I think this is very well said. As much as I'd want the predictions to come true, somehow I sense the same observation as below. It appears this has been said in the past, but all we see is very little movement. Secondly, as I recall, DOS had hinted that there'll be advance for EB2 India, I don't know if they mentioned EB2 China? Has anyone seen DOS themselves talking about EB2 C? The reason I am raising this here, is that maybe when DOS had said "substantial movement for EB2 India", did they mean that India will move to China's date (From May to Jul 06, 3 months movement)?

Also I have analyzed that people who have a date in 2008 somehow predict that the dates might move to 2008 and people who have a PD of July predict that dates will move to August . This is just an observation and nothing more , and if you go through the threads thats exactly what you will see.
I will be equally benefited as you all will if the predictions come true , but be well prepared for a major heartbreak also like last year .
While it takes a lot of effort from some of the members to crunch such numbers I would be first to extend my sincere gratitude to them for doing this , I would also recommend you all to take the analysis and predictions with a grain of salt and not to raise your hopes too much on these predictions.

I went for H1B extn (approved Nov 2007) stamping on 15th Jan at New Delhi consulate. The person checking the papers at the outside window wrote - PIMS found on my appl form.
I checked with the VO after the interview if I will experience any PIMS delay. He replied he would not have been able to process my application without PIMS entry being found and everything is good.
Got the passport back on 18th.

I am speaking from experience. Download the forms needed for filing 485, EAD and AP. Then when your attorney send you his/her set ( normally they do this in 2 stages - one they will send you a draft copy to verify and correct all info - some have online questionnaire; stage two - they send the final forms for you to verify and sign again - this they may do paper copy or online PDF - that cannot be edited - not fill able forms).
So, here I am providing links to all forms that I know are needed. These from uscis.gov site are fill able. Weekend is coming. Fill them, and print and keep them.

If they decide to cut-off some day next week can't believe how a day or two would make a huge difference in someone's lives. This is very cruel. We have to react based on the infomration we have and it keeps changing every day. So every time I have to run to my manager/director ask them to escalate to HR and they talk to Lawyer. I look like a guy pushing panic button all the time but in reality if we don't act quickly will regret for next few years. Never had a such a bad July4th holiday :(

Unfortunately we are all caught in it with only solution to fix is time travel and kill the beast in infancy. There is vested interest by the Govt and Banks to lend because that's the only way money is created. That explains constant rate cut cycle and stimulating artificial growth. The entire monetary system is hijacked by banks. The debt to ordinary people drives the economy and people pay that debt and interest a good part of their life. Thus collapse of big banks could lead to eventual meltdown of the system, and no wonder govt keeps bailing them out.
In the end personal level frugal living and debt free people are constantly punished by taxing interest like ordinary income and no tax breaks. On the other hand big over leveraged spenders are rewarded with big tax breaks. Why ? Because it allows the well-oiled machinery to work.
In last 10-12 months, this overworked (overstretched) machinery broke down because the debt (and interest) is no longer paid back. Banking system of the entire countries start to fail (Iceland, Latvia, Hungry...). What happens next is anybody's guess, but we will be collateral damage, mine and your savings will be eroded by diminished buying power due to currency printed to bail out the fundamentally flawed system.
The sharp decline in moral and ethics is a direct result of entitlement mentality and welfare society. People feel that they deserve everything without having to pay it back and everyone who is better off must be evil. They forget that simple hardworking people can be rich by simply living debt free and with in the means.
Finally the money from debt driven system might survive but not without huge decline in standard of living, a massive recession and permanent shift away from material possession as a central theme of life.

A new technique reqruiters are using is
"Hey, I am OK with EAD, it is just this particular client of mine who is not and I tried to educate this client but they do not listen. I tried placing another guy on EAD at this client but they rejected because of EAD and I placed so many people on EAD in other clients. So I hear you. Good luck with other jobs."
I still think it is some notorous reqruiters who apply the EAD filter. They do not want to deal with a lot of resumes and they want to apply that filter.
If someone askes we can say we have GCs and then if that takes us through the process, they cannot raise a problem at the I-9 stage as that would violate labor law.
And usually people who initially ask and filter are different from people who collect I-9 information, so that may actually work.

