    Type in congressman your city name in google or yahoo search. It will give you various names for your senator and congressmen. Call them and give them your name FN LN, DOB, Alien number and fedex / delivery tracking mnumber. They will call you back with relevant information.

    My Adjustment of status application [I-485,I-765 and I-131] based on EB3 RIR category, was delivered to Department of Homeland Security, USCIS, Nebraska Service Center, Lincoln, NE on July 2nd 2007. It was received in the mailroom at 10.25am (reference : FedEx tracking number xxxxx).

    USCIS website says NSC are working with August 2007 received AOS applications. However, I haven't heard any sort of communication pertaining to my pending application with USCIS. USCIS Customer Service would not pull up my application information in the system yet. Seems like USCIS is either not following the First in First out (FIFO) process for sure or the figures are misleading.

    This is the note I send them when I m in the call and Prakash noticed this and read this on the call . I m happy that major issue got noticed because there are lot of questions which are not related to receipt delays

    Just to answer your question . Most callers are July 2nd applications who have not received the receipts ..where as others who filed in August are receving EAD's . This is why we are here . We can send n examples regarding this

    First of all let me tell you that I am EB2 with MS from a US university. However, I do not agree to your terms! This is just not fair. If a person filed under eb3 at a point then he/she should be able to transfer it to EB2 using the same old dates. What is the problem with that mate? After all they are waiting since a long time just like us!

    Also please contact your attorneys and tell them to complain on this half baked PIMS implementation.
    My wife received her approval email from Mumbai consulate yesterday. When I contacted my attorney, he asked that after she returns to the US, to send him more details and he will lodge a complaint with the DOS through his liaison.

    Big companies like TCS cannot split or start another company as everything is associated with Brand name and other stock market regulations. They will be forced to hire citizens/GC holders with H1bs if this bill is passed in same form. USCIS will take care of small Indian bodyshoppers by RFE and asking client letters etc if they start multiple companies. Of course there will be loopholes our Indian companies will find in any law but still it will clean up H1b and L1 atleast for some extent.

    I agree. Sometime back when I was actively looking for jobs, Infosys was hiring local candidates which means EAD, GC and Citizens trying to augment their workforce with local candidates. As I was on EAD they asked me to come for interview. The salary level they were willing to offier is so low that it will just never work out and I did not even go forward.

    If these companies want to hire local candidates -they cannot treat them like they treat h1 or l1 holders - it is going to be interesting.

    On one side they need to be in business and on other side they HAVE to hire locals which means lesser profits.

    Thank you. I am not worried about the three companies I know of , I am worried about other 3000 companies that I don't know of.
    I also beleive, it is not the companies that are evil. It is the system that provides the incentive. And I am trying to take away that incentive.

    First: I appreciate that you have not lost your cool yet despite all the opposition and rude posts against you. We will not close the thread as long as the discussion remains civil.

    While I personally do not support the lawsuit idea because it divides the community in two parts and there are better ways to help the community. You can try to help positively for the greater good for everyone or run a negative campaign that will help some but hurt others who are also like you and are genuinely following the law. I also think it will be expensive and may not have a lifeline. As IV members we need to all work together to fix the system. This was the basis of founding IV. The aim was never to look after our own selfish interests and hurt others who are like us. We never discriminated between different EB categories or country of changeability. The intent of our fight is not to deny others their greencards and get ours first, but to allow everyone get their greencards. The intent is to have the system be efficient and work the way it was intended. IV core team has never made action items or ask lists in campaigns to suit their own selfish needs.

    Now in this post you have raised a serious issue. If a fraud is going on, do collect evidence and file a complaint against it. If consulting companies are making money by gaming the system, drag those companies in your complaint. Help punish such people who are gaming the system. IV community will appreciate that.

    There is some wisdom needed here to draw a line between selfishness and working with honest intentions to clean up the system.

    OK....wait till next week for an outright refusal on EAD.
    once that happens.....explore the option to file suit......



    they first stated that they had instructions from their legal team that they have too much hassle with EADs causing problems, so they dont hire ppl with outside EAD. When I asked them to reconsider they said I dont know for sure, lets see what the legal team says.

    It seem to me that this hr person did not make up the refusal on their own, but had previous precedents to go by or had been given explicit instructions.
    My fear is that they will come back with a clearer explanation of why they cannot offer employment based on the EAD.
    I am getting really really upset about this. If I had known about this EAD refusal thing I would not even have gotten out of H1 and would have continued to work...

    We are a husband and wife, both filing.
    My priority date is Oct 06 and my wife's will be July 1st. (or so.)

    My wife's company is a large multinational and her job is secure. My company is small and not making oodles of money right now.

    So I consider my wife's to be solid and slow and mine to be less solid but faster.

    I predict that mine will get approved before hers and they'll drop hers. But because I simply do not trust USCIS to process them without a hitch, we're filing twice. Shotgun theory.

