    I did sign G-38 (whatever that number is) for attorney. Can I still send email from my end to USCIS, congressmen and all the team requesting explanation on my application?

    Why don't you dispute the charges. Dispute the amout that they overcharged. Then Credit Card company will refund you that amount and deal with Embassy themselves. Which card did you use to pay (AMEX/V/MC). AMEX is the most consumer friendly in this regards.

    I always use AMEX and I know they have a good service. Maybe that is the reason they don't accept AMEX. I also disputed the charges with my CC company and they just got back to me after a month. They require some kind of proof (which I have), but I know what they are going to say. Since the email from UK emb(ass)y clearly mention the amount of $184 and $276, they (CC company) will say the charges are correct. The trick is to catch someone at the emb(ass)y, but it will only work if their email's are working or someone out there will handle my voice mail message left on their answering machine. It is much easier for them to delete/ignore the message than to take pains to correct the situation. Remember, I am dealing with a useless govt. organization rather than a highly competitive private company.

    i dont think the country makes a big difference, i have two friends stuck in name check (one was born in canada with an english first and last name). i think its the combination of the name, DOB and a crappy system



    Thank you for your response. I filed on July 2nd. Spoke to uscis imm officer this week and they said my criminal check cleared but my name check was still pending.... Just a waiting game I guess

    I have filed my green card with her. But in all our discussions she has sided with my company's interest over mine. In fact in one of our FYI meetings, she said that getting the green card faster would not be good for companies as people would quit after that. So I am not sure whether she will take up the cause but we can try.

    I think it would be fair to split the leftover numbers the same way they split whole year quota.

    50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?


    I'm wondering why you ask this question. It's not your or my perception of "fair" that will drive the DOS or USCIS but the letter of law. The law is not easy to change but the interpretation of the law which shows up in the US Code (USC) can be changed. Therefore the DOS changed their interpretation to match the INA better and my or your perception of "fair" will not change anything. On the other hand it will only lead to heartbreak and destructive discussions that lead nowhere.

    I have verified that with my attorney. The officer should not have asked you to enter on AP. You could have entered on H1 or AP and it was up to you. This is a good example of the fact that some immigration officers do not know the rules well. If your H1 is still good, you can leave and re-enter showing H1 and you should be fine.

    Thats correct. I came back from India yesterday and i used H1 but my wife used her AP to enter at the POE.

    In filing for I-485 no one has mentioned copy of I-140 or copy of Labor cert.

    My question is how does USCIS tally an AOS application to an already approved I-140 or labor certifcation and find out the PD for the application?

    If you read the instructions, it states clearly that you need to proivde a copy of your approved immigrant petition.

    It is not good disparaging the countries needing TV by calling them idiotic and asking for boycott etc. Please know that you are living in a country (USA) which is far worse than those "idiotic" countries in this respect since 2003. US needs C1 visa for transiting through its airports even when you have a valid VISA stamp in your passport to a destination country and you need to fill eqaully gruelling application (DS 156). Also you need to carry documents for travel purposes and financial support.

    i'm utterly shocked.. dude ...u like to live in pain..u like injustice.. u should see a doctor asap!

    I just received notification that my approved 140 (which got approved way back in 2007) is now moved to USCIS. Has anyone seen this before?

    I would not trust the lawyers in any of this, because their analysis will be superficial and not even close compared to what we see here. We have around 4-5 different folks here doing some really good sound analysis, so unless it's a lawyer known to historically make accurate predictions, I wouldn't care less about their say.

    Lawyer is sharing info that some of their client have got fee invoice from NVC. I have done family based application through NVC for my parents and I know you get fees invoice almost 4 months prior to your GC interview date. So lawyer is thinking that NVC is thinking to go upto Nov 2007 in case if CIS fails to act on enough cases in last months.

    I am a dependent of my husband's process - my PD is now current, is it possible to switch and have an I-485 application where I am the primary applicant and he is the dependent, so we do not depend on his company anymore?

    I do not want to take anyone's else opportunity by getting another A#, just want to know if there is a way to switch the roles.

    To Add to what you have said, I would say getting EB2 approval is almost impossible because not only is DOL cracking down on EB2 perms because of bad economy, DOL also knows that people are trying to reapply in Eb2 to jump ahead and they are stopping that practise.

    The following information is asked in the first field of ETA form 9089.

    "1. Are you seeking to utilize the filing date for a previously submitted application for Alien Employemnt Certification (ETA 750)?"
    "1-A. If Yes, enter the previous filing date"
    "2-A. "Indicate the previous SWA or local offiice case number OR, if not available, specify the state where case was originally filed:"

    With the above information from form 9089 DOL knows the people who are trying to jump ahead by interfiling. Thats an almost gaurenteed audit. The attorneys already know this and this is the reason why many companies are not entretaining filing any EB2 perm. If anybody is lucky they might find a company willing to file eb3 perm after 6 months but no company wants to file Eb2 perm. interfiling \porting from eb3 to eb2 is a pipe dream, people cant even get eb3 approvals or alteast companies willing to file eb3 perm.


    "interfiling" to use old EB3 PD for new EB2 is not the easiest path for EB3-I guys specially if they have used AC21 and work on EAD now ( Most of us are in this category). Priority date porting is not an issue, USCIS does not have a problem with that. The problem is with "Job definition and level". While one use AC21 claims job position matching EB3 job classification and if there no enough progression gap between AC21 usage and "inerfiling" It becomes hard for a lawyer to convince USCIS that fellow is matching EB2 capability under same job classification. Hundred of such intefilings are waiting without no action from USCIS. My lawyer's advice wait till we logically can establish the skill progression, in other words minimum 3 years of wait from the day AC21 usage. And other important thing is "real promotion" in position should happen at employment and this whole explanation is based on assumption of employment at the same employer. If you change employment inbetween after AC21 usage and before interfiling , your 3 years wait cycle starts from new emploment date. I have not filed "interfiling" just because of these reasons and waiting for correct time to do that. In other words Eb3-I is really and badly screwed.

    Kudos! Thanks for the extra effort. No pain no gain.

    I sent the letters too, both to the President and Immigration Voice. But I didn't use the IV template. Wrote a 2 page letter starting from scratch using my own thoughts. I also attached a copy of my MS degree from the US and also mentioned that I am a IV member and mentioned all the major objectives of the Administrative fixes campaign.

    Not a lawyer, obviously :) , but the first line on I-9 about discrimination covers "hiring, discharging, or recruiting or referring... It is illegal to discriminate against work eligible individuals."

    Yes, "Interviewing" is not written there. And we all know that "Recruiting" or "Hiring" is not equivalent of "interviewing"

    the first contact for the congressman's office is the relevant consulate. so it doesn't hurt. it is a simple process. your boss has to sign a confidentiality release document for you and attach a cover letter. to help your boss, identify the congressman, go to the congressman's website and find out where the forms are, write a draft cover letter etc . you can do this yourself i.e enquire as a constituent just in case you don't want to involve your boss. i think it may be better that it goes through your boss

    i do think it helped prevent further delays though...
