I'm wondering if these figures actually provide ammo for people who claim that H1b is driving down salary. A $50k median starting and a $60k median is not that great.

Median salary for H1B in computer related occupations: $60,000

Median salary for H1B in computer related occupations for initial employment: $50,000

Median salary for H1B in computer related occupations for continuing employment: $68,000

Looks like it's a high time for a non-stop GC(Green Channel) airlines between US and India. Lets contact Ambani's. They of course can raise money for this within days thru their IPO or atleast influence Indian Govt to do so.

Congrats.. its bit boring to ready through your story though..

Finally got the CPO emails/texts today morning for both me and my wife.

Came to USA in 1996 on H1. Masters (F1) from 1999-2000.
All GC applications in EB2. Nationality : India.
Applied in Mid 2001 : company (think $15B!!!) went kaput.
Applied in Mid 2003 : I quit in mid-2005 - while labor pending.
    Applied Nov 22, 2005 : Approved Aug 11, 2010.

Labor applied via PERM - approved in about 4 months.
I-140 applied soon after - approved in about 4 months.
    I-485 applied during the July-August 2007.
    Receipt Date: Aug 16, 2007
    Notice Date: Oct 1, 2007
    At NSC.

    Quit in mid-2008 with 485/EAD, sent AC21.
Got RFE in Sep 2008 (missed the 2008 boat).
485 LUD stuck at 10/29/2008 forever until today.

Opened a SR on Aug 5th.
Took an infopass on Aug 6th - all I could get was, "your application is with an
Immigration Officer since Aug 2nd". Nothing else!
Don't know if either had an effect.
Didn't do anything beyond the above two.

I think anything that's helpful for anyone based on dates/apps/process/procedures are all listed above. Now for a bit of something in my mind. No particular theme but general rambling....if you so indulge..please continue. Else Have a good day and happy life. And thanks IV.

It has been a long journey for sure. A lot of my friends who came to
USA in 1996 are now citizens. I have NO regrets at all. I took my own
path. Sometimes I used to think that if I had done the GC process
in 1998/1999 instead of quitting my full time job to do full time masters,
I might've gotten GC sooner. OR what if I had stuck with the 2003 application,
sure, it would've taken longer to get even the Labor cleared but I would
have gotten GC in probably 2007 - and worst case 2008. And heck, I would
have made an additional $150K (since the company got acquired by "as big
as it gets" tech company). OR what if I had chosen a very safe choice out
of masters [believe it or not, I got 12 offers back in 2000 - but then heck,
every body else got 12 offers as well]. OH btw, the full time masters ended
up costing me about $45K in credit card loans. So yeah...no point in contemplating
all the "coulda woulda shoulda"s in life.

As Nike says: Just do it.

I strongly believe it was because of the masters that I got the first 2000/2001 company, I got into the next job - and because of it to the next one and because
of that to the current one - where I am extremely happy and think
will over time come out very well off too.

At all times, I never compromised on my job. Took the job which offered
me the most challenge and allowed me to learn as much as possible while
working the smartest folks around. That I think was a great benefit - all
along - since that component of life (work) never bothered me. And was never
afraid of taking (apparent) risks either. To me they were calculated risks.
The 2002 company I joined, it was a small startup - I was employee number 20-something and was the only H1-B until we had about 150+ employees.
When I quit it was 450+ folks and was about 750+ when it was acquired.
The company I joined in 2008 (via AC21), was and still is a startup. When
I joined we were 8 employees and still now, remain lean-and-mean but
kicking some serious ass. (if I say so myself..pardon me). :)

The biggest hiccup as I think of it now was that my wife was not able
to work from 2003-2007. But the EAD in mid-2007 finally solved that
problem. Oh, I never hesitated traveling either : travel to Africa (three
countries) one year, and to Europe (three countries) one year and
Asia (two countries other than India) in one year.
Also purchased a home in 2009 (it was very tempting during the
2004-2006 times...but waited out for good).

So yeah...H1-B/EAD/AP are all handicaps - only if you convince yourself so.

A couple of times I had contemplated Canadian PR or really
moving there or to somewhere in Europe (and even Aus PR).
But pursued nothing mostly because I was lazy.

But all along my wife fully supported in everything I (we) did.
Be it change of jobs, other big decisions..what not.
So thankful to god for that.

Just a bit to go back in the way back machine.
Long ago, labor was the bottle-neck. Then 485, then something else.
Things repeat - old is new, new is old...repeat.
There were times when there was no online checking, no sms, no email notifications.
Six year h1-cap was strongly enforced. no concurrent 140/485. No one year extension of h1. No 3 year extenstions of h1 after 140. No 2 year EADs. No AC21. No priority date porting. I can go on....but a lot of stuff happened...happens.

If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.

A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

Good luck and all the best to those who are waiting.
EB2-IC seems in pretty good shape as far as I can tell.
EB3-folks need some serious legislative help - please consider contributing a fraction of what you send for your immigration-lawyers and get something done. support IV.

    And finally: Be Happy!

    Peace.

Yes, the same law can be interpreted like this:

EB1-ROW unused visa will go to EB2-ROW
EB2-ROW unused visa will go to EB3-ROW

    Same for each country.
But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?

