We had our interview on January 17th in chennai Consulate. Interview was smooth - which company.. how long you were working for the company and what do you do there.. these were the questions. We were told at the end that we will receive passports within a week.
So far We ( H1B extension -- 3rd time and my wife - H4( 2nd Time), have not received the passports. I already postponed our date of travel to Feb 5th. Looks like I have to postpone again.
Frustated..
Calling VFS daily to hear the same news.. Passports not been handed over VFS. The VISA is still under process.
Called Consulate Twice ... they say they are doing security checks..

Yes, USCIS works backwards, dont you see, mar 2005 is still waiting while May 2006 getting approved? There is no pattern even to the approval statuses, god only knows how they work.

I sent the letters too, both to the President and Immigration Voice. But I didn't use the IV template. Wrote a 2 page letter starting from scratch using my own thoughts. I also attached a copy of my MS degree from the US and also mentioned that I am a IV member and mentioned all the major objectives of the Administrative fixes campaign.

If AILA is telling that means there is 50% chance of rumors becoming true. If the rumors are true then State Dept and USCIS mismanaged visa numbers. Anyhow wait and see couple of days

very interesting thread ..it is more interesting than the other famous thread "how to get your maid to USA" ..no wonder some senior core members are disappointed because no one cares about other threads which talk about recapture and other campaigns.
the only point about renting the house is that it has many pitfalls too ...one of my friends tried that and he is a full time businessman ...problem is many people stop paying rent after 4-5 months ...it happened in his case plus the tenant painted the house in red and green colors.. In US it is not very easy to evict the tenant ..you have to go to court etc etc (so it is sort of full time job).
on top of it ..how do you make sure that 3-4 families are not staying in the house ...i.e. u rent it to 1 person and that person reduces his rent by renting it to 2-3 families ,... these few points are the problems that you face by renting

To quote it in a much broader sense, America is not the end of the world - period! Just take it easy and enjoy life...don't freak out if the visa bulletin updates and you don't get to file your 485...we are all in this country by our free will..if we feel the rules of the land are not fair to us..each one of us is free to leave....
On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...

I am all for it, and would support it in whatever way possible. Although not sure how it would work. It would require a gigantic change in the US laws.
I am here for past 11 years paying all possible taxes. Fortunately i was able to file 485 in 07, thru my second gc filing. Bought a house in '06 in a bold move, with the hope that gc would come thru sooner or later. Overall happy with the move to my own house (though the house value has dropped considerably since). Waiting is really painful, but I'll continue to maintain a positive outlook till then.

We need to expose the fraudulent EB1 filing by Indian companies! Under the circumstances, I think that this issue is much more relevant now! As such, I would once again like to share the information which I obtained about 6 weeks back from the local Congressman's office.
I was pleasantly suprised to learn that many Indians have been quietly writing about the fraudulent EB1 filing by Indian IT companies to lawmakers! I was told that the local office had received about 50 or so signed (hard copy) letters and that they had subsequently spoken to the INS office about this. It is a good thing that some conscientous Indians are quietly working behind the scenes for the welfare of the community.
Subsequently, I also made a letter on the subject and hand delivered the same the very next day, to the Congressman's office. I then also posted my letter to the Senators of my state.
I once again plead with all fellow EB Indian friends to write letters (please do not Email) about the fraudulent EB1 filings by Indian IT companies (TCS, CTS, L&T-IT, Infosys, Vetri software, et al) to your local congressman / senators. Please also visit your lawmakers to follow up. Personally, I feel that this very very important. IV is there to help us, but all of us must also play a role to get results
It is the strategy that will win the war, not always brute force! We should adopt a multi-pronged attach strategy, realising that each ever visa no. we get is important!
Spending about an hour of your time to write, print, sign and post could save many atleast 2 years of wait time. Did your realize this?
Imagine the impact of 1000s of covers getting dumped in your law makers' offices!
Even lawmaker's offices feel that the impact of printed and signed hard copies is much higher that Emails!
If we are united and focused, we can all win!

You wanted to buy a home, live in it for 2 years, sell it and make money. Nothing wrong with it. But, now that the market if not favorable to you, think you are not responsible for payment, and want to foreclose. All I'm saying is you are responsible for your actions; the act of buying a house, making sure you take care of it (read the contract where it says you are to take care and maintain the house to a reasonable standard), paying your monthly mortgage, insuring your home, and paying back the loan with interest by the end of the loan term. You signed the contract. You were ready to reap profits by the sale if there was equity on the home. Likewise you are to assume responsibility of payment if the home value depreciates. This is common sense. This is how the world has been. This is what they teach you as a kid. Why in the world are you complaining about depreciation when you knew this is a possibility when you bought the house?????????????????

