What Pappu says is right. Ppl have been so impatient that they're bombarding USCIS with SRs, emails, letters from attorneys, Infopass etc..etc...etc...I understand the anxiety but isnt this a bit 2 much? I was no exception to this. I raised an SR on the very first day my date got current and on trying to followup on the SR the very next week, I stumbled upon a clearly tired second level IO who didn't like the way I was pushing for it. He clearly explained to me that there was no need to worry as the dates were current and everyone who was current and cleared of security would be approved as there were several visa numbers available and he also told me that there have been thousands of calls received everyday and its becoming really hard for them to handle the situation. I could see how tired and frustrated he was. I immediately understood their plight and just waited without any further action and within a span of 15 days after that call, I got my approval. My attorney also advised me to wait as he was sure the dates were gonna be current the next month as well and followups would only result in delays.
Well I'm not saying its wrong to be anxious. Ofcourse, its an important milestone, one that secures our future in this country and yes, its only natural to be anxious. But being anxious doesn't mean that by calling or emailing or Ombudsman etc...ur case will be approved. Try and put yourselves in the IO's shoes as well. For a moment think what it wud be like to be an USCIS first lvl/second lvl IO receiving the same call every minute from a diff person and each one trying to reach the second lvl IO with lies such as my A# on file is diff than the one on 140 OR address change etc...etc...This is ridiculous. After years of wait we resort to such shameful behavior towards the end.

Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?
My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

Did you compare Obama's tax plan with McCain's. Go to CNN and you will that you will get more from Obama than from McCain's tax cut. How is universal health care bad? There are 50million without healthcare here. Soon your company will say that it cannot pay your healthcare plans because it is getting costly. The middle men(insurance companies) maybe eating more of your money than the actual health care costs. The long lines are due to less available doctors, not because of universal healthcare.

Does it work well with Home security systems Like BRINKS? How good is the call quality if you have DSL at home. I have DSL with 1.5 MBPS download. Thus the voice garbles when you are actively downloading on Internet.
It will not work in case of power failure unless you have UPS back up for your modem. You will need standard landline to work with Brinks. I would advise to get cellular backup and make that number is first number to call in case of a break in. Burglars generally cut phone line when they become aware of security system. There have been some complaints where security companies just called the landline and since you didn't answer they left a voicemail. Logically they are suppose to all cops.

We have plans of visiting Canada in November. My card had a data entry error because of which I have to apply for a replacement card. It can take 3 months for that.
As I have no other proof of permanent residency (as I have to return the card with error), alternative is to get the I-551 stamp on the passport that is valid for 1 year. It works as a short term replacement of the acutal card.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

I have AT&T DSL, the 3 to 6 mbps plan...
Took vonage approximately 35 days back...works great....
my usual speed (tested using speedtest dot net) is around 5 MBPS download.
now the vonage setup (as you all might know) order is
1. DSL modem
2. vonage adaptor
3. your computer or router (I have a wireless router)
for the first 30 days (cancellation period) my internet bandwidth was not affect while using vonage...it used to remain around 4 to 5 mbps...
would drop down to 3 mbps when using VPN ..
but using phone (vonage phone) did not affect...
now the story seems to have changed after the cancellation period.... -:)
when I am connected to vpn (to office network) the speed is 4 to 5 mbps...
When I make a call and test the speed during the call my download speed is 0.09 MBPs...
I have started seeing this behaviour in the last 3 to 4 days....
wondering if that has something to do with the fact that the cancellation period is over -;)
anyways, can folks here share thier experience on how the speed is affected when using the phone...(I use speedtest.net to test my speed)

This is the number in red on your visa stamp in ur passport. Mine is 8-digits long. Even if ur visa stamp has expired you've to provide that number.

