our applications were supposedly approved today. IO called home around 7:30AM.
Dependent case is being worked on though..he said we should get approval notice in 3 days.

There is nothing called h1b jobs. There is no job reserved for someone on h1b. So to say that people on l1 are taking h1b jobs is kind of funny.
At the same time, that anti-immigrant l1fraud is here to scare people and is against the community. But because most people here are not on L1, so most people are agreeing with l1fraud user. As if L1 folks are getting ahead of us, and L1 folks are taking our jobs, same mentality and outlook as that of the disgruntled programmers at programmers guild. Maybe there is nothing wrong about that because, humans as species have always behaved as part of the food chain, eating and living on the ones below us. Likewise, people here just want to blame someone else for their problems, including delay in GCs, on others on L1. So the entire focus of this thread is "l1fraud". From time to time, some anti-immigrant or someone from another site come in and divide people here without much of an effort, that we are just a bunch of losers, yes that's right, people who play into the hands of anti-immigrants and people who play into the designs of the agents of other agenda's are nothing but losers. You or your employer should have a copy of all approved I-797 H1 reciept. Isint the l-94 on there?
Yes. But I travelled to India when I was on one of those I-797s and submitted the I-94 attached at the bottom of that I-797 while travelling out. I had not clue at that time that a copy of this I-94 would be needed.
I have other I-797s with I-94s attached at bottom coz I never travelled while I was on those I-797s.
Anyways, I am not worried. What I dont have, I just dont have it. Cant do anything about it now.

I dont expect USCIS to get all emotional because of our flowers and issue an update to their updated bulletin saying they will now accept and issue green cards.
The point is that we need to make awareness that there is a HUGE community that gets affected by every move they make and that we are an active and cohesive community and also to create awareness of this debacle.
Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.

The only way out is legislation. Even this eb2 trend of approvals will end come october.
With the earlier method or the current method, EB3-I will always end up last. Vertically EB3-ROW gets the excess visas (old method), horizontally EB2-I gets the excess visas (new method). So, either way EB3-I won't benefit, the only solace being that with the current system atleast our EB2-I friends are getting their freedom faster.
For us, visa recapture or other legislative changes are the only relief.

EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.
If you want your GC faster, work with IV for country cap removal and recapture.
Have you donated a single dime for IV's cause ?We always find it easy to go against fellow immigrants than fighting the injustice at root.

My understanding is this is a forum where we can express our thoughts without any fear or prejudice.
I agree with you that the main reason for the GC delay is the two causes you have mentioned. The Country cap is based on the current law (I am not saying the law is good). However along with the main causes for the delay the fraudulent uses of EB1 visa #s are also causing extra delay. Thus along with the effort to remove the main cause of delay we should work on the other cause of delays too.
I am also agreeing that as per the current law the L1A - Senior Level Manager can get their GC processed as EB1 and get GC within six months. I agree that this is the current law.
My main concern is the misuse of this law. People who should not get L1A visa are getting L1A using fraud and taking the EB1 visas which otherwise as per law would have trickled down to EB2.
You may be ok with the fraud being done by many of the L1A visa holders and their sponsors. However I am not and I shall support any steps taken by the IV member "L1Fraud".
You may think that the spillovers are bonuses and it�s ok if we do not get them. I differ with you; I feel if someone using fraudulent methods takes our bonuses away we need to protest against that.
Regarding donating to IV think I am not accountable to you. Please note that this is a forum where everyone can express their views without attacking each other personally.

My understanding is this is a forum where we can express our thoughts without any fear or prejudice.
I agree with you that the main reason for the GC delay is the two causes you have mentioned. The Country cap is based on the current law (I am not saying the law is good). However along with the main causes for the delay the fraudulent uses of EB1 visa #s are also causing extra delay. Thus along with the effort to remove the main cause of delay we should work on the other cause of delays too.
I am also agreeing that as per the current law the L1A - Senior Level Manager can get their GC processed as EB1 and get GC within six months. I agree that this is the current law.
My main concern is the misuse of this law. People who should not get L1A visa are getting L1A using fraud and taking the EB1 visas which otherwise as per law would have trickled down to EB2.
You may be ok with the fraud being done by many of the L1A visa holders and their sponsors. However I am not and I shall support any steps taken by the IV member "L1Fraud".
You may think that the spillovers are bonuses and it�s ok if we do not get them. I differ with you; I feel if someone using fraudulent methods takes our bonuses away we need to protest against that.
Regarding donating to IV think I am not accountable to you. Please note that this is a forum where everyone can express their views without attacking each other personally.

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. 1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

I had my visa interview in Mumbai on Dec 28th. A PIMS Verfication was required for them to be able to issue me a visa. This is for an H1-B extension of stay - My six years expired in Nov. 2007 and my green card is in process.
I was told the time they are taking for procesing is 48 hours but I still have not received any notification to take my papers to the VFS center.
Has anyone in this situation already received their visa and stamped passport and if so how long did it take?

Did you have an Infopass ? Yes - which was of no use
My wife has a RFE last year so may be taht soft LUD is they r checkin may be
how many SRs did you create? Two SRs would be good - call once for your receipt number and then, after 5-10 mins have your wife call once for her receipt number.
At the end of the day they send the SRs to the corresponding service center (TSC or NSC) where it is looked at...and responded to later. (this is what the customer service rep told me).

Also, does anyone remember where the I-485 was mailed? NSC or TSC? From what I remember it was based on what state you lived in when I-485 was filed.

I would like this idea to materialize but I am just wondering how it is practical.
Except for waiting for a visa number to be available all other delays are due to the time that it takes to process a case (and also due to the country quota). In labor stage, DOL determines if there is any citizen who fit in the labor description and who is looking for a job. In 140 stage, USCIS determines if the company is in good standing and has the ability to pay. In final stage, the candidate’s biometrics is taken and his background checked. All these are essential process in adjudicating a GC case in the employment category. I just do not how all these can be surpassed and candidates handed over a GC, let alone citizenship.
Allocating recaptured visa numbers and following a sensible order is more practical in eliminating some of the delays…

I spoke to IO this morning regarding NC clearance for my family (7/2 filers). I was told whereas, my derivative's (wife and daughter) names have been cleared but there is no information on my clearance. She furthur told me the names were submitted on 8/30/07 and was told to wait for another month or so.
Guys: What is your take on this? I have started worrying now. Although they say 120 day processing time- My understanding is you are either cleared in few days or get stuck in the hole.
