I graduated in MS (I'm on H4 currently) recently.My previous degree is from India (passed out BCOM in 1999). I dont have any IT experience.
I'm talking with couple of companies about getting a H1. What documents I need to show for H1 for USCIS? Do I need to show any experience to USCIS?

You need to have a job offer, a LCA for the job, educational evaluation, I-129 and copies of your passport/i94 and degree. A supporting letter from the employer is also needed. No experience letter is needed to apply for H1, but to get it stamped you may need it.

My brother graduated in Dec 08 and is on OPT now. He is with a consultant and he was wondering if there is any rule which states that folks on OPT should get a job in 3 months, otherwise the OPT will not be valid.
Can any one please clarify.

as far as i know that in the opt as long as you are employed its fine, even without pay employment works to keep the status active WITHOUT lapsing into the 90 day period. do tell him to cross check with his ISO

Hello All,
Brief History: I am working for a Food Processing company (A) in R&D. Company A was my sponsor for GC. I have been on EAD since Oct 2007 (filed 485 during July-Aug 2007 time period) :) . My I-140 was approved Jan 2007. My GC application was started in Apr 2006 - Perm process. Also, i still have my H1B(Extension) valid until Apr 2010. Company A uses a consulting firm for roughly about 25 - 35% of R&D projects.
Reason to change: I believe this opportunity will have a significant change/growth to my career.
Questions: :confused: Can i change my job to the consulting firm using EAD? What are the consequences i should expect from USCIS? Does the Consulting company have to get involved with any Immigration fillings?
If i decide to work for the consulting firm, i will still be doing the same job for Company A but as a consultant + I will have additional projects with other Food Processing companies. I think labor application job description won't change (Company A to Consulting Firm) and this is where i struggle to understand the rules. Need your thoughts and Advice.

Hi Folks,
I am currently on EAD and am applying for extension using e-file. I had a question on what do we fill in for 'Current Immigration Status'. The closest I can think about (as per the options given) is : DA - Advance Parole (Dist Auth).
Any comments?

Remember USCIS server sees the IP address of the proxy...
I can understand if someone is calling too many times. Looks like the USCIS computers are also feeling fed up. :p
Check the message I got when I was trying to see the details of my case online

Is premium processing option available for the this change of status?
Friend worked till last week of pregnancy (clean H1 history before). Her 12 weeks of maternity leave is ending soon and looks like the family needs to pay attention to child's condition and she has no choice but to become a full-time mom (another full-time job in itself though). She was in status during her maternity leave (some part of which was covered by STD insurance, remaining unpaid leave totaling 12 weeks under FMLA). She needs to change her status from H1 to H4.
- File for H1-H4 ASAP with in the unpaid leave window
- No premium processing available for H4

I think approved I-140 is the right stage. Why do we have to live in uncertainty after an application for immigration has been approved. It also makes sense to request AOS for 5+ years of H1 as well.

Hi !!!
i was suffered fm TB long time back around 5 yrs back .... i am scared whether due to this reason my I-485 gonna be rejected. I already went trought the full 9 months medication at that time and been fully cures as my own mamaji was a TB specialist.
Can someone suggest me if they have gone through the same case. And if i need any documents to let them know that i am fully cured because my X-ray shows that spot/scars which says that i had TB and my mamaji told me that the scars will never go because of the medcation thing?? Please help

I would transfer to a visitor visa and then identify which university and course I want to join. Once I have all the things lined up I would hire a good attorney and file for a new F1.

now where does this situation leave me? am i out of status as of now? will i be able to transfer to any university/institute for my future studies?

was your 140 approved at TSC? i read somewhere that 485 goes to the same place where 140 was approved. you may want to ask your attorney why they sent to TSC

I'm possibly in the same situation - if the company I work for gets bought and the company name changes does this complicate the process? I would hold the same job, title and everything else? This is a real possibility we already made 1/3 of the workforce redundant last week..
Or is it that the name change or the going away of the oirginal sponsor name means a re-start to the PERM stage? This is bad timing for me as I'm about to enter my 6th year of H1B - and as I understand it I cannot start a new PERM in the last year of H1B..?
What should I do - hold my breath or can I do something in the 3 months I have left before my 6th year starts??

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? USCIS denied my and my family's 485 based on withdrawl of old pending 140.
How did you come to know about your denial. Did they send a denial notice after you applied for EAD. Was there any status change on the USCIS website after your 140 was revoked by employer.

I have my I-140 approved from Company A(Future Emp) PD 2002 and 485 PENDING . Since Visa category is current.
My current company B is asking me to apply for I-485 PD 2005 and withdraw 485 from Company A. Since PD of
Company A is 2002. I dont want to loose the opportunity. Should I join Company A/ Stick with Compamy B.

thats very sad and bad on part of the HR. should always use fedEX, UPS for tracking such imp docs. anyways you can use Form I-824 Application for Duplicate Approval Notice.
google it and it should take around 3-5 months. friend of mine lost it at the photocopier and had to take this route.
