I am applying I-485 on July 2nd based on approved I-140 PD Feb 2006
as I don't want to take chance with refiling I-140 for PD Dec 2004.
In future can I apply I-140 for labor with PD Dec 2004 & on approval can I switch the
PD for my pending I-485 if dates are current for that PD?

How about, they are expecting so many application 140 plus 485...that THEY DO NOT WANT TO PROCESS ANY APPLICATION...like always - THEY WILL SIT and EAT BURGERS and dont WANT TO DO ANY WORK...nothing new here folks...
On Monday I upgraded my I-140 at NSC to Premium Processing category. It got approved in just 3 days. It is not as if they are not doing any work. In fact I checked that the TSC I-140 dates (my successor in interest I-140 is pending here) have moved forward too.
I think they stopped premium processing I-140's now as they know there will be a flurry of AOS apps, which they would want to look at.
For the same reason, I think the AILA thing about a new interim bulletin is also a rumour.
Given a chance though, I would want to file ASAP... who won't?

ummm...not sure what that means....are you saying 'american' people can give you better advice on this matter "of leaving the house because you are moving for a different job" than 'desis'.
U tell me how wise it is to give a loan to a person without a down payment..The reason i said that other people are stupid is because.. i took an ARM loan of 5 years,, where i knew that i am not going to live in the house for more than 3 years and will later sell it..and there are people who knew that they are going to stay in the same house for more than their ARM period.. but didnt realize that they wont be able to make payment once the rate is re-adjusted.. i am calling those people's decision as stupid..
about me making a bad decision about buying a house.. well not 2 years ago..

How about signing for efax,its free for first 30 days and using that send Faxes to senators.

Foreclosure and bankruptcy will not affect your job search... especially in this market.
If you encounter a situation in future and HR questions you about bad credit or bankruptcy be honest and explain what happened and companies will understand. This is a tough economy and even millionaires are foreclosing because its the smart thing to do in a capitalist economy.
Similarly applying for bankruptcy is not bad, it is there for a reason. But remember, understand the bankruptcy laws; for example if you owe 100,000 and apply for bankruptcy the chances are the court will make you pay for it. If you owe 1mill then the court knows that you cannot pay and will dissolve it. Same applies for foreclosure, banks will help you if you cannot afford to make the payment. If you can and they think you can, you are screwed. sorry!

So isn't this implying that the PDs will advance very very further than the available visa numbers!!!!!!!!!!

The way i read that statement is that DOS is being cautious and don't want to move the dates way ahead at one go, dates will move by some degree in May and then bulletin will have projected dates for future months, this way if DOS sees demand from porting in Sept, it may not move EB2 dates at all...My 2C.

There is some comments that EB3-I can really only benefit if EB2-I goes current with the current horizontal spill over rules. Such statements are clearly misleading. Eb3-I will not directly be impacted by EB2-I being current. It just allows EB3 to get a lot of numbers which will first be used by EB3-ROW before spilling over into EB3-I.
With this change, we get EB3ROW move ahead faster, it probably would have been C had the rules been followed, and EB3 would have started moving ahead.
The only way for EB3 to move ahead is for EB3-ROW to become current, nothing else will help EB3 beyond the visa recapture (which is iffy at best). If we get USCIS to follow rules, this happens sooner, and EB3-I starts to move sooner. If not, EB3-I shall wait for a long time.

If USCIS recaptures lost visas (estimated to be in the range 300k-600k), all of us will be current. IV should start a drive to push for the recapture ....even if it is partial, it would help everybody in a big way.

Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.

Good advisory discussion. It is scary. I have a fundamental question. I heard that foreclosure and bancrupcy that is not easy anymore. A guy owe a mortgage loan for 100K, and not able to pay and forecloses it. If the bank aution the house only for 50K, he has still pay remaining amount (50K) to the bank. He cant just walk away, unless he files bankrupcy. Is that true?

1 - i have previously applied but was returned due to pd not current , what to file in the form where it say if u have appllied before ? ( i am filing on my own this time )
2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN
i will appreciate anyone answering any question please

The employment letter should state the salary and should also say the job is full time and permanent. Also include general job description and job title matching the labor cert.
You should include your A# wherever it is asked for. You do NOT put the taxpayer ID # instead of SS#, leave it blank.
Regarding your first question. I would suggest the truth is always the truth and check the yes box to an application being filed before and add a short explanatory note with it.
good luck, I filed mine and my husbands on my own, just take your time and read carefully.

Since this campaign is endorsed by IV, I think you must mention in your letter that you are a member of Immigration voice so that it is easy for IV to follow up..

Does anyone know about the W2 form and 1040 tax return forms? I currently only have W2 and 1040 for the year 2006, but my lawyer says I need to submit the past three years. Is there any problem?
