    With all due sympathies, this is one of the funniest posts I have read in a long time....It helps to lighten up a bit every now and then considering we are all in this for a long haul...

    Anyway, just wanted to let you know that I went through London back in 2004 and my experience was completely different. I went to the NYC consulate to get my TV for $50, yes just $50 and the whole paper work etc was done in less than 30min and I had to go back after 2 hours to collect my passport with a 1 year multiple entry stamped on it.

    My point being, I think they have changed a lot of rules and made it more stringent after the recent security threats etc.

    Getting a GC soon is our saviour


    I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).

    I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).

    Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).

    It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.

    I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.

    I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

    @ Neelu:

    a. Contact your senator and your congressman/woman. I contacted both. Senator's office had a very nice system of faxing in your request, just for USCIS issues, so I did that, and got a letter in three days stating that Senator has contacted USCIS for me. Later, I got another letter which included USCIS response. If there is a number for your Senator's office, I suggest pick up the phone and get talking to them.

    b. I will get started immediately instead of waiting. You do not know if your IO is working on other EB-2 India applications. He could be working on a chunk of EB-4 applications and not even picking up your application from the holding area, where it can lie for many days.

    c. I feel that you should submit 7001 unless you believe you know where your application is. Meaning, if multiple IOs / infopass tell you the same info, then it is probably true and you can wait. If you get nebulous answers like "wait 60 days", then submit 7001. I dont think there is any reason / advantage of an attorney submitting it. I filled it out and FedEx'ed it overnight to Washington DC.

    Someone else asked me for the POJ method for TSC. I just followed the POJ instructions listed on this forum.

    I think if number of employees are less than 50 then 50% rule will not be applicable(according to 2007 proposed bill). It may be similar to that.

    But are n't they proposing 50 % rule.. how can a small desi company afford 50 % US citizen staff ? That is why may be people think consulting companies will not work.

    but what I think is it will make them less profitable. Very small body shoppers will go out of business. Med to large indian owner based consulting companies will be less profitable.

    Dear Sirs/Madams,

    Good morning!! With reference to your previous e mail talking about "living in US for 5 years, pay taxes and get a green card". Also, " living in US for 10 years get a citizenship". It reminds me that a few days ago, from the other forum, I see someone talking about the bill "HR264", there is several items in this bill. However, there is only one section in this bill mentioned about "granting green card to people who have stayed in US for 5 years or more". I do believe the chance to pass this bill is very very small because right now the economic recession is so deep that no one knows when it will be recovered.

    Also, I know some people who have won the diversity visa lottery and get the immigrant visa to US to be the permanent resident and then stayed in US for another 5 years and get the citizenship.

    But some people (for example like my situation) who have stayed in US and fully paid foreign student tuition fees as a foreign student for 10 years (6 years in several degrees then graduate and then back home and then come back to US to study another advanced degree for 4 years and total 10 years as foreign student) still cannot get the green card. After I finish my doctorate degree, I got a company sponsored me the H-1B visa but the quota is full and I pack all things back to my home country until now. So I just wonder when will "granting green card to people who have stayed in US for 5 years"and whether it will be true!!!!!!!!!!!!!!!!!!
    I wonder whether this 5 years only for people who have worked here for 5 years in
    H-1B visa or not?????????

    Sad to see how much you had to struggle, but I know and I'm one of them who are here for close to 10 years and paid taxes etc.. If 100,000 of us make the right noise, then we may be heard.
    As someone here is saying, following a GC step before Citizenship makes BS to me. You have done whats needed to be a citizen (dont go by the book, doesnt even appear there is one). They have delayed it for no fault of applicants. So this is the way to correct it.
    Lets say I am 10th grade student who invented a cure for cancer. Will you oppose if MIT gives me a hon. Doctorate. That may be an extreme example but what we are asking for is something much smaller and well-deserved. After 10-15 years, the only rule should be to look at the paystubs and criminal record. Not which company you worked for or how much you were **ed by X employer. The case must just be yours independent on any employer. PERIOD.
    Current economic situation.. SHOW how you can contribute. There is something called timing,. so THIS is the timing to ask for Citizenship so that you can BUY HOUSES AND START COMPANIES.. and thats how you help America to come out of this.

    Get over with it bunch of whiny losers. Someone can can and is willing to do the job cheaper than you.

    Think from your client's perspective:

    1. Why should he pay you more if he can get someone for cheaper price?
    2. Are you willing to do the same job for the salary that is offered by TCS, WIPRO?
    3. If you screw up , who is responsible? What can you do to mitigate damage? TCS/WIPRO can replace the whole team at free of cost to make project successful.
    4. YOU guys want to leave companies at will but the companies should not replace you at will?