Your salary is not your personal choice, it is governed by market factors. Company makes the final decision whether they want to pay you what you ask for and whether they need your services. Your client can easily send your job to India if they can hire someone here for 3 months. Most likely that person is going to be back with the job after 3 months.
3. If you screw up , who is responsible? What can you do to mitigate damage? TCS/WIPRO can replace the whole team at free of cost to make project successful. - BS
I work for a major system integrator and I have seen client come to us and say, X did not perform well, give us the money back or provide Y number of free consulting days. I have seen clients come to us and say , we give you 2 more months, deliver this project or else lawsuit, and I have seen company agreeing to client demands. These are additional advantages for going to TCS/WIPRO. I have seen at one client place, they offered 10% of the resources free. So if client took 50 peopkle, they got 5 more for free. Can your company do that? Dont make hollow claims of BS if you are just a simple developer.
4. YOU guys want to leave companies at will but the companies should not replace you at will? - Not at all, they can replace us anytime they want.. I don't know why this point ???
Here we are discussing about a violation by companies using L-1B visa resources and we think reporting this to the agencies (ICE/USCIS) and making awareness amoung clients doesn't harm anyone who does their business within the legal frame work.
No we are discussing YOUR jobs loss due to L1 misuse. You were sleeping until it hit you and now you suddenly want sympathy. BTW, I feel sorry for you that any guy from India can come and do your job. Most guys who come on L1 are freshers with not much skills. Thats what is needed for the job then.

Hey BP, taking your numbers and assuming horizontal spill over instead of vertical would make eb2 all over current. total spill over from eb1 = 53807, total eb2 quota = 40040, pending eb2 = 74932
assume eb1 demand = 5000, eb2 demand = 20000
we can easily see eb2 getting completely approved.
I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. However your argument that you are reporting it since you cannot tolerate fraud isn't that convincing.
If you were always against injustice/lawlessness, you will see a lot of it in your daily life. Do you report or take action against each of those ? I don't think so.
After living in India for long and seeing people put up with all injustice and sometimes doing it themselves, it is hard to believe your argument that you are doing it just for the sake of law.
I does not matter whether we are exposing L! fraud by these outsourcing companies for the love of law or pure selfishness. As long as there is a greater good out of one's intentions it does not matter what my intentions are.
I am an architect now and i know for sure that this profile is no longer immune to outsourcing. I am ok with that. I am reconciled with that fact and I am moving on to another field. However, my point is, if you want to outsource take the job to the low wage country. Do not bring low wages here. I am ok if outsourcing would increase because of the Grassley bill. I am not ok if the low wages are dumped in here. I hope you people see the difference.
My self interest in preventing this dumping of bodies is to ensure that this doesnt happen in the new field I am entering into. Remember, most aspects of manufacturing are outsourced to China. However, I do not see the chinese companies dumping in low wage manufacturing workers here.

I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

I have attended the Interview for H1 B renewal at the US consulate in Toronto (Although i see a lot of posts concerning US consulates in India....thought this might be helpful for someone who would attend an interviewat US consulate in Toronto)
I attended the Interview on Jan 16th at toronto for H1 B renewal and i got my passport back on Jan 23rd (4 business days as the officer told me as jan 21st is a holiday...martin Luther king day)
I have been speaking to some people at the consulate and for them it is taking 5-8 business days and for some they got it in 4 business days.....the worst i have seen is for a lady who was coming to the consulate from past 3 weeks everyday and there is no ETA on her status..(i hope she gets her passport soon:) )...
Unfortunately most of the people who attended there did not know of these delays and are struck cancelling and re-booking their flight tickets and extending their hotel stay

How do you guys know that 12K visas will be allotted in one single month(May)? From USCIS point of view, won't it make sense to keep some numbers as reserve, if the EB1 picks up in the 2nd half?
