    I felt the same too since I am also in the middle of H-1B transfer and my PD is current. But I spoke to my new employer's attorney and he mentioned that they are two seperate processes and should not delay things. In most cases they are considered seperate. There is always a chance. But that is rare. Even I felt that using EAD would have been better but my EAD expired and the new company decided to do H1. So things started moving with H1 and my PD became current.


    I saw LUD on my previous H1. So don't know what's going on.




    Its just that i think if IO see's that there is an H1 transfer application pending, he may delay the AOS with the current sponsor. I am just mentally preparing myself, havent seen any change in online status.
    Looking back, it might have been better to just go with EAD, that way USCIS wouldnt even know I am changing jobs then :D

    I-485 inventory means number of 485 apps they have received or in their DB. ( simple )
    I don't think USCIS will( should ) worry about the PERM applications/140-approved applications.IMHO that' be fortune-telling business for USCIS, that so many PERM/140 approvals will directly result into so many 485 applications.

    I'm know USCIS trumped us before, but If I were to bet, I'd bet that these are straight-record count off their 485 applications.

    .... If they can't find a guy, most companies now a days are putting off projects and wait. So your campaign on this scale will not help H1Bs at all. ...

    Total BS. Do you know how the market is. We have 2 open positions (dot net developers) that I am trying to fill up. We have got over 200 resumes in less than a week.

    So many consulting companies are offering H1-B resources at 40 to 50 dollars per hour.

    Unfortunately we are all caught in it with only solution to fix is time travel and kill the beast in infancy. There is vested interest by the Govt and Banks to lend because that's the only way money is created. That explains constant rate cut cycle and stimulating artificial growth. The entire monetary system is hijacked by banks. The debt to ordinary people drives the economy and people pay that debt and interest a good part of their life. Thus collapse of big banks could lead to eventual meltdown of the system, and no wonder govt keeps bailing them out.
    In the end personal level frugal living and debt free people are constantly punished by taxing interest like ordinary income and no tax breaks. On the other hand big over leveraged spenders are rewarded with big tax breaks. Why ? Because it allows the well-oiled machinery to work.

    In last 10-12 months, this overworked (overstretched) machinery broke down because the debt (and interest) is no longer paid back. Banking system of the entire countries start to fail (Iceland, Latvia, Hungry...). What happens next is anybody's guess, but we will be collateral damage, mine and your savings will be eroded by diminished buying power due to currency printed to bail out the fundamentally flawed system.
    The sharp decline in moral and ethics is a direct result of entitlement mentality and welfare society. People feel that they deserve everything without having to pay it back and everyone who is better off must be evil. They forget that simple hardworking people can be rich by simply living debt free and with in the means.
    Finally the money from debt driven system might survive but not without huge decline in standard of living, a massive recession and permanent shift away from material possession as a central theme of life.



    It would have been ideal if they mandated 1:5 ratio. Unfortunately, with lax lending standards and unregulated banking, people made almost zero down payment (instead of the normal 20%) and bought into loans they couldn't afford in the first place.

    I would still blame the borrower 95% for all the mess.

    Hi,

    I'm in trouble situation, maybe somebody can give advice.
    I can file I-485(Eb3 March 2005). But my wife & daugther basically out of status. Their H4 visas were not extended.
    Before june bulletin I was thinking to go back home with my daughter (she is under 18) and try to get visa in consulate. It was attorney advice. Also he suggest to file for an asylym for my wife.
    Now I'm going to file I-485 for whole family regardless what attorney will tell me.
    Is it good idea to go directly to uscis office and ask them (can I file)?
    And what will happen if their apps gets denied?

    Any ideas?

    I think in your case the best thing is to go out of country with your wife and daughter, get their passports stamped, reenter us and apply 485 with the new I-94.

    This is what I think, but I am no expert...

    I read in another forum that US consulate in Canada is actually asking to fill out some PIMS form available on their website. Also you need to fax your documents 1 week prior to your appointment.

    Can anyone confirm this? Man, I wish this could be the case in India also. :confused:

    I called up to find that my application is still not in the system. Surprisingly, the IO would not put the phone down and keeps on chatting to enlighten me. Seem to have lot of time on hand.

