While FBI is the bottleneck because they are responsible for processing name checks, the USCIS shares full responsibility because
1) NC completion is not required by law to adjudicate AOS
2) NC requests from the USCIS do not have a processing timeframe, so why FBI should care if those requests are lingering forever?
3) the USCIS is aware of the problem, but did nothing to fix it, trying to hide it by creative reporting instead.

Do we suppose to send I-130 with I-485 application? I have re-filed for my self and my wife for I-485 based on approved I-140 EB2 Employment. Please let me know.
My application filed on July 2 was rejected (NSC->CSS) saying missing I-140 I797 approval even though it was attached.

Height, weight is noted.
For adults (man or woman) only Tetanus and MMR is needed. Children, take your child's school vaccination record; by elementary school end, this record should be complete and they will not no vaccination needed. Go to your doctor /HMO and get these done. For MMR they will say, oh, you don't need, we will do antibody assay (to squeeze more money from Insurance). Show your left hand and ask them to poke. Tetatus is IM and MMR is SC (sub cutaneous). Then and there take a vaccination report.
Go to doctor. First visit - they will draw sample (for HIV test) and then give Mantoux Test; this is Intra Dermal injedtion. usa your right hand - (for BCG or TB). No skin reaction, don't worry.
Skin reaction over 5mm with raised skin (induration or something). I had a postive skin reaction. Then doctor will take complete physical , take an x-ray. In 99% of case TB will be ruled out ( you see the positive skin reaction is saying that your were exposed to TB bacteria in the past - not necessarily disease). The chest X-Ray is the dignostic proof, that no TB was there at all or is not thee now. This X-Ray and Physical is on the 3rd day after 48 hours. The X-ray is not included in the sealed cover, only conclusions of X-ray and Physical.
For those 1%, don't worry. Even if you are diganosed your I-485 will not be rejected. You have to take an undertaking and prescriptions and medicines. You will be treated in 3 to 6 months. Then they may complete your case. This para is my educated, logical and common sense guess.
For a good doctor, in Denver / Aurora area of CO, PM me. Good and nice American Doctor and staff.
All you said is correct, except for you don't need Hepatitis B if you are over 16. No, there are no more tests involved, unless your tb is positive. If you tb is positive you need to do chestX-ray. I know that because I was just doing the tests for myself. Varicella must be taken twice 30 days apart. Same applies to MMR.

The Gandhi Protest
Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.
Here's a sample:
"I wonder if USCIS really understood why the flowers were sent. It was a symbolic protest by legal immigrants AGAINST the way USCIS treated them. How could they send it in the 'same spirit' to soldiers whom we all empathize with?"

Just imagine what would have happened in WWII if the US would have turned away the immigrating sciencists and engineers. How come some 50 years later, the US is struggling to see the value of inviting the world's best and brightest to immigrate here."

As a highly skilled H1B worker in the US, let me the set the record straight on a few common misconceptions:
- Many of us come from upper middle class families and didnt come to the US 'seeking quality of life'. We already had it.
- Many of us have graduated with distinction or higher from TOP US universities where we competed with 'local' talent and aced the programs, with NO SPECIAL FAVORS
- All of us are PASSIONATE about the PROMISE of the GREAT AMERICAN DREAM. We work hard because we want to, not because we need to. (Hint: We are ambitious and can hence go to any country in the world!)
- All of us are an INTEGRAL part of this society, paying 28%-33% of our $100K+ jobs as TAXES that go back to the US economy
- All of us continue the great tradition of the US being a melting pot
Go back to the age of the Gold Rush. We are the new Gold Rush. We are the new Lewis and Clarke. We are adventurers, learners, experiments, believers, doers.
We are not lowly paid 'tech slaves'. Get the media misconception out of your heads.
We are PROUD to be part of the Great American Fabric. We strengthen this country with our diversity. We will continue to contribute selflessly to make this a greater, stronger nation.
And while we are it, we wont forget that our own future generations might take it more lightly and risk messing up their careers. Anyone that has 'life handed to them in a platter' ends up messing it.
So, please take your heads out of the sand, quit being protectionist and complaining the someone moved your cheese. Look at how you can move and be flexible, nimble and adaptive.
Inspiration. Ideation. Innovation. Hardwork. Dedication. Focus. Results. Rewards. Since when have we decided to change the ingredients of the American Dream?

