I don't intent to sound rude, but why would this make your life "Suck", "no social life" , "no carreer life", "no nothing life".
Iam in the same position as everybody else, and am deeply dissapointed with the news (hence Iam here), but I just spend 2 hours in a nice pub, drinking nice micro brews, came home had a nice talk with my wife (H4), we are planning on going out for dinner and maybe watch Knocked up afterwords (heard its nice).
If this were to be true, it would delay our GC by another 2-3 years, but we are in this country on our own free will, making good money. Be dissapointed, but this is not the end of the world..Mantain the perspective...
To quote it in a much broader sense, America is not the end of the world - period! Just take it easy and enjoy life...don't freak out if the visa bulletin updates and you don't get to file your 485...we are all in this country by our free will..if we feel the rules of the land are not fair to us..each one of us is free to leave....
On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...

I would say, any fraud, whether H1/L1/F1, employee related, employer related should be reported? Why should law abiding immigrants/workers pay for those who are committing fraud?

It should not matter when you file as long as your priority date is available when you file - and of course you need to be in the country when you file it (to be on safest - i would be in the country on receipt date until I get my receipt notice).
Having said that, I am not sure until when June VB will effective. I mean I do not know when July VB dates will take effect. Probably someone else can clarify this.

We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. Hi Guys,
Please find the details of how we complaint to our client management regarding L1 violation ....(for some of you guys who are interested in educating uer clients)
Step 1. Collect the email id of uer CEO and 8-10 executive managers, make sure that your groups CIO/CTO s email ids are included, get the email id of HR Head/Legal Dept/Immigration Dept of your client (CC them in the email).
Step 2. Create an anonymous Id with something like "Against Fruad"
Step 3. Formulate the email as given below
Subject: Fradulant Activity by Vendor - CTZ Tech Solutions ...For Eg.:-)
First Paragraph: What the Fraud/Violation Is?:
Mention the L-1B violation by these companies and how these resources are legally prohibited from working on staff augmentation assignments, mention the L1 reform act of 2004, provide the link to USCIS website and attach the .pdf file with L1 reform act. Mention the list of employees at the bottom of the email.
Second Pargaraph: Why They Do This?: Key points .. NO wage restrictions, NO numerical limitation and mention the H1 visa lottery in 2006,07,08 etc. NEVER talk abt corporate greed in this whole email (hope u got why!).
Third Paragraph: How they do this?: Mention about the petition which has to do nothing the current project they work on and the visa interview where these guys tell abt someother projects and clearly mention how they gets deployed to projects where they don't have eligibility to work and skills they cannot be utilized for.
Fourth Paragraph: How to Prevent this: (To show that you are sending this to resolve an issue and not to complicate one) ... mention about how easily each hiring manager can avoid this by setting visa criterion for all jobs including contract and temporary jobs.. once criterion is set by hiring managers these vendors cannot violate the same. For Eg. Hiring managers set the criterion that a new contract position can only be filled by Citizens/Green Cards/EAD/H1 s... so L1 violation doesnt even come into picture.
Last Paragraph (BUT NOT LEAST)
Mention the NAME of atleast 5 resources (and their organisation) working on L1, their projects, technology on which they work and how they violate L1 by working on these projects and technologies.
BELIEVE ME ... WE WERE PARTIALLY SUCCESSFULL ... NO MORE NEW ONSITE CONSULTANTS FROM THIS VENDOR ... but client is not yet ready to review the existing consultants.. looks like they are having a internal probe into the matter...hope we'll get some good news regarding the same too.

let's compile a list of famous immigrants like Albert Einstien, Henry Kissinger, Madalene Albright et al and change the face of what constitutes a legal immigrant. We need stories of doctors, scientists, engineers (the success of NASA) who were immigrants and benefited this country. Please check with some other attorney too. As per my understanding, you can not file H1 from your own company.
I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..

USCIS decided to take our $604 and give me an my wife APs in 9 days! They seem really efficient when they have to take money from us. But really slow when they have to approve GC applications (EB2, PD of Dec 2004). USCIS just seems to be interested in 'extortion' payments to employ USCIS staff - more a lawless mafia than a organization upholding the law!

My lawyer recommends to do independent filing without the spouse. He says you get 2 bites at the apple. When the dates becomes current,USCIS won't adjudicate immediately. We have time to add the derivative spouse later on.
Making AOS filing is not acceptable to USCIS and may trigger personal interviews and confusion. He also said take the spouse approved 140 and do an addendum to the 485 saying he/she is doing an independent 485 though we are married.

here is my theory.
DOS and USCIS played a tactical move by making all the visa numbers current in anticipation of the CIR bill so that the legals wont complain to the senators about retrogression.
Once the CIR went down the drain, they are panicking about the outcome of their tactical error and trying to undo that move.
Again, just my theory...:confused:

I-693, supplemental I-693 (vaccination record) , copy of enclosed documents, blood tests (HIV) , skin test results( BCG), your acceptance for these tests, x-ray report (if skin test is very positive - see belwo) and TB diagnosis ( no TB) is enclosed in the sealed envelope. In original.
The same set is given to you. The medical staff with go through section by section and show it to you (in your copy) that all sections are completed ans signed. If you take vaccination on the first day, then on the third day they will give you sealed cover. [LIST=1]

Multiple 485 and EAD filing

My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.
The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.
Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).
Any inputs or clarifications will be greatly appreciated.

Yup. One should be ready for the consequences when they apply. Think carefully before you do something and do not make any errors in decisions.There are both advantages and disadvantages. A lawyer office that has done this in the past quoted a case to me. Another non-desi expensive lawyer who always gives accurate information and is not greedy told me that he would not advice multiple filing.

Having filed mine and spouse's AOS in May, honestly everyone these are not hard to file yourselves. If your employer is paying for the lawyer then great, but why not devote a couple hours and do it yourself, cut the lawyer out of the loop. I am sure we have all had bad experiences with lawyers, and heard about many others the chances are you will do a far better job since this really matters to you, you are just another number to the law office.

Another notice which says that they reviewing or reconsidering the decision previously taken.
Called 1-800 # and the infopass. They say that reopened or reconsidering the case as the visa numbers retrogressed.
How can that be when am current in oct as well.
Mine is EB2 and the priority date is Dec 2004.
Any suggestions to have this fixed.