People who meet the conditions above can benefit the US Economy in a long run because...
1)Deficits are going to be high for a long time...in trillions, and if we are allowed to apply for naturalization directly, there is a better chance for us to pay taxes to reduce the burden.
2)If we are asked to leave now, the US is committed to Social Security payments(with the minimum 40 points) even if we are outside.
3)By now, we already have kids who are American citizens... which means that when they become 18, they can always sponsor us as citizens. All that we are asking is for the congress to do the same a few years earlier. It is better we are here in our earning years than when we are in our older years.
If this Bill is introduced in congress, people will listen because...
1)People waiting for 10 years... and done all the right things, no one can simply ignore. Also, there will be a sense of guilt on the US Government to have let the situation deteriorate. They will think of ways to make the transition smoother... remember they created a special green card category for Iraqis since there was a sense of guilt.
2) Whether this passes congress or not, there is a legitimate argument of asking for the congress to rectify the situation. That is the best we can do.
3) We need to give more and more options to the congress. Not everything sticks, but even if one or two get passed, it goes a long way to help all of us.
I personally will contribute bigtime if IV core want to take this up!

The contents of this postings are based on what I have read from various Lawyer's website and my lawyer's suggestions.
Multiple I-485 Fillings Scenario:
1. Two I-485 for the with the same primary applicant
Case a: One I-140/I-485 Pending with another employer and one I-140/I-485 to be filed in July with the current employer.
Case b: One I-140/I-485 Pending due to substituted labor (and cannot be expedited because premium processing not available). Another I-485 to be filed based on approved I-140 (on one's own labor). Both from the same employer.
2. Two I-485 with different primary applicants (Primary on one and dependent on other)
Case a: I-140 for one is approved while other's pending
Case b: Both I-140 Approved
Case c: Both filling concurrently in June
Pros and Cons
Scenario 1, Case a: In this case there is a substantial risk that I-485 filed with first employer might lead to issues esp if I-140 is not approved. Thus is a good idea to file another one with current employer. (Pro)
Scenario 1, Case a: How can one Adjust the Status from two employer at the same time. (Con)
Scenario 1, Case b: Since first I-485 application is already filed and I-140's outcome is not known. It is a good idea to file another one as a fall back option. If one waits for the outcome of first I-140 and it is denied and then it will be too late to file another I-485 because dates might have retrogressed.
Scenario 2, Case a: One with the approved I-140 should file I-485 with other as dependent.
Scenario 2, Case b: I-485 for both is almost ensured and thus filling two will give added cover in case something happens. One might have a better priority date than other. (Pro)
Scenario 2, Case b: Job loss of one would still allow other with AC-21 benefits. (Pro)
Scenario 2, Case b:Only one of the two partners has to stick to the job description and other is free to pursue anything (including studies).
Scenario 2, Case c: Use I-140 Premium Processing on at least one application for added certainty.
Summary of Pros and Cons
Pros:
1. More flexibility as there are two applications to fall back on.
2. Only opportunity to file EAD/AP before retrogression kicks in.
3. Useful if I-140 is pending and outcome of it is unknown.
4. There are NO USCIS memos that prohibits such filling explicitly.
5. Many lawyers have recommended this as a best option.
6. It has been mentioned that USCIS cancels the second I-485 after approving the other. That makes this a hassle free option.
7. If there are issues with multiple filling one of the application can be withdrawn.
8. If later on it turns out two application is a norm and right thing to do and retrogression hits one has no one to blame but himself.
Cons:
1. Cost of two fillings (if paid by self)
2. There have been indications by lawyers that two fillings could lead to unnecessary delays and interviews.
3. Apart from delays there has been indications that USCIS might issue an
RFE and ask to choose one.
Conclusion
========
There is nothing wrong with two filings, worst case scenario could be an RFE from USCIS to choose one. Best case scenario is USCIS upon approving one cancels other. Two filings indeed give you a peace of mind and reduce risk during the process. It doesn't change the outcome (like your application will not be denied just because you have filed two). If a little delay is acceptable to you as a price you pay to reduce a bigger risk and added benefits then multiple filing is right thing to do.

Let me add my 2cents here.
This came up when I was discussing this topic with my lawyer friend -
Person can still file for GC when he/she is at school in eb3 and after finishing school, he/she can file another one for EB2 and can port the date to earlier PD, just like eb3 person who started work instead of going to school. Remember, GC is for the future job and person can not claim that he/she needs to be employed in order for GC to be filed.
Law does provide equal opportunity to both for PD recapture (aka PD porting).
Disclaimer: I am green card holder for 6 years and personally this issue does not affect me.

1. Ball park figure is total of 218,000 visa wasted from previous years. How much of it will go to EBs (and others) will be based on how the recapture gets implemented. If we don't do anything and sit quiet, it may as well be ZERO. Nurses will walk away with the cake
