Everyone seems to indicate that the checks for fees payment to the INS need to be made out to USCIS, however, all the forms that I've downloaded from their website instruct that the payments be made out to Department of Homeland Security - which one is correct?
I have already filed my AOS for self and spouse, and made checks payable to Department of Homeland Security, written out in full. They were cashed more than a month ago which suggests I got it right.

I just received notification that my approved 140 (which got approved way back in 2007) is now moved to USCIS. Has anyone seen this before?

nrk, how long did it take after the status got updated to "Approval Notice Sent" to the cards received by you? I am assuming that "Approval Notice Sent" on 485 is actually mailing the cards out to the applicant. ( That is what happens on 765 (EAD) application all the time).

The only thing I can tell is most of us are trying to search "light" from this "black and dark cloud". USCIS does not seem to be agree with what you are saying. Please have this trend chart and the worksheet in this thread together and then you will realize what we all are saying.:)

I am referring to the PDF report - which clearly mentions that the numbers are for pending Employment based 485 applications. And yet people refer to this report and ask stupid questions or over-analyze it...

The employer will come up with many excuses to not interview a candidate or hire. If the law doesn't allow you to discriminate when hiring based on national origin or EAD or whatever, rejecting candidates even for an interview doesn't make sense.
Interview is part of the hiring and recruiting processes. Would you say employers putting a job ad saying we will only interview someone from a particular nationality is allowed?
However, the more important point is we are fighting to get multi-year EAD in IV among other things. The law doesn't allow discrimination based on EAD for hiring. Let the govt lawyers and employers figure it out if not even interviewing candidates because of EAD comes under the purview of hiring or not and if it is legal or not.

You are rightaway asked about your work status and they insist till you give them "specific" word - either "GC" or "Citizenship" or "EAD"... If this would have been the real way ( I and all of us wishes that) the these recruiting guys may not dare to insist till you spit the speific word out and that is before interviewing. In my experience, I always had verbal conversation. I have never been sent an email or letter by any company yet regarding their refusal not to even interview me based on EAD. Verbally 5 companies have starightaway told me "they are not considering me as I do not have green card yet - EAD is not enough". My thinking is that they do this because somehow some law may be covering them, we do not know that but they know that, perhaps..:confused:

I must say y'all are doing a commendable job. I have contributed $$ and would do so more in the future if needed.
I remember Senate Majority Leader Bill Frist saying that the comprehensive immigration reform bill will be handled in February 2006. Is the schedule still the same. I am keeping my fingers crossed and hope that everyone of us stuck in this immigration hell-hole will get a relief from the comprehensive immigration reform bills that (hopefully) will be passed in 02/06.

He says he likes Legal immigration, but then he curses every avenue for legal immigration under curent law.

I was told if you are going back to your home country, even if you don't have valid US Visa stamped, you don't need a transit visa. When you come back ofcourse you will have a vaild US visa

Do I have to file I-485 though a lawyer or can I do it myself. I have an old I-485 form that my lawyer filled out and he sent me a copy of but he never filed it to immigration. Can I update that old form he gave me and file an updated I-485 myself without a lawyer??

The salary in employer letter should match the one in labor or in I 140?
Mine is more in labor than I 140.
Here's what I requested my employer to write in the Letter:
Current salary is XXX.
Salary that will be offered on permant residence will be not less than YYY (mentioned in the labor)

There is a direct Air India service from JFK to Mumbai, painful commute if living in NJ but for those closer to JFK, this is the best flight they can have. I still think, the USA is the best place for democracy loving people. Govt and its agencies try their best to be accountable to law. Now if you want our Immigration issue to be put before IRAQ in the Congress, I would think that is selfishness. I have colleagues whose sons are in IRAQ. For me their lives are more important than my GC. Now that does not mean we stop making our point to Congress.
Vinabath i do NOT expect the nation to put Legal Immigration before the IRAQ WAR. Ofcourse I do not expect that. What I am trying to point out is that this is going to be a LONG LONG ongoing issue and if not the war, there will be OTHER issues like the presedential elections etc.
On another note, the US is a capitalistic economy. If you are not selfish, ur a nice guy and nice guys finish LAST.

When you say "according the our calculations", and you can only come up with years (& not 1 year, 2 year), you have obviously not done a very accurate calculation/guestimation.
I wouldn't put too much stock into it.
There are two years (2006 and 2007 ) from 2006 to 2007 and you know language of all lawyers, so he is not wrong here too. I bet you if you can convince him to say 1-2 or 3 years.

the first contact for the congressman's office is the relevant consulate. so it doesn't hurt. it is a simple process. your boss has to sign a confidentiality release document for you and attach a cover letter. to help your boss, identify the congressman, go to the congressman's website and find out where the forms are, write a draft cover letter etc . you can do this yourself i.e enquire as a constituent just in case you don't want to involve your boss. i think it may be better that it goes through your boss
