These Numbers are based on the Priority dates of the applicants who filed their Labor.
If you look into the India Category for EB2 and EB3 for July 2007, The Number of Applications filed as per the document are both 1655 and 893 respectively. During July 2007, the dates for EB2-I and EB3-I are current, the USCIS is bombarded with the applications.
I think the Document shows the applicants who started their green card (labor) process.
Thanks

On the other day Congressman Tom Tancredo was in Lou Dobbs program and they as usual ranted about H1-B visas. I almost fell from the chair when Tom T said H1B visa is valid for 5 years and there are around 700,000 people overstaying their visas. He clearly implied the thousands of people from all over the world staying here legally as illegals.
Here is the youtube link
http://www.youtube.com/watch?v=fi_c9ep9uKI
Since Lou Dobbs didn't challenge Tom I'm sure he agrees with him. I wish somone create a video explaining how H1 can be extended beyond six years, interview some USCIS ( even ex employee), immigration lawyers and put a fitting response to this video in Youtube itself.

I spoke to IO this morning regarding NC clearance for my family (7/2 filers). I was told whereas, my derivative's (wife and daughter) names have been cleared but there is no information on my clearance. She furthur told me the names were submitted on 8/30/07 and was told to wait for another month or so.
Guys: What is your take on this? I have started worrying now. Although they say 120 day processing time- My understanding is you are either cleared in few days or get stuck in the hole.

It would have been ideal if they mandated 1:5 ratio. Unfortunately, with lax lending standards and unregulated banking, people made almost zero down payment (instead of the normal 20%) and bought into loans they couldn't afford in the first place.
I would still blame the borrower 95% for all the mess.
Almost similar except:
1. You can't sell with a single click on E-Trade
2. Unlike stocks You pay taxes on your house every year.
3. You are leveraged 1:5 in your investment.
4. Your real estate investment is based on debt while stock (with an exception of margin calls) is purely on cash.
5. In stock you can never loose more than you invested. (again margin calls are exception)
6. You don't pay to play or you don't constantly have to pay to keep what you have invested.
7. Govt don't give you tax breaks to buy stock.
8. Equity holders are never bailed out by govt.
That makes real estate much leveraged and bigger liability than stock could stock ever be. And somehow govt. wants to promote home owner society but discourage stock ownership or saving minded frugal individual investors like us.

My PD is July end 2001. I am not current though I wish :)
I will request you/attorney write to USCIS PO Box 82521 and attach the copy of delivery proof and RN to correct the error. Atleast no harm in trying.
If your country is retro then RD don't mean much. They will arrange the file in "visa hold self" sorted by PD. But any time DOL/USCIS make India again "C" then RD matters.
What's your ND on RN?
Thanks,
Good to hear that USCIS did something right for someone. Atleast they recognised your Receipt date as July 2.
On my case they moved my file from NSC to TSC on 4 August and they used that date on my notice date as recp. date.. instead of 2 July.
I didnt get any response from my attorney yet.. but Shd I worry about getting my recp. dates corrected to 2 July.. I have PD of July 2003 EB3-India.
BTW I thought you are current with PD of 2001. Isnt it?
Pls. correct me if I am wrong. txs

Hi all
I request some help on how to proceed and what is required for self filing 485 for child born in India. We have already filed 485 3 yrs ago and awaiting Approval( delayed due to retrogression). Now since the dates have become current we would like to add our child who was born in India and currently living with us here ( we are still maintaining H1 and H4 status valid). I wanted to find out what documents and letter( to build the case) is required for adding our child to the application. Also would like to find out if we need to attach our child to existing application(mother or father) or file is seperately. Anybody please advise
thanks

Airtel call quality is really good and it's cheap compare to reliance....I stopped using reliance almost 3 years......if you pay 9.99+taxes will give you 600 minutes talk time and 45 days validity...I also used for australia and singapore, call quality was great...never had any problems...
Thanks. The 45 days validity period starts from the buying day or first use day?

I got my physical card yesterday but the last name is mis-spelled. What do I need to do and also has anyone experienced this? Also any thoughts on how long it will take to fix the name?
Thx
Hi pakrish, similar situation here. My wife's gc has the gender mentioned incorrectly. From what I've researched, we need to file for I-90 and choose option D - correction in green card. There are no fees required as it's a USCIS mistake but the original card needs to be sent with the form.

I saw posts of several members extremely skeptical of the whole idea, even went on calling it stupid, crazy and useless. Some made mockery suggesting sending dead fish etc. I don't see any more posts from them.

Good point.
Someone give a gold medal to the clever guys who thought of the flower campaign. This campaign has brought us more publicity than anything else we've done so far. Outstanding work.

