    wow...u guys have made my decision easier...better to go via ny directly to mumbai

    I have flown on Continental from Newark to Mumbai non-stop. The best international flight experience so far! I bought the ticket online at their website. Guess what! It was almost 60% the price of lowest price travel agents were quoting on other airlines!

    The flight is a bit long lasting just under 15 hours. But, it leaves at around 8 PM. After an in-flight dinner, it is bedtime. People who have taken overnight bus journeys in India, this is not much different. If you can manage to sleep in that half sitting position (I cannot!) then it is that much better. You wake up, eat breakfast, spend 3-4 hours enjoying their inflight individual entertaintment unit, and soon it is time to land in Mumbai.

    There is no hassle with food either. Indian veg is part of their standard offering. So, no hassle of ordering AVML and hoping that they will remember to serve it to you.

    The down side:
    1) The length - at 15 hours (16.5 hours during return), it can get too much.
    2) The service is as bad as any US domestic flight.
    3) If you do not live in Mumbai or Delhi, your journey would not end with this flight.

    I see that more airlines are moving towards this long haul model with flights lasting over 12 hours. I think it is great, because we avoid all transit hassles, such as security, transit visa, etc., etc.

    Soon, AI, Jet and Kingfisher are going to enter into this market. Hopefully more cities in India will connected to more cities in US this way.

    I read somewhere in the forum that one guy contacted USCIS regarding I-140 PP and he was told by USCIS representative that they honor Postmark date. If USCIS honors Postmark date not the receive date they one must be careful sending application on June 29th.

    My case is at the local USCIS service center. I opened an SR on Aug 12 and got an email response encouraging me to apply for an Infopass appointment: "We have determined that your case would have a better result if you make an appointment to visit your local office, so you may speak with an Immigration Services Officer about your case."

    I now have an Infopass booked. Let's see what happens. My case is pre-adjudicated since we had an interview two years ago.

    Should it go any further this way, can anyone please explain the process of Ombudsman / Congressman / Senator et al?

    Today got the magic e-mail Card/ Document Production . Looks like the SR submitted 3 days back worked in my case. Prior to my SR the IO said that they don't have FP cleared, I called FBI and confirmed that they sent back my FP's and in my SR I request the IO to input the details that I got from FBI, Looks like that did the trick.

    All the best for the folks who are waiting for approval.

    Can you please pass on the steps of contacting FBI for FP clearance. Thanks and Congrats.

    Actually you should consider yourself in the same group as these so called stupid people, cannot exclude yourself as a smart person just because you did not take an ARM. Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

    Here is some real advice:
    Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

    i do not understand how overstaying and transit visas are related.
    the TV allows you to "walk from one gate to another" in the international transit area...that's all. you cannot walk OUT anyway without crossing immigration- and if you want to do that- you always need a visa. this new visa, confers (for 90 bucks per person) the right to walk to your plane- sometime the right to walk off and back on to your plane...what a joke!

    even the US now requires this so the UK only did a copycat deal, but the issue here (besides money grubbing behavior) is the way people are treated. sorry lost in space...but you do not seem to understand. if you do not step on UK soil you cannot overstay. the purported reason for this "walking visa" is security. and we all know that "security" can these days be a euphemism for treating people pretty badly. personally if i had the choice when transiting i would not go through london...ever. if nothing else the taxes are astronomical and they make the tickets more expensive most times and walking from one gate to another involves serious hassles with new security checks and long lines. and i do hope that enough people vote with their feet so the UK govt pays attention. london is too wonderful a city to lose out like this....

    When I filed my I-485, the letter/job offer of my employer stated that the job will be open for me as soon as I get my green card. So when I get my EAD in 3 months, what am I going to do with it if I will not be working for my employer yet.

    Yes you can work on EAD but join the employer after getting GC. He should support you if you get any RFC that he still intends to hire you.

    Am a new member here. Thought of posting the follow-up activities I have done till now and the results for the same.

