I am calling them now, Again. Usually teleblend offers good quality services at lower price than vonage or lingo. If they don't come up with a good solution, I will move to vonage by this weekend.

I think all the folks who visit this thread must send out a complaint.
Also please contact your attorneys and tell them to complain on this half baked PIMS implementation.
My wife received her approval email from Mumbai consulate yesterday. When I contacted my attorney, he asked that after she returns to the US, to send him more details and he will lodge a complaint with the DOS through his liaison.

I know that is ACT. But USCIS can interpret the provisions and make adjustments like what we are requesting. Similarly it can , IF THEY WANT TO, include a provision saying the job not only need to be in similar field, but it shall be in the same labor market because that is where you got your labor. I am not saying this is going to happen just because IVs effort.
If the intent of the similar job requirement is not to hurt the local talent because that is that job that is advertised for, the restriction of the same labor market will serve the same purpose.
That is a legitimate doubt and concern for some.

Different people react differently for the same news. I am not sure your rant has any back ground with any other post by the people you are pissed off about ;)

Since when this immigration is a BIG issue in USA...... remember the BIG Rally ?? Some of the efforts with positive intentions may have a negative consequences in the short term or a long term.
The reason I post those strong words is because negative posters seem to influence people's decisions a lot. An example is , right during the rally time, I had negative people calling my wife and frightening her about the rally. She was always confused, and did not understand if she wants to support me for my efforts on mobilization or listen to them. It took a while for us to overcome her confusion. Negative posts and negative influence impact and hinder our efforts a lot. We do not need anti immigrants to cause damage, these negative posters do more damage than anti immigrants. One negaitve post can influence many people, as such it is very difficult to draw people for a good cause these days, people just do not want to cooperate or just are not motivated, negative posters demotivate the fence sitters.
If people are positive and cooperative they influence positively, they set an example for others to follow and that is what all the positive folks do, no matter what the negative influencers say or do, positive people always remain positive and try to guide people through examples.
"needhelp" is a good example of positive motivation - she does everything she can to set an example - if people learn from her - that is what we want

1. CIR bill introduce with lots of provision for Legal immigrants such as reduction of visa numbers to 90k, some people need to apply under new points system, and higher fees for renewing H1b visa. (Supporting US government)
2. Amendments introduce for legal immigrants coming to US on H1B visa or who are on H1B visa. No renewal of your H1B visa since AC21 was removed from the original bill. (Immigrants can go back to thier home country quickly).
3. VB came out with all the dates current. Majority of the people spent approx. $4000-$5000, and time so that they are their family can have better life. On July 2 2007 VB dates will show 'U'. (Supporting US economy)

When you call up the number, on mentioning your case #, it pulls up the date on which H1b was approved.
