    I think you are doing the right thing here. My question .. what are the typical signs you need to watch out for to determine L1 violations are happening? How do you collect information / evidence that ICE or USCIS could find helpful and act upon?


    'Symptoms' of this violation are

    1. If your outsourcing partner (TCS, CTS, IBM etc) brings in a lot of resources and places them in client managed and executed projects and all these resources are supervised by client managers then there is a violation (pretty sure that more than half of the resources from these companies would be in L-1B, please refer the statistics published in this discussion).

    2. If these resources are used for any common technical skills (Java/.Net/Oracle etc) in their projects, then you can expect a violation because all L-1B petitions are approved by uscis/consulate for speciality skills/tools. If you verify most of these petitions they would be approved for some XYZ internal tool specific to these companies (couple of L-1B brothers where generous enough to share these information). If these resources are used for any other skills/tools then there is a violation. In case of Blanket L1 petitions its pretty easy because there is no blanket petition approvals for any common technical skills.

    Hope its clear to you now, please try to educate your client management first and try to avoid such a scenario, most of the times these outsourcing vendors won't budge to open up these petitions and then you have to report these cases to the corresponding authorities. One way we are doing good to L-1B resources, they can ask their organisations to process H-1Bs using this oppurtunity and come out of the bonded labour.

    .... If they can't find a guy, most companies now a days are putting off projects and wait. So your campaign on this scale will not help H1Bs at all. ...

    Total BS. Do you know how the market is. We have 2 open positions (dot net developers) that I am trying to fill up. We have got over 200 resumes in less than a week.

    So many consulting companies are offering H1-B resources at 40 to 50 dollars per hour.

    Wake up and smell the coffee.

    I am glad you are finally out of this rut. Heartiest congratulations to you again!

    I will call the CIS om. number you provided again on Monday. I got a letter in the mail from DHS (CIS Om) saying they were looking into my case and it would take anywhere between 45-90 days. I have around 10 letters from different senators, USCIS that tell me the same thing - wait 45- 90 days.

    I will keep trying....

    Hi Gurus,
    I need some help with my situation:
    After 5 years of waiting, my Labor got finally aproved thru Dallas BEC(EB3, RIR, PD: Oct'02). But my wife is in India on vacation and as per original plan will return middle of August.
    1. What are my options so I can take advantage of the PD being current for me?
    2. can I apply for I-140 and I-485 and then apply her I-485 when she returns?

    As per my knowledge, ask your wife to come back from India and file I-485 along with your petition by before Jun 30, 2007.

    If you want to wait till she comes back from India you can, but at that time (in Aug ) Cutt-off dates should be current to your PD date, If not you CANNOT file I-485 to your wife.

    I am not sure what is happening. When I went to USCIS during Infopass, the officer at the time told me that my case will be looked upon when the notice date comes up.
    MY priority date is april25 2006 and the notice date was 09/18/2007. I didn't believe him. Even I raised the question in one of the forums and other guys shot me down saying the notice date is not important. But now I got an LUD on 09/19/2007 and that was the reason why I raised this question to you as well as HIINVIN66. I am assuming that the applications are looked upon based on the notice dates. If they under EB2, pre adjudcated and visa numbers availaible, MAY BE MAYBE we get green cards. IF not, We have to keep our fingers crossed. Let see what happens.....

    That's been my understanding all along. Applications are approved per the Notice Date, provided the applicant's PD is current. But I know, we've all seen exceptions to that rule. I guess this is more relevant in your case since you're current, but I'm not, so it doesn't really matter too much anyway. I just don't want any RFEs.

    Guys,

    I am not sure what others are doing, but as somebody said a flower campaign to the guys who support us may go against us, but I think that shoudl be sent to those who dont support.
    I have written twice in the last week and today I am sending cards with a letter.

    One simple way of sending very short messages is "I am EB3-India and due to to non-availablility of visas, I am going back to INdia". And tell your qualifications. This is the same story even with PhD holders in US whose job desc doesnt qulaify for EB2 or EB1. No offense any others, as I know many others got experience while some got education.

    This is in fact true with 5 of my friends who left in 2007 just before that visa bulletin. They had good offers and they did not want to wait for the US GC.

    Just send the loud message" UNLESS YOU DO SOMETHING, WE ARE GOING BACK.". Send the message in different ways.
    And ofcors good to meet personally.

    We have learned that in all probability House Judiciary committee will finishing marking up HR5882 in the next committee meeting. The bill is likely to be brought to the House floor the following week. We have been told that if our bill(s) pass the House, Senate will include the language of the bill(s) in another Senate bill that has majority support. We must admit that the time is shot but its still possible.

    We request everyone that starting monday, please call all the members of Judiciary committee. Thanks to the members who have already made phone calls to the lawmaker's office. We request you to please call again to show your support starting Monday.

    In reality How USCIS divide 28.6% among countires - That is unknown mystery and nobody surely know that. And that is why I had to assume "equal shares - 5 part" in my analysis assuming USCIS works fairly but we all know that is a bullshit too :)

    Look at histrocial approval you will know your assumption is incorrect. ROW gets more than half the numbers in any category.