    Details:
    PD: Oct 2005
    Center: NSC
    I485 RD: 07/26/2007
    I485 ND: 08/24/2007
    FP done only once in 2007 (forgot exact date).

    Follow-up:
    08/03/2010: Opened SR for primary (self)
    08/05/2010: Sent email to NSCfollowup. Got reply that this account address is for following up on open SRs.
    08/09/2010: Infopass appointment, did not get any useful info other than that case is being processed
    08/09/2010: Opened SR for Secondary (spouse)
    08/12/2010: Got response for 1st SR. Main gist of reply was that due to pending caseload in Nebraska, the processing time for my case has been extended :(. But the statement that got my attention was "Your application remains awaiting review by an Officer and you will be notified as soon as a decision is made. The Service is waiting for VISA availability." So called helpline again and was able to get to 2nd Level IO. She said that this statement is a mistake and that Visas are still available. Also confirmed that my case is with IO. However she said that I might be required to do FP again. The FP might be causing the delay.
    08/13/2010: Contacted local congressman and asked help for following up.
    08/13/2010: Send letter to Ombudsman

    Latest status: Still waiting, not sure what other action I can take.

    You are doing the right thing. Don't give up. Contact the Senator, if you have any other application pending (like EAD or AP) call them and try to find the status of it. Open an SR for it if needed etc...

    Thanks for the quick response, Logiclife. That makes perfect sense in your case. But as for me, where my attorney is pretty good and my employer was treating me well till now. Should I just let him file 485 for me and 485/EAD/AP for my wife? And can I file my EAD and AP on my own later? What are the consequences of doing that??

    For me, its 1 and 3. I am sick of my company's lawfirm. They are slow and they always end up filing things late. I almost lost my driver's licence renewal in April due to their procrastination and slowness in apply for H1 extension. If they do the same thing in this, then dates can retrogress and window of opportunity closes.

    Besides, I somehow feel that errors on forms are more likely when paralegals do your paperwork rather than you doing your paperwork.

    I am planning to keep a backup of all paperwork to file on my own if the lawfirm fails to file it by the 7th or 8th July. I will fire them and tell them to back off and do this on my own. I think that if they cant burn the midnight oil and work overtime during such critical times, then they deserve to lose business and we deserve to take care of our problems.

    According to the report Mexico EB3 has 2240 pending cases till the end of 2001
    and India EB3 has 1630 pending cases till the end of 2001

    Then according to current visa bulletin why does PD for India way behind Mexico???
    and even China is behind Mexico when they have only 108 pending cases till end of 2001.

    Something is wrong with the numbers or they mean something else??

    Nothing, Zilch, Nada....My lawyer said that of the 40 applications they filed on July 2nd. they got RN for only 5 so..... Seems to be a very long wait

    Our attorney sent about 50 applications and has only received abt 9 RN so far..now when we call him, he asks us to call the USCIS customer service!!

    No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.
    Don't come after me for saying this, its not my opinion. But general opinion that I have observed from people who are not well informed(read majority of people). Lets focus on the main stream media in US, outside coverage is not that significant anyway.

    For more information, we went to visit our home country and re-entered from JFK with no issue twice after 2004. We got H4 tranfered, EAD advanced Payrole too with no issue al all. Looks like "nunc pro tunc" is the solution according to Murthy. Anybody has experience with "nunc pro tunc" please post your experience. http://www.murthy.com/news/n_nunpro.html
    gc4me - I have experience using "nunc pro tunc" - and it saved my I-485 (AC21).
    I had just come back from vacation (09/01) and the Officer at the POE stamped my I-94 with the date on my visa (11/01), instead of the date of my then H1-B extension I-797 approval notice (03/03) which I had with me.
    I explained to her she had stamped the wrong date, she said that was all I was allowed. I tought this wrong so mentioned it my attorney when I got home. My attorney confirmed that the POE Officer was wrong - so drafted a letter for me to take to my local INS Office to get the card corrected - along with one of her paralegal assistants. The Officer at the INS office took one look at the letter and supporting documents and told me I was ok as the I-797 had me covered to 2003. The paralegal then typed up a eport of the meeting with the INS, saying everything was ok, and we thought that was the end of the matter.
    How wrong we were.
    I next left the US to go on vacation in November 2002. By this time I had renewed my visa through the now non-existant Department of State mail in program, got my Labour Certificate, my I-140 and had filed my I-485. The issue of my erroneously stamped I-94 was a distant memory and I had no trouble getting back into the US with the new Visa, and my I-797.