So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.

So where is the correct interpretation? Does any body know?

Don't take me wrong here. I don't favor EB3-ROW or any particular category. I am EB3-I with PD Nov 2002.

I remember reading statement from USCIS head (if I remember correct on Ron Gotcher's forum as well as in some immigration newsletter) that they consulted congress and other legal resources on how to interpret the unused visa overflow provisions and based upon the consultation decided to change overflow allocation from "vertical" to "horizontal".

So yes, they did change the way they used to handle the overflow but it does not seem like it was done on their own whims and fancies. It does not matter how we interpret the sections of the law among ourselves, if they got the current interpretation after consulting with congress etc. IMHO it will be very hard to make them change it back to the old way. As a government agency they can not do frequent flip-flops on policy matters - now efficiency is whole another story ;)

If I can find the links to the articles I mentioned above I'll post them on this thread.

There is no message. Just a soft update on the date. I just called USCIS and no news was disclosed and asked to wait for another 30 days for response.

India/China Quota numbers Update | Klasko, Rulon, Stock & Seltzer, LLP: Blog (http://blog.klaskolaw.com/2011/04/01/indiachina-quota-numbers-update/)

    India/China Quota numbers Update
April 1st, 2011 by William Stock
While the USCIS numbers of pending I-485 make me relatively pessimistic on movement for India and China EB-2, the State Departments internal case management staff are feeling more optimistic. In fact, we are seeing the National Visa Center issue fee bills for EB-2 India immigrant visa files with priority dates as late as November 2007, which would seem to indicate that NVC, at least, thinks the visa numbers will move at least that far ahead this year.

A caveat against reading too much into the NVC action: recall that it was imperfect information-sharing between USCIS and the State Department that led to the July 2007 Visagate debacle, and NVC likely has a small minority of the overall number of visa petitions with India and China EB priority dates in 2006 and early 2007, since so many of those beneficiaries could file for adjustment of status in July of 2007.

Its also possible that NVC is simply trying to get cases set up with fees paid and documents submitted in case the numbers stay current for the rest of the fiscal year but applicants would lose their filing fees if the numbers retrogress later this year.

We will have to wait for the May Visa Bulletin from the State Department, likely released by April 13 or so, for more detailed information on the State Departments thinking.

Counting the dates..... Thank you all in IV team; great work

And to think just sometime back we had an action item to send mails saying "Give us GCs and we will buy houses and help the economy"! What a joke!! For all the labels of highly skilled/highly educated etc. that we shower ourselves with we are no better than those idiots and irresponsible people who bought houses far beyond what they can afford and ran away putting their keys in mailboxes when going got tough.

To the original poster: You asked an advise on an open forum. You asked a favor. You can't dictate terms like just tell me options and not your opinion etc.when you ask a favor. You don't like what people have to say about you, don't ask them for help. That's the way it works. Other people have every right to be upset with you as if and when you foreclose you will be asking taxpayers - and that's us - to foot your bill.

Lou Dobbs Crusades Against Spitzers Drivers License Plan for Illegal Immigrants (http://www.nytimes.com/2007/10/17/nyregion/17dobbs.html) By NICHOLAS CONFESSORE | New York Times, October 17, 2007

ALBANY, Oct. 16 The CNN anchor Lou Dobbs calls Gov. Eliot Spitzer a genius. But not in a nice way.

I was being about as facetious as one could be, Mr. Dobbs said in an interview Tuesday as he prepared for his nightly broadcast, Lou Dobbs Tonight. For the last nine days, the show has included discussion of Mr. Spitzers plan to allow illegal immigrants to apply for drivers licenses.

Mr. Dobbs, a pinstriped journalist turned populist crusader against illegal immigration, is not a fan.

Its an abuse of power! Mr. Dobbs thundered. He is being absolutely irresponsible. When the governor of New York embarks on this kind of irresponsibility, it is national news as far as Im concerned.

And when Mr. Dobbs whose broadcast is CNNs second-highest-rated show speaks, many people listen. His relentless mockery of Mr. Spitzers decision has thrust the drivers license policy onto the national stage, helping fuel an uproar not only among New Yorkers, but among national groups opposed to illegal immigration as well.

As it happens, Mr. Dobbs was recovering from a tonsillectomy when Mr. Spitzer announced the policy on Sept. 21. But the anchorman went on the attack almost immediately after going back on the air Oct. 8, saying it was hard to imagine what this governor is thinking.

It only took him another week to conclude that Mr. Spitzer, in fact, was not thinking at all. This governor is a genius, he proclaimed disgustedly on Monday. An overwhelming majority of New York voters oppose the governor, but he refuses to back down.

With the television set on mute, the scrunch alone of Mr. Dobbss brow conveys his belief that Mr. Spitzers new policy is, possibly, the dumbest idea in the history of dumb ideas.

I think hes definitely had an effect, said State Senator Martin J. Golden, a Brooklyn Republican who was on Mr. Dobbss show on Sunday to denounce the plan. Everybodys chiming in. I get e-mails from across the country because of Lou Dobbs. I got an e-mail from a soldier in Iraq saying, Go for it, Golden, keep it up.