    1. My application is most likely transfered to texas since my I-140 was approved there
    2. FIFO is valid only if the application is not transfered. Once it is transfered, the receiving center will take the date 'they' received to put in queue for data entry. If your application took continental US tour, more delay.
    3. He is asnwering 5-6 calls every day from July 2 filers. There are several of them. So plenty of July 2 apps still waiting to be entered.
    4. The application is not rejected for sure, since even a rejection would be entered into the system.
    5. he cannot raise a service request without receipt number.

    I sent mail to USCIS withe fedex scanned signature, wrote to Senator. Its frustrating.
    The bottom line is there is no bottomline, except to wait.

    For me also similar reply...From an IO.

    I would like this idea to materialize but I am just wondering how it is practical.

    Except for waiting for a visa number to be available all other delays are due to the time that it takes to process a case (and also due to the country quota). In labor stage, DOL determines if there is any citizen who fit in the labor description and who is looking for a job. In 140 stage, USCIS determines if the company is in good standing and has the ability to pay. In final stage, the candidate�s biometrics is taken and his background checked. All these are essential process in adjudicating a GC case in the employment category. I just do not how all these can be surpassed and candidates handed over a GC, let alone citizenship.

    Allocating recaptured visa numbers and following a sensible order is more practical in eliminating some of the delays�

    I was amazed to hear about the development. Would Mr. Gonzalez will show a curtsey to personally reply to all the people who sent flowers, and apolozise for the pain and emotional trauma his agency has caused to thousands of legal immigrants in this country ?

    BTW, couple of years ago one of my American (citizen) friend was dealing with USCIS (at that time INS) to adopt a baby from China. When she got the baby after struggling for 4-5 years and with a push from local congressman, she was agahst with the way USCIS treated her. I still remember her remarks "If they do not understand the pain and suffering of a mother, and they do not care for a suffering orphan child, I highly doubt that they have any more humanity left in them".

    The name has changed but the public face of the agency remains the same. Please remember that for them we are not human's, we are just file numbers sitting and rotting at their service center's.

    So when USCIS decided to forward the flowers to our soilders (which we think is an excellent idea), its not because the agency has a human touch in it, but its because they found an excellent face saving mask for their unjust action.

    Why don't you just ask those 10 guys you know are comitting fraud ( by not joining the desi consulting companies and trying to workaround etc ) which company\companies they are working with and then file a complaint with DOL about them. I am sure DOL would surely look into their workings and will very very surely find out that they are doing something illegal in other things ( even if this is not one of them ). Those companies will get blacklisted and will set an example for other companies.

    But I don't think you should stop anyone who is doing it legitimately. If one qualifies for EB2 and has been in the queue for a long time he has the right to do it.

    Please consider the after effects of filing bankruptcy and foreclosure. Your credit has a lot of things to do, its not just the credit cards or loans. It may affect even your ability to get another job. Getting another apt will be a big problem as this remains in the credit file for along time. None of the good apt complex will offer the apt, and you may be forced to live in a crime-ridden area with your family. if you cannot make the payment or you feel that your home has lost its value, ( I hate to say this) default your payment for 60-90 days and you can file to get into the new federal program where your mortgage will be adjusted to pay a smaller amount.


    I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
    Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
    I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
    Will this affect my GC process. I have no plans of buying a house in coming years.
    What might be an outcome of foreclosure, keeping in mind that i am wiating for my GC process.
    If anyone had an experiecne like this or may know someone, please share ur thought..

    My understanding is that this is incorrect:
    In the old system any unused visa from EB3 Row would got EB1 India/China first and then EB2 -I/C and then Eb3 -I/C.

    What you described ("last few rows") is what they are following now, Einstein!!!

    [Except this piece EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)]

    but then the devil is in the details ain't it? The "Except this piece" is what is overwhelmingly providing EB2 the numbers, and that is what will jump start EB3 movement forward.


    I think people don't realize that Eb3-ROW is less compared to EB2-I/C and will therefore provide EB3-I numbers sooner than if we wait for EB2-I to get current.