    The following Februaury my company ran into some problems and I was let go. Luckily I had passed the magic 180 days so was able to invoke AC21 and went to find a new job, which I did. My new employers were quite happy to take over the GC sponsorship as all they had to do was send a letter to the now USCIS and work with their lawyers.

    That's where the trouble started. USCIS got the letter, put it on my file and started their review of my I-485.
    They then sent me an RFE asking me to prove I had been here legally between the expiration of my old I-94 in 11/01 and when I submitted the I-485 in July 2002. (I-485 for AOS can only be submitted if you are legally in the US at time of submittal). I was devastated as it looked as though they were going to deny my I-485 due to an INS mistake.
    As it was more than 365 days from when my I-94 "Expired" till I left on my next trip, I was looking at deportation and a 10 year ban from the United States.

    Luckily it is a good thing I am a pack rat and keep every bit of correspondance between me and my lawyers. I was able to go to my new lawyers with the info and statements from my old lawyers about what had happened back in 2001 with the INS and my I-94 and after getting Sworn Affadavits (on pain of Perjury) from my old lawyer, paralegal and myself, we went to the local USCIS office and made an appointment with the Director and asked for a "Nunc pro Tunc" decision on the I-94 as it was clearly an INS mistake and that we had acted in Good Faith throughout in trusting the INS official.
    We got the "Nunc pro Tunc" and responded to the RFE. Six weeks after that - I got the I-485 Approval notice and my passport stamped the week after.

    The things for anyone to take away from my experience are.
    1. When you realize a mistake has been made - act on it immediately - like I did as soon as I left the airport on September 2001

    2. Document everything - to prove that you acted in Good Faith throughout the process.
    Every conversation you have with someone relating to your case - your employer, your lawyer, the USCIS - get the main points in writing - email is graet for this - fire off an email - get confirmation (ok - not so helpful when talking to USCIS)

    3. Keep EVERYTHING. take photocopies of I-94's, I-797's - everything. Every letter, every email. You never know when you'll need them.

    4. Yes, the Government really does know where everything is in your file and they will catch even the smallest mistake.

    Hope that helps you gc4me. If you can prove you acted in Good Faith throughout the whole process from finding the mistake and trying to correct it - your chances of getting the "nunc pro tunc" go up.

    Just Now, I received a call from congresswomen staff. She was able to get some standard response from NSC via congrees inquiry cell at NSC[she read for me]. Still 26000 application are pending NSC prior to July 17th filer. I asked again and again same question, How they can enter data for Aug first week before July 2nd. What about FIFO? She was repeating again and again what response she got from USCIS. I was able to get I-765 # from her. I asked her how come 765 (LIN#) is possible without 485 data[she don't understand inter-dependency of application]. Stange but something is better than nothing. I will write again for FIFO. I don't want USCIS actions go unnoticed. I will do my part.

    I am happy congresswomen staff did some inquiry. I will post when i received copy of USCIS official reponse to congresswomen by post/email.

    I wish I had all the data on his reporting for H1B visas. He always makes it sound like there is unlimited H1B visa available for foreign workers and nothing can be further from the truth.

    I hate to watch his show anymore but I'll from now on just to report the lies and inconsistencies he reports in his program. Let's do a "Expose Lou" campaign. I would love to spend any free time I have on this noble cause.