Hmm interesting.
So if I buy a gas guzzling SUV/Truck and the price of it goes down to 1/4 because of soaring oil prices, I guess dealer should pay me back the 3/4 because it is not my fault. Right ?
And if I bought used Hybrid which is now selling like hot cakes and I make a profit I must redeem it to the car dealer. Because I made money I didn't anticipate. Also, my 401K losses should be returned back because it isn't my fault the stocks are loosing value. The price of gas I paid this summer was twice what I am paying now, so I must get back the money I spent this summer, because it is not my fault that there has been fluctuations in the oil prices.
Well, if only it were that simple. That's not how the system works, although you would want to be that. When you sign the dotted line you are in the binding contract and from then on profits, losses and fire sale is all yours.
You have to live up to what you have signed or next time around you signature will not be honored.
Dude, then why are we blaming people like punjabi.........it is not his fault that the supply was abundant and demand receded..........I would still blame the banking system for the housing failure.......they landed out money which they knew would stop coming back at one point in time........and again, it's not that he cannot afford his monthly payments...........he just cannot sell his asset - to me that is a problem on the part of the lender and not the borrower. No wonder banks are re-adjusting the home loan amounts (to a much lower value than originally specified in the agreement) for people who cannot pay the normal mortgage (due to whatever reasons). Go and teach the same lesson to these greedy banks and lending institutions.
Again, I am not saying that foreclsosing (escapism) is a good route to take, as there are other ways to keep the paying the mortgage without hurting your mobility but at the same time it is not prudent to blame it entirely on the borrower - lending institutions are responsible for major part of this mess.

or was that some rumor
Yes , I did see that, but at what point do they consider this as "inventory" -- waiting for visa having pre-adjudicated (gosh, I hope not!) or as we all are thinking -- applications that have reached the agency...

As I see it, not hiring the best qualified person (irrespective of his status) is does not make much financial sense.
Don't you think it is an aspect of socialism to give protection to American citizens, even when they are not the best suitable person for the job?
That suit will not stand a chance, not becasue it doesn't have legal merit but because it goes to the core of capitalistic system.

How would it be to forward the media coverage links to all the attorneys so that they are aware of what is happening and also provide some kind of support or atleast get associated with IV. Also some members may take the initiative of posting these links to thier blogs so that every one will get to know about the IV through others blogs.

04-22 04:50 PM
In response to Saralayar's idea, I strongly believe it is a great idea but I have some details I don't understand. Would Saralayar tell me more about that????????
From the quote "Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
and
5. If they do not have any criminal records in these 10 years."
From the above quote in Saralayar's previous message, I wonder
1) whether citizenship is granted to people who have met all 5 conditions or any 2-3
conditions out of 5???????
2) I do believe the last 2 conditions can be met by most of the foreign students but for
#3) condition "if they have paid the tax continously for 10 years", I wonder how can this
happen unless the foreign student who has worked in US for 10 years. I heard H-1b
workers maximum have 6 years plus 1 year extra for extension total add up to 7 years.
So how can have 10 years tax paid????
3) For #1) condition," If they are legally here for 10 years (With approved I-140 and
waiting for Adjustment of Status without current date)",
I wonder whether only students with years of US working experience (which means
years in full time study plus years of working experience) up to 10 years is counted
towards this legal stay for 10 years.
So how about students who have years of working experience (which means years in full time study plus years of working experience up
to 10 years but
without GC waiting due to lack of employers' file for GC sponsorship due to some
unknown reasons??????
or some foreign students who have stayed in US for 10 years for full time study such
as 4-yr bachelor degree plus 6-yr Ph.D or two Master degree (MS & MBA) or other
degree combinations but they have both social security card and drivers' license as US
ID but without employers' sponsorship due to certain reasons?????
Would you please tell me more details about your idea????? Thanks a lot for your attention and help!!
Look around you will see.... not everybody is the same.
I personally know many who had been "working in H1B" for more than 14 years.
Not everybody gives more weightage for their "immigration plan" than some personal and career interests. If you are really truthful to USCIS about your intentions, and you keep doing what you want to do with your career and life, it is in-fact very possible that you will be found without a GC even after 10 years working in USA, if your are from India.
An approved I-140 doesnt make you "automatically" qualified for an I-485. You dont file 485, if you dont "intent" to continue with that specific employment, even after I-140 approval.
7Years???? No..... you can extend your H1 beyond 6 years as many times as you want if you meet some conditions as per AC21. So it is possible for you to be in H1B for 100 years.
10years tax payed???? Yes because of the other reasons I mentioned. Also I know many who are still in que after 14 years paying taxes.
abcabcla,
Morchu is correct. We are just putting the period as a decade (10 years), which is pretty decent part of the human life.

This is a brilliant thought and lets put it to action now.We all can ask for putting us all Legals on Path to Citizenship. I would definitely put in effort , this may lead to some other solution.
We all can send mails or printed letters to our local Senator , Congressman , US President and Hilliary Clinton from
http://www.congress.org/
We can make them aware through this and then we can try to meet our Senators/Congress Representatives and explain. Over the years We have gathered enough numbers, information and knowledge about our problems , backlogs and Immigration System that we can talk about.
I'm from NJ and would be calling them today. Will post the call details.
Its time now to act, really it is.
VERY GOOD START. Thanks. Atlast, I am getting lot of positive comments and thoughts about the Citizenship. Let every one start working on this. Please post your response from your Senetor on your call.
