When did you realize the L1 Fraud? The day you were hired or the day you were fired?
There was story of a man who used to beat his wife after coming back from work. Apparently he was frustrated with his boss and his wife was the victim of his frustration. He soon realized a remedy to his situation. He built an effigy of his boss and hid it in a safe & lonely place. Everyday after work he used to go there and beat and curse the shit out of that effigy. He could then return to his normal family life and continue to love his wife.

Number of H1B petitions approved for initial employment: 117,536
H1B petitions for intial employment where the alien was in the US: 62,292 (53%)
This is a good proxy number for H1B for applications filed by students who have studied in the US.
54% of applicants have a master's, doctorate or professional degree. 45% of applicants have a bachelor's degree
43% (a minority) of applications are from Computer Related Occupations
Median salary for H1B in computer related occupations: $60,000
Median salary for H1B in computer related occupations for initial employment: $50,000
Median salary for H1B in computer related occupations for continuing employment: $68,000
This proves that H1B employees have the power to negotiate raises and secure better working conditions as the median compensation for continuing employment is 36% higher than that for initial employment.
After seeing this data and considering the definition of median compensation, I think a good way to approach the problem of fraud is to audit all employers paying 5% below the median for the occupation.
For e.g. if the employer happened to fall into the low compensation bucket for FY 2005, then all applications from that employer for FY 2006 would face greater scrutiny.

It is not popular to say so but I have this doubt too.
Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.
Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.
All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.
Hope AC21 don't go away like labor substitution has. :(

If all these years they were misinterpreting the law, where were lawyers and AILA raising their voice to correct this mistake? This error was deeply affecting the clients of lawyers.
We need to see more proactive activism of lawyers in matters such as these that are very important for the community. If not, members need to learn the law and do such research themselves. IV core team has been trying its best to read the law and create presentations and research documents whenever we have an important action item or bill on the floor. I would urge the community to read the law om their own as and when needed and raise their awareness.
You are right about members working on understanding the law in this forum and thrashing out arguments to make them fool proof. Instead I find people getting incensed at each other and creating a destructive environment instead of a constructive one.
As far as immigration lawyers go - they have no incentive to file a lawsuit to get a correct interpretation as they donot stand to gain whatever way the law is interpreted. Also while there definitely are a few smart immigration lawyers- the run of the mill ones are no better than paralegals. I'm not sure I should be saying the above but my experience points to that.

Now about the staff at Heathrow. Surely anyone with eyes that work can see most of them are not British at all but immigrants of some variety or another. A true Brit is a very friendly individual. The invasion of their island during the past fifty years has changed the face of the entire community, not all for the better that is for certain.
Now how do you know that, do you check their passports or do you ask them point blank about their origin. Or do you try to place them by their accent. Obviously not. The only way you can make such a blanket statement and attach an "immigrant of some variety" lable is by the looks alone. My friend, the last ten pages are precisly about such issues. Also, it is quite possible for a third generation Indian/Pakisani, a true Brit nevertheless, to work at Heathrow ... and If I borrowed your eyes for a minute, I see only an immigrant invading the country.

Godbless, I am sure you can get your post 6 years H-1B extension based on the Cornin and new Aytes memo of 12-5-2006. Can you ask your lawyer whether it is possible to file your H-1B extension after 01/26/2007 but BEFORE June 2007 or it must be filed before the expiry of your parolee I-94? Also, you said the Immigration Officer at the POE did not let you use your H visa but the AP. Is it because you showed him both of your H-1B visa and AP? If you did not show the AP, he would probably let you enter with the H-1B visa, right?

There is nothing called h1b jobs. There is no job reserved for someone on h1b. So to say that people on l1 are taking h1b jobs is kind of funny.
At the same time, that anti-immigrant l1fraud is here to scare people and is against the community. But because most people here are not on L1, so most people are agreeing with l1fraud user. As if L1 folks are getting ahead of us, and L1 folks are taking our jobs, same mentality and outlook as that of the disgruntled programmers at programmers guild. Maybe there is nothing wrong about that because, humans as species have always behaved as part of the food chain, eating and living on the ones below us. Likewise, people here just want to blame someone else for their problems, including delay in GCs, on others on L1. So the entire focus of this thread is "l1fraud". From time to time, some anti-immigrant or someone from another site come in and divide people here without much of an effort, that we are just a bunch of losers, yes that's right, people who play into the hands of anti-immigrants and people who play into the designs of the agents of other agenda's are nothing but losers. Date received is the date they received your application,Notice date is the date they entered your application was entered into their system.
So, if someone with priority date of 08MAY2006 (EB2), but with a notice date of Aug 30 2007 will get the green card earlier than someone with priority date of 20April2006 (Eb2) with a notice date of Sept 15.

My lawyer's office is saying that Non Immigrant Visa number is Control number, but what I heard and looking at different websites including here, I think it is the red number not control number.
Is there a place I can verify this? What is effect on the application if they put control number? will that affect processing of my application in any way ?

I have been a reader on this site for years and have contributed to many of the fund raising campaigns. I agree with many of the comments on this thread. Brothers and sisters we need to team up and clamour for fair treatment; let us all contribute with dollars and sweat. I assume most of us on this site can afford to contribute a lot more than we have in the past and the potential rewards (fair opportunity to Immigration) are immense.
I have personally been in the US for ten years and believe I have contributed to the society a lot - while being a law abiding tax payer (I wish I could use the word citizen). And my story is not any different from any of yours. Why then we haven't gotten what we deserve at this point, afterall we have earned it by our sweat. The reason is we haven't realized our strength: in numbers, in dollars and in our contribution to the American society. No one is going to listen until we make our plight known to the public at large and to the law makers.
Some thoughts on how to go about doing it. We need a detailed plan with names of volunteers who can contribute their time. The plan should also include a list of key law-makers we are going to contact and how. All of this will cost money - so the first thing to do is support the fund-raising efforts. I also think we need to increase the fund-raising target by a lot; because the stakes are so high.
I apologize if I have wasted anyone's time with a long post. And I thank all of you for caring for one another and by sharing so much info with all the silent readers of this site. I have learned more about immigration from this site than my employer or immigration attroneys could ever share with me.
I will now put my money where my mouth is by making a contribution to Immigration Voice.

I have applied my I485 and EAD based on EB3, I have received EAD for me and my wife, in parallel I had also applied for I140 based on my EB2 application. Now my I140 has been approved for EB2 and PD is current for EB2. I was wondering if there is any way that I can get my I485 transferred to EB2 and how can I get it done...
Could someone please suggest...
