My attorney's office contacted USCIS and was told that USCIS has current address on system :cool: They told that since the case is waiting for RFE it must have happend by mistake :confused:

Look around you will see.... not everybody is the same.
I personally know many who had been "working in H1B" for more than 14 years.
Not everybody gives more weightage for their "immigration plan" than some personal and career interests. If you are really truthful to USCIS about your intentions, and you keep doing what you want to do with your career and life, it is in-fact very possible that you will be found without a GC even after 10 years working in USA, if your are from India.
An approved I-140 doesnt make you "automatically" qualified for an I-485. You dont file 485, if you dont "intent" to continue with that specific employment, even after I-140 approval.
7Years???? No..... you can extend your H1 beyond 6 years as many times as you want if you meet some conditions as per AC21. So it is possible for you to be in H1B for 100 years.
10years tax payed???? Yes because of the other reasons I mentioned. Also I know many who are still in que after 14 years paying taxes.
.......... but for
#3) condition "if they have paid the tax continously for 10 years", I wonder how can this
happen unless the foreign student who has worked in US for 10 years. I heard H-1b
workers maximum have 6 years plus 1 year extra for extension total add up to 7 years.
So how can have 10 years tax paid????

That is not an RFE. It's a welcome notice, which is expected.

I am so emotional now........just got the email, text message and message on the website changed to "Decision"
Mine, my wife's and my son's cases APPROVED!!!!
My case was in NSC. No additional fingerprinting, except one in Oct 2007, my son had to do one since he turned 14 this year....
14 years of wait is over......Praise be to God for his faithfulness and mercies

I received a phone call (WOW!) from a sweet lady from CIS Ombudsman's office. I sent letters to his office and in the letter I mentioned my cell #. Anyway she wants a real person who got deniel. I told her that my friend got deniel (IVens are my fried). Anyway, she sent an email too after I asked her to give her info so that my friend can send her his case details. Unfortunately, the email I received shortly after the conversation, looks like general and does not have her ID. Please PM me if you like to hera more about the phone call.

You know every time I hear the so called "highly skilled and educated" complaining about predatory lending, it reminds me of our maid servant in India. She would constantly get into trouble by borrowing money from her neighborhood sharks at high interest rates, and then come to my parents for help when she couldn't pay up. My parents would give her a well meaning scold, and help her out only because they knew she was illiterate.
Now I wonder how these guys like punjabi7, kumar1 and leo2606 can blame the lender only for what they got themselves into. They even go as far as claiming that moral, ethics, and scruples are all some kind of fairy tale virtues that are hardly ever practiced in real life. They even have the audacity to assume everyone else here shares their definition of what's right and wrong by saying everyone has at one point or another returned used items to stores!
Punjabi7 still insists on avoiding morals in the discussion and is persistently soliciting for "advice/options" for his so called mess.

The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.
Punjabi77, good luck to you buddy. This will pass too, don't ruin everything for $20K. You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. Do the right thing it will only make you stronger and someday you will be able to tell your kid that you did the right thing in the face of adversity and eventually not only survived it but thrived out of it.

Guys: This has become a major problem at every place. If we do not take any action, every one of us will be replaced by these BIG outsource companies with L1 and B1.
I already reported this to ICE about violations of CTS which has placed their L1's at client's place for the past 2 years. And still they have several people.
You may not believe their pay. I do not want to put a number here and it will be a shame on CTS for misusing L1. They replaced 18 American Workers at my client's pace. Whatever you guys might think, this is a FRAUD.
This is exactly what I have been arguing for in another thread about the Grim visa numbers. I will fully support you in your cause and let me know if you need any help. I am a GC holder but I feel its my duty to report this fraud against all these outsourcing companies.

In filing for I-485 no one has mentioned copy of I-140 or copy of Labor cert.
My question is how does USCIS tally an AOS application to an already approved I-140 or labor certifcation and find out the PD for the application?

Big companies like TCS cannot split or start another company as everything is associated with Brand name and other stock market regulations. They will be forced to hire citizens/GC holders with H1bs if this bill is passed in same form. USCIS will take care of small Indian bodyshoppers by RFE and asking client letters etc if they start multiple companies. Of course there will be loopholes our Indian companies will find in any law but still it will clean up H1b and L1 atleast for some extent.
I agree. Sometime back when I was actively looking for jobs, Infosys was hiring local candidates which means EAD, GC and Citizens trying to augment their workforce with local candidates. As I was on EAD they asked me to come for interview. The salary level they were willing to offier is so low that it will just never work out and I did not even go forward.
If these companies want to hire local candidates -they cannot treat them like they treat h1 or l1 holders - it is going to be interesting.
On one side they need to be in business and on other side they HAVE to hire locals which means lesser profits.

This included efforts from some very hardworking IV people who did not spend time on the forums but went out and collected 100s of letters, one collected more than a thousand letters. So i am guessing that not more than 2000 EB folks got their collective butts to participate in the letter campaign.