    If you were bringing in value to the client that they cant get from TCS/WIPRO then you will have the job. Get some more skills, be best in the business and be smart. Know what it takes for long term success. You have to be on your toes all the time.

    STOP whining, you are just wasting time. All the best!

    Here we are discussing about a violation by companies using L-1B visa resources and we think reporting this to the agencies (ICE/USCIS) and making awareness amoung clients doesn't harm anyone who does their business within the legal frame work.

    Should your address showing up on your w2 and pay stub be matching with the address of your parent company that filed your LC for Permanent Residence? My parent company that filed for my GC is in MI and so my Labor was also filed from there and currently I am working in IL and have been filing tax return for the state of IL for the last 3 years. The addres that shows up on my pay stub and w2 is for the state of IL. As my I485 is already filed so would it matter at the time of adudication of I485 about this address issue?

    can an attorney file g28 later on if there is a RFE , who else can file g28
    Did not file this form since I prepared all the forms personally. I believe this is only needed if a lawyer files for you.

    Finally, we got the approval emails for self & wife.

    I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-

    1: The review was complete
    2: Visa numbers were requested 2 months ago and all security/prints are current
    3: Files have been forwarded to officers for completion.

    In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.

    As others have mentioned IV has played a big part throughout this journey. Thank you again.

    Congratulations Ski_dude.....I am so happy for you.....I am happy that your agony is over......

    I just verified the online status and the case is approved.I got approved in july-07, then applied for my wife (I got married after mine was filed). I have registered to post this message so that it might help anyone who is tracking...

    Details:

    RD:July 24th-07
    RFE:July-09 on bonafide marriage & late registration of birth
    Center:NSC

    This actually ends my GC journey as my 9 month old was born here.

    Question, though, does it really take 60 days to get the card?

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    I appeared for an interview on Feb 11 (H1b renewal and H4b renewal case).
    Was asked to wait a week for an email and was given the yellow form.
    Its been 16 days and no reply yet.
    Does anyone know how long the wait will be?
    How can I follow this up with the Mumbai consulate?
    Is there a way I can cancel my application and go back on AP?

    Here is a list of things you can do to protect and improve you cash cushion (and may be avoid foreclosure)

    1. If you drive one of those luxury cars that cost upwards of 25K and have paid it off. Get rid of it now. These cars depreciate more in dollar terms compared to cheaper cars. Buy a less expensive, no frill used car for 9-10K, put the difference in bank. That might bring in 10K of much needed cash. Even if you have not paid it off look for deals to sell and reduce your monthly payments.

    2. Open an account at quicken online (http://quicken.intuit.com/online-banking-finances.jsp) it is free. Connect your banks and monitor ALL your expenses carefully. Find out what portion of spending is discretionary and cut down on it.

    3. Hunt coupons, shop at Costco/Walmart (even if you hate the shopping experience). Avoid brand names and stick to Kirkland/Great Value. This might save you in monthly expenses.

    4. Also, you can add cash by working part-time. I am not talking about those hard to come software moonlighting jobs. Any job that pays 10-12 an hour will add 12 x 4hr x 5days x 4 Weeks = $960 per month.

    5. If you live in a duplex with a bathroom/bedroom downstairs, you can rent it to someone from local college/university. Underbid by quoting super low rent on craigslist and you can get $400-500 per month.

    6. Use online services like LegalZoom (or Prepaid legal from work) to prepare contracts for rentals etc.

    7. Cut down on travel/eating out and anything that you can live without. A little cash could go a long way.

    Also, when it is hard to stay put and make payments, always remember there is a silver lining in owning a house too. If there is a hyper inflation (which is very likely) rents will sky rocket and salary might go up to keep pace with it, but your home mortgage frozen in time for next 20-30 years will remain unchanged and you could potentially have lower monthly expenses compared to renters. That's a bright side of staying put.

    Guys,

    Conflicting opinions are welcome and necessary. However, pls let us eliminate the mudslinging that gets personal so quickly, just because we disagree.

    From a practical point of view, given the situation today, getting doors open for citizenship looks remote: True.

    However, in a land of immigrants, We The Legal, can stress a case for fairness. Just because we were born in a certain country and were classified by the law, the lawyer and the employer, sometimes unfairly, to be in a certain category, does not mean that we'll get into mainstream 15 years after others.

    This is why we are a part of IV. There have been past successes with IV.
    Pls let us TRY.

    Question is that there are so many July 2 filers (including me) who have not got any response yet. Therefore, it is not an isolated case. I don't know if emailing to the Director does any good, as long as USCIS keeps admitting that they have not yet sent all receipts (inspite of weekly bulletins). Until 90 days are over, I guess, USCIS will be unresponsive to individual inquiries.