My Guess is , It is a rumour . since the USCIS suspended the I -140 Premium Service for the month of july . It clearly indicates they are aware of the I -485 filings from July 1st and do not want to promise I- 140 decision in 15 days during July .

Bush deems guest workers key for economy

President Bush last night called for 'stronger immigration enforcement and border protection' even as he told Congress to move forward with his plan to create a guest-worker program to fill jobs that no Americans want.
He also seemed to challenge those in his party who oppose a guest-worker program, saying the nation needs immigrants.
'We hear claims that immigrants are somehow bad for the economy -- even though this economy could not function without them,' Mr. Bush said in his State of the Union address.
The only way to keep the United States competitive is to create an immigration system that 'upholds our laws, reflects our values and serves the interests of our economy,' he said.
'Our nation needs orderly and secure borders. To meet this goal, we must have stronger immigration enforcement and border protection,' Mr. Bush said. 'And we must have a rational, humane guest-worker program that rejects amnesty, allows temporary jobs for people who seek them legally and reduces smuggling and crime at the border.'
The president pushed for his guest-worker plan in his past two State of the Union addresses as a way to help employers, but this year his focus on border security and immigration enforcement was much clearer.
'There has been continual movement on his part because he recognizes the Congress and the American people aren't with him, and we're going to fight him,' said Rep. Tom Tancredo, Colorado Republican.
He and other Republicans took issue with Mr. Bush for not differentiating between legal immigrants and illegal aliens when he said the economy could not work without immigrants.
Rep. Lamar Smith, Texas Republican, said U.S. workers would be hurt by a guest-worker program.
'Studies show that competition from cheap foreign labor depresses wages and takes jobs away from American citizens and legal immigrants alike,' Mr. Smith said.
He also said Mr. Bush's plan is unenforceable, because those here illegally cannot be expected to return to their home countries voluntarily.
In the official Democratic response to the State of the Union, Virginia Gov. Timothy M. Kaine said Mr. Bush does not have a rational immigration policy and that the result is a 'confusing patchwork' for states and localities to handle.
He shied away from a specific call for a path to citizenship for illegal aliens, even though most party leaders in Washington have endorsed that.
'We should welcome those who seek to lawfully join and contribute to our American family,' Mr. Kaine said. 'At the same time, we must ensure that our homeland-defense efforts begin with consistent federal action to protect our borders.'
In the Spanish-language Democratic response, Los Angeles Mayor Antonio Villaraigosa specifically called for 'comprehensive immigration reform' and for giving 'hardworking people who play by the rules a greater opportunity to realize the American dream.'
Sen. John Cornyn, Texas Republican, said Mr. Bush was right to call for action on the border and for his guest-worker plan.
'The bill I've introduced strengthens our border enforcement and comprehensively reforms our immigration system,' Mr. Cornyn said. 'We need both stronger enforcement and reasonable reform of our immigration laws.'

Processing : Consular
Today i received a mail from NVC to pay immigration processing fee of $794.
Does any ones what is this for ? does it help to know the demand ?

According to the below websites, seems it is the Immigrant's Final application and processing fee(and seems like your immigrant visa has been approved by USCIS*** according to http://www.americanlaw.com/consul_iv.html
"In April of 1994, DOS opened the NVC, a permanent immigrant visa processing facility in Portsmouth, NH. NVC processes all approved immigrant petitions that it receives from USCIS. NVC will retain the petitions until the cases are ready for adjudication by a consular officer abroad. When an applicant's case is about to become current, the petition is forwarded to the appropriate U.S. embassy or consulate overseas. " ***

Thanks a lot fromnjia! I do have the receipt from USCIS.It makes me feel much better now.I'll send all the 485 papers after June 1st.hope 485 clears smoothly for me.