    And sorry, I don't support nepotism, everyone should be eligible on their own.

    I was asking for Ideas.. it is not just Kumar or some more people giving an idea that one should leave the house if the value of the house has gone down and now you have to move because of ur job and it is hard selling ur house where u may have to bear a loss ..
    I already had conversation with american people ( not any desi's) in my office and they also had the same opinion as to leave a house if u have to leave because of job..
    U tell me how wise it is to give a loan to a person without a down payment..The reason i said that other people are stupid is because.. i took an ARM loan of 5 years,, where i knew that i am not going to live in the house for more than 3 years and will later sell it..and there are people who knew that they are going to stay in the same house for more than their ARM period.. but didnt realize that they wont be able to make payment once the rate is re-adjusted.. i am calling those people's decision as stupid..
    about me making a bad decision about buying a house.. well not 2 years ago..
    i can sell the house for a loss of may be 20,000.. but why should i pay that money from my pocket.. i can keep that in my savings account and use it in my bad time..
    Well you seem to have same attitude problem as others in this situation. When people were making profit they were thankful, and now banks/system is there to blame.
    Let's see how you are not different from those "stupid" people. Keyword here is "greed". You got greedy and bought house bcoz it will appreciate. People who knew they will be living for more than 5 yrs got ARM bcoz they have to pay less/month(max. leverage), house will appreciate and/or they can refinance when time comes. Do you see any similarity ??? So please stop using derogatory words like "stupid". Banks were lending bcoz they were greedy. All the parties have one thing in common greed.
    Ok, coming back to your case. I do not have any experience with foreclosure. From your post it seems like you are losing $20k. Well this does not seem a very big amount. Consider the impact of foreclosure, bad credit will mean you will not get any loan. It will be tough to get auto or any other credit. You carry risk with background checks. I think the lending standards will get tough going forward which means you don't know for how long you will not qualify for home. In my opinion, if you have 20k and it is matter of losing some savings, not going to foreclosure looks better option.
    I hope you will learn to own up to your own mistakes, it will only make you better person in life. Good luck.

    Here is my take-

    Foreclosing on your house is asolutely legal in the USA. You can even declare personal bankruptcy if you are in a real mess.

    Ofcourse you need to evaluate the consequences of forclosing or declaring bankruptcy.

    Wall Street executives are cahsing in millions of dollars in bonuses while filing for bankruptcy. This is how the system works in a capitalist country. There is no place for morals and ethics in capitalism. It's all about playing by the rules.

    First let me state that I need people like you to proceed and hence I will be happy to answer the points you rasied to the best of my ability:

    We all agree that there is severe backlog. Only way the backlog will alleviate is by increasing visa numbers, which not going to happen any time sooner.
    So some people (and I know around 10 of them) what they are doing is the following:
    They got the chance to file their 485 last July , which is pending. They are now contacting several small desi consulting firms to file for their fresh labor in EB2 category. Once their labor is filled and new I-140 is approved, they plan to attach new I-140 to the original 485 and hence effectively convering to Eb2 category but with priority dates in 2002 and 2003 (because original I-140 had that priority). Worst, they would never join that desi consulting firm...

    This how the system is being gamed. If I know 10 such cases, I am sure there must be thousand like that.Now you tell me , isn't that unfair to the people already in Eb2 line as well as the ones who do not know how to game the system

    By the way: If any one is interested, I know of three such consulting firms that can do for you for a fee.

    you want to file a lawsuit because of 10 people you know game the system, thereby negatively impacting many more people who are moving to new jobs to climb the ladder and may benefit by the rule as a side-effect. Should you then not file a lawsuit against the people who play the game indicating that they are not even joining the company that sponsored their GC? I am now really confused whom you are against.

    Either way, I would not support any lawsuit. If someone is smarter to get his way ahead of me, it is good for him/her. I cannot blame my status on someone else's intelligence/ smartness. If I do not know how to play the game, it is my problem (it actually is, hence I am stuck). But that is OK. I am happy the way I am.
