I think all the folks who visit this thread must send out a complaint.
Also please contact your attorneys and tell them to complain on this half baked PIMS implementation.
My wife received her approval email from Mumbai consulate yesterday. When I contacted my attorney, he asked that after she returns to the US, to send him more details and he will lodge a complaint with the DOS through his liaison.

After the infopass for me and my wife, we had multiple soft/hard luds and status changed to case moved to local office.
Received mail that we would be called for interview.
Wish they get this fast when the dates are current.

Mr. Dobbs, a pinstriped journalist turned populist crusader against illegal immigration, is not a fan.
�It�s an abuse of power!� Mr. Dobbs thundered. �He is being absolutely irresponsible. When the governor of New York embarks on this kind of irresponsibility, it is national news as far as I�m concerned.�
And when Mr. Dobbs � whose broadcast is CNN�s second-highest-rated show � speaks, many people listen. His relentless mockery of Mr. Spitzer�s decision has thrust the driver�s license policy onto the national stage, helping fuel an uproar not only among New Yorkers, but among national groups opposed to illegal immigration as well.
As it happens, Mr. Dobbs was recovering from a tonsillectomy when Mr. Spitzer announced the policy on Sept. 21. But the anchorman went on the attack almost immediately after going back on the air Oct. 8, saying it was �hard to imagine what this governor is thinking.�
It only took him another week to conclude that Mr. Spitzer, in fact, was not thinking at all. �This governor is a genius,� he proclaimed disgustedly on Monday. �An overwhelming majority of New York voters oppose the governor, but he refuses to back down.�
With the television set on mute, the scrunch alone of Mr. Dobbs�s brow conveys his belief that Mr. Spitzer�s new policy is, possibly, the dumbest idea in the history of dumb ideas.
�I think he�s definitely had an effect,� said State Senator Martin J. Golden, a Brooklyn Republican who was on Mr. Dobbs�s show on Sunday to denounce the plan. �Everybody�s chiming in. I get e-mails from across the country because of Lou Dobbs. I got an e-mail from a soldier in Iraq saying, �Go for it, Golden, keep it up.��
Mr. Golden is one of several New York elected officials � most of them with more experience on New York 1 than on CNN � who have been recent guests on Mr. Dobbs�s show. Many have expressed support for proposals by state lawmakers to overturn the license policy or to deny funding for it.
But not everyone who goes on gets supportive e-mail messages.
Jos� M. Serrano, a Democratic state senator who represents parts of Manhattan and the Bronx, appeared with Mr. Golden to defend Mr. Spitzer�s policy, but found himself under a verbal barrage from both the host and his fellow guest. �Oh my goodness, that was something else,� Mr. Serrano said. �I think it was my first time on national television. �One guy wrote, �We will derail the illegal gravy train from within,�� he said. �I don�t really know what that means. If Aman had worried about only himself then there would have been no IV. Start thinking for whole EB community. Change your "I" comes before "WE" attitude, help the whole community and help yourself. Anyway, good luck on your law suit.

No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.
If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.
If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

According to the report of AILA, State Department had exhausted FY 2010 immigrant visa numbers as of 09/16/2010 for the following preference categories and the State Department would not allocate any immigrant visa numbers to the visa posts and the USCIS for these categories during the period. The affected preference categories include all family-based preference categories, employment-based preference categories of EB-2, EB-3, EB-EW, EB-4 and eertain Religious Worker categories. The State Department will keep taking immigrant visa number requests from the visa posts and the USCIS even during the gap period but the State Department will not be able to allocate the numbers until October 1, 2010 or thereafter when the new FY 2011 immigrant visa numbers will become available for these preference categories. There may be some cases for which the USCIS has requested and the State Department has already allocated the visa numbers before 09/16/2010 and these I-485 cases will receive approvals even during the cap-gap period. However, in general, I-485 applicants will witness either a slow-down or vacuum in receiving I-485 approval notices and news until October 1 or thereafter because of the gap. The gap will last only for about two weeks and I-485 applicants should keep patience during the period.

take your i 485 application. There is a received date column and notice date column.
Date received is the date they received your application,notice date is the date they entered your application was entered into their system.
So, if someone with priority date of 08may2006 (eb2), but with a notice date of aug 30 2007 will get the green card earlier than someone with priority date of 20april2006 (eb2) with a notice date of sept 15.

gc_chahiye is correct - this is precisely why my lawyer advised me not to go with 2nd set of 485 + if one gets rejected the other one automatically gets rejected (when both are combined)
We decided to go for 485 that had older PD
I know someone who applied for 2nd set and then withdrew the 2nd application as soon as he got Receipts (his application was in Neb and wife's was in Texas << this could lead to major delays as the files are now physically located in different centers)
With all the confusion and movement of applications to different centers... things can only get complicated in my opinion. One can only hope for the best

Is there some master list of companies that have been filed against ? Do you know of anyone on this list that have done so and won ?
What will that accomplish really ? I dont know if working for this place will be a good idea anyway after filing a suit against them... but OTOH if it helps other people or at least if its out there on the net, so other companies wont get his brilliant idea....

My wife has H4 stamped on her passport which expired last year. We had got H4 extended last year, but has not been stamped. After that she changed status to F1 again not stamped. Now as per my lawyer's advice probably we will need to change her status back to H4.
My lawyer has suggested that it is not advisable to be on F-1 while applying for 485. You might argue that you are not the primary applicant ( on F1), and USCIS might buy that. But risks remain. Specifically if you have to travel out of country before your I-485 application is adjudicated you will have problem.
Since we all know that right now USCIS is just taking applications, and it might be mighty long time before applications are adjudicated, I have decided to not take risk applying on F1 status.

If all these years they were misinterpreting the law, where were lawyers and AILA raising their voice to correct this mistake? This error was deeply affecting the clients of lawyers.
We need to see more proactive activism of lawyers in matters such as these that are very important for the community. If not, members need to learn the law and do such research themselves. IV core team has been trying its best to read the law and create presentations and research documents whenever we have an important action item or bill on the floor. I would urge the community to read the law om their own as and when needed and raise their awareness.

As far as immigration lawyers go - they have no incentive to file a lawsuit to get a correct interpretation as they donot stand to gain whatever way the law is interpreted. Also while there definitely are a few smart immigration lawyers- the run of the mill ones are no better than paralegals. I'm not sure I should be saying the above but my experience points to that.

Question is that there are so many July 2 filers (including me) who have not got any response yet. Therefore, it is not an isolated case. I don't know if emailing to the Director does any good, as long as USCIS keeps admitting that they have not yet sent all receipts (inspite of weekly bulletins). Until 90 days are over, I guess, USCIS will be unresponsive to individual inquiries.