    Our lawyers seem to concur. If our PDs were the same and our companies were similar, it probably wouldn't be worth filing twice.

    My question is regarding the EADs and APs. I believe that I should file through her because they are more "solid" applications. I assume that the EAD/AP will be processed prior to the 485 and priority date does not affect them. Her job is more secure than mine and so her EAD would be too..

    Am I wrong?

    I am not on L1, neither do I work in the kind of an assignment which will come under the radar due to this - but have many friends on L1. Hence I think I may have a slightly more balanced and perhaps somewhat sobering POV on this.

    Since I have many friends on L1 - I know pretty well how they are abused by their employers. Just the fact that you cant quit the employer enables some forms of abuse so subtle that they will not stand in any court of law. So I hope for the sake of people on L1, and to uphold the rule of law - that this abuse stops. If it does - their employers would be forced to bring them in H1 - which is far less prone to abuse due to the portability.

    However, the current "run to the DOL/ICE" approach that you guys are taking may have repurcussions well beyond you had bargained for. Think of it from the POV of a client manager (lets take the example of, say, a goldman manager). He has his hands full of sucking up to his boss, playing the internal politics and in his spare time doing some work. 99% of them (even those who actually immigrated themselves) have no appetite to get into the details of immigration law. So, as soon as there is a backlash on this - their immediate response would be to take the safest route out and require Citizenship/GC for all positions.

    As soon as that wave starts - many of us are going to get burnt. Many of us who have EAD, including yours truely, would probably be able to sneak through without too much of an issue (since it is illegal to discriminate against EADs) - however, many others who are not so fortunate would probably not fare so well. Most probably what will happen is that as soon as a recruiter sees brown skin and hears some trace of an accent - alerm bells would go off in the mind to check if this guy is GC holder or a citizen.

    The enabler of the L1 abuse is the non-portability of these visas. We cant do much about that in the current environment. But going all gung ho in terms of enforcement right now -when there is a recession in full swing - may not be in the best interest of any of us.

    people who try to make quick money in couple of years by investing in house is ............... It is better to go and try it out in Las Vegas how lucky you are in making money instead of trying it out in real estate market with the span of 1-2 years in mind.

    Even if someone wants to make quick money, here are the few tips. Also these tips are tips and not guidelines.

    0. Know your limits. If you earn 100K, your buying power by thumb rule is 300K. So on saferside start searching with the range of 250K-260K. VERY IMPORTANT RULE.

    1. Check the rental cost where you live. Example if 2br apt is 1200, then try to limit your mortgage, taxes etc within 1500 assuming you buy at least 3br house.

    2. Reverse calulate the down paymet you have to put by subsituting your monthly payment ( apartment rental cost in your area + house tax + $300). Calculate the % of down payment from the above formula.

    If the down payment comes to 10-15%, then it is worth buying than renting in your area. If the down payment is above that, then try to meet it. In worst case put 20-30% down payment to keep your mortgage payment lower.

    Again, the above information is based on my house search and analysis. Others might have different opinion. Please take it if it is worth for you otherwise just ignore it.

    I am on H1/EAD and own a home. Lenders don't deny you a loan solely based on your visa status. Some think its too risky to own a home before getting a green card. I think this is a personal choice you make based on your comfort level. IMHO, we should keep the home ownership out of this. If we include things that are simply not true, it will only make our letter(s) less credible.
    guys, these were just examble of personal blurbs. Please feel free to make it your own. However, I have heard of one case right now because of the subprime mess where the lender did not go ahead with the loan because of the risk. i am not saying there arent any banks out there where you wont get a loan, but some banks are switching gears and making really safe loans compared to their risk taking ability a few yrs back.

I don't think the call was anything big deal.....it was more a courtesy call an image improving call...we were not told anything that we didn't know already.....USCIS always raised more questions than answering them.......

    When you buy a home you sign a contract saying you will pay the loan amount at the end of the loan term with interest. There was a commitment made. And you are saying people who walk away without fulfilling their obligation are smart? Fool!


    And who do you think is footing the bill for bailing out those banks? its you and me! You are not only not honest and ethical, you must be really dumb if you think you are not going to be paying for the mistakes of people like punjabi when they "walk away" from their homes!

    These guys have jacked up the price insane and out of reach of most folks who want to buy because they got greedy and wanted to make profit. There are few on this forum who have been advising to go and buy house at this time. :mad:
    For 'punjabi77' it is always others fault that they got into this mess. :mad: 'If the house didn't appreciate like I thought then it is the others mistake that it is making me go into foreclosure and if the housing had gone up and I made 200K profit, I am a smart man' :confused::confused:

    I got a letter from Cong Tom Price (Rep- GA) saying that the immigration clauses in the Budget Reconciliation Bill did not make it. But he will try to push for those clauses in the immigration bills in 2006.

    I got the same message from his DC staff, when I called to follow-up.