H1 quota will be over on day 1 also started as a rumor ..however USICS quickly jumped and clarified how they will handle the situation ..i hope the same this time also .
Only intresting thing is will they accept applications on day 1 and cover their skin ?...Then no body can question DOS/USICS as they always had a reason to defend themself....Guys what ever happens if you can file today thats fine else ..do use fedex same day service and make sure the application will reach b4 5 on monday

Doesn't DOL have a directive telling employers, they have to try to recruit US Citizens first, and only if they do not find properly qualified US Citizens they can go on to search for people having 'other work authorizations' . Isn't that the whole basis for the approval of our Labor certifications in the first place???
So can the employers not use that directive as a legal loophole and try to prescreen the candidates and ask them whether they are US Citizens or GC or EAD or H1 and so on... as a hidden ploy to figure out whether you are GC or EAD while externally they can still put on a facade that they are just strictly following the legal directives that DOL has laid out?

All these statistics are based on wage rate specified on LCA. But in many cases LCA wage is treated as a minimum wage by companies. I don't think many companies get a new LCA when the salary rises, I don't think they are supposed to. It also does not include bonuses as companies often don't know what the bonus is going to be when they apply for an LCA.
Even based on the LCA salaries 10% H1Bs in 2006 were for 100K or more. (Unlike what the programmer's guild wrongly says (1%) )

I am surprised that Capitolone did not accept EAD. I do not see any issues for them with employing somebody on EAD. Personally I think a lot of banks and other financial institutions have been neck deep in losses from the Mortgage melt down and they are laying off staff and put a halt on the hiring. I suspect this might be the case with Capitolone too and may be they do not want to admit it. Once you have an EAD do not stick with one company, apply for multiple opportunities and go with the best offer. I would advise every body with EAD to try and secure a job if they are not working currently, because with the weakening economy this will be a period where the job market will suffer.

Today i received a mail from NVC to pay immigration processing fee of $794.
Does any ones what is this for ? does it help to know the demand ?

Though you are processing through consular processing, can you please verify if you have any reasons ( Birth country, spouse birth country) etc.. to get charged against a category that is current now. If so, it is business as usual, else not sure.. you just got lucky your case is approved, but again .. with pre-adjudication, etc.. we never know.. Anything requested from USCIS, do respond in time.... On the other hand makes me wonder, if the EB2 dates can really advance that much ???? Significant forward movement based on other thread... Anyway good luck.

Is there anyone who has heard from the consulate and interviewed around that time? Also, could someone please tell me what this kentucky number is which you can call?

Highly skilled professionals in various high-technology fields currently facing a long wait of 6 to 12 years, find themselves trapped in a legal maze, and are unable to advance in their careers. Changing jobs, even with the same employer, means the process must be started over again.
Mr. President, you can make changes that would impart fairness and dignity to this arduously long process and improve the quality of life of these half a million hard-working professionals. Mr. President, I appeal to you to implement administrative reforms to:
Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
Allow visa revalidation in the United States.
Reinstate premium processing of Immigrant Petitions.The above fixes are urgently needed to fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.

I was wondering if there are any plans for a recapture campaign ? my feeling is that we should concentrate on recapture at all times ..even if it is something in preparation i.e. do some homework now itself in anticipation ..the other point is keep talking about IV and get new members ..in the last 2 days ..I came across 2 people in various stages of immigration and they did not know about IV ..and they have joined now. I guess this is the most effective way to increase membership
well - we need money for lobbying and our funding drives are not going well. As nothing has happened on the legislative front, our members are not happy. But we must not give up.

Yes, the same law can be interpreted like this:
EB1-ROW unused visa will go to EB2-ROW
EB2-ROW unused visa will go to EB3-ROW
Same for each country.
But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?
So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.
So where is the correct interpretation? Does any body know?
Don't take me wrong here. I don't favor EB3-ROW or any particular category. I am EB3-I with PD Nov 2002.
This was the law till 2000 (vertical spill over). After 2000, because of AC21, the INA got changed to horizontal spillover. This means each employment catagories are seperatly free from country quota if demand is less than supply in each catagory. If you analyze word by word in the language of the AC21 act, you will understand. Unfortunally (fortunatly for EB3) DOS has not interpreted the law correctly till 2006. Now they are interpreting correctly.