Mr. Golden is one of several New York elected officials most of them with more experience on New York 1 than on CNN who have been recent guests on Mr. Dobbss show. Many have expressed support for proposals by state lawmakers to overturn the license policy or to deny funding for it.

But not everyone who goes on gets supportive e-mail messages.

Jos M. Serrano, a Democratic state senator who represents parts of Manhattan and the Bronx, appeared with Mr. Golden to defend Mr. Spitzers policy, but found himself under a verbal barrage from both the host and his fellow guest. Oh my goodness, that was something else, Mr. Serrano said. I think it was my first time on national television. I wound up debating both of them Lou paid very little attention to Marty Golden and instead just kind of dug in on me.

This next morning, Mr. Serrano said, his office was bombarded with angry e-mail messages from around the country.

One guy wrote, We will derail the illegal gravy train from within, he said. I dont really know what that means. Another person said, Go back to Mexico, youre obviously Mexican. (Mr. Serrano is from Puerto Rico.) Im not nave, but I was still surprised at the level of ignorance, Mr. Serrano said.

(Mr. Dobbss correspondents have also stated on the air that illegal immigrants will need only a foreign passport to obtain a drivers license, and that Mr. Spitzers policy was instituted through executive order, neither of which is true.)

Mr. Dobbss guests and interviewees are typically opponents of the policy. A segment that Mr. Dobbs pitched on Thursday as a lively debate on the issue, for example, featured the host and two members of the State Assembly who oppose the governors plan, along with a viewers poll on whether Mr. Spitzer should be recalled. (Ninety-seven percent said yes.)

One person who has not made an appearance on Mr. Dobbss show, despite repeated invitations, is the governor himself. Christine Anderson, a spokeswoman for Mr. Spitzer, said scheduling problems had prevented the governor from appearing. The administration had made other officials available to Mr. Dobbss bookers, she said, including Michael A. L. Balboni, the governors top Homeland Security aide. But the shows producers had declined.

We dont really have a position about his show, Ms. Anderson said. That said, facts matter, and what we have endeavored to do throughout this entire debate is to make an argument about the safety and security benefits to doing this.

But Mr. Dobbs said that Mr. Spitzer, and Mr. Spitzer alone, is responsible for defending his new policy.

The man hasnt shown the gumption to come on the air and debate the issue with me, Mr. Dobbs said.

Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.

Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.

INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.

It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

if a change in interpretation is done intentionally, then USCIS admits they were allotting visas incorrectly during the previous years...if it were a public company, lawyers would be climbing over one another to file a class action suit...unfortunately all we can do is write letters, make phone calls and pray

Don't bother to ask anything about CP for people just don't care to respond!

I have tried enough on every forum including this (even whe we need a genuine information and not just predictions).

No one to be blamed! But relax, there will be a time for CP guys too!

Maybe people are not responding on the basis that they do not have any knowledge of consular processing.

I think majority of people on this forum are in the US and are adjusting status. Surely you would not want answers that were wrong or misleading.

Vonage was just responding to the competition.

Lingo has a world plan which included unlimited calling to 30 countries( India not included)
India calls were just 2 cents per minute. I switched to Lingo from Vonage 2 months back. Sensing this mass exodus, vonage came up with an even more aggressive plan.

    Competition is good !

    Hi Friends,

I am really sick and tired of my attorney. He is making money out of immigrants but he does not like immigrants based on our dicussion.
I think we are very well educated and can easily take care of 485 filing.
My attorney will charge me at least $3000 for it although I got his referral from AILA. On top of that he delays filing my PERM and 140 and having serious attitude problem.
I can easily take care of 485 filing by myself.
My only and great concern is- Is my attorney can screw up my GC processing if I fire him and file 485 on my own?

    Your Thoughts..

    Thanks!

I doubt that the lawyer would purposely hurt a former client. Its not just unethical, its really malpractice. And its not like lawyers done get fired and they cant handle getting fired.

However, please do make sure that you have all documents that you need to do your own 485 filing. If there are some documents like 140 approval or other stuff that only he has, then you will have to get it out of him, which he just might delay (a little) in case if he is an absolute nut job.

For me, I dont care what the lawyer thinks of immigrants as long as the job is done in a TIMELY manner without mistakes. If he hates immigrants and votes for Jeff Sessions, I dont care about it. All I want is TIMELINESS and ERROR FREE job. After that, he can hate anyone he wants and stick pins in voodoo dolls of immigrants.

Excellent idea JBR. Why don't you create a letter template and put it in IV. If we have the facility to sign electronically, it will be nice. Later, it can be sent electronically to all Congress Members. Let us try to create a slogan for our campaign. Any IV member can shed their ideas on this.
Is PAPPU or any IV Core members following this thread?. PAPPU we need your involvement in this and make this as another IV campaign immediately...

I'm in. Anything that has action has my support..

No point in waiting till economy improves and shit like that. Houses, jobs, Social securtity .. Project all the points in which you can improve the crisis. We can ALL also write to firms like REMAX and other reality firms to tell them we are 500 thousand here, ready to buy houses.. stupid idea.. but better than doing nothing..
