Cool video. Good to see acknowlegement of flower campaign as a reason for USCIS decision.
Who is the guy in the video being interviewed - is he USCIS official?
Yes, he is a USCIS spokesperson. His name is Bill Wright.

This is a good news. Do we need to tell individuals who are affected to send email to that email address? Let plan asap.
I don't think thats a good idea. You collect all evidence and we represent at once.
Opinion?

Why would they think like that?, USCIS made a mistake. They tried to cover (by making visas unavailable) their ass to save their jobs. Thats why we have congress to help us out.
For USCIS its a bad publicity.
We have congress "helping us out" by doing WHAT exactly?? So far we have exactly ONE congresswoman who made a statement. After that no one has even BOTHERED to do anything.
It may be bad publicity for the USCIS, but guess what? NO ONE GIVES A S**T. The USCIS is an INDEPENDANT body and it made a MISTAKE. Everyone makes mistakes, remember?

Using the same logic, they can avoid interviewing an African American.
I think we all should get together and file a class action law suit against those companies.
Yes, This comes into picture once company decides to hire. Now hiring is teh last process and beofre that you get grilled in multiple interviews. Employer is tsill at liberty not to interview EAD holder. If you are not interviewed, hiring would not come into picture and hence this text of law in I-9 form is worthless for you for that position. This I-9 text will only cover the situation for the period after hiring not before hiring.

My company will only apply for an EAD for the spouse.
For the employee .. they ask that the h1 be extended.
Now in case I am laid off .. this pretty much puts me in the spot.
I've heard that it is possible to apply for EAD on my own.
1. Any idea if this is true and what info is needed to apply for the EAD.
2. Any issues with having both h1 and EAD?
3. Also if my wife is on EAD .. and I get laid off on h1 and am looking for a job .. what happens to her EAD?
4. If my wife is on EAD .. and I get laid off when on EAD and am looking for a job .. what happens to her EAD? And do i need to seek a smilar position in new company .. or anything works?
Thanks

One way to end his mis-information is to make a list of the companies who advertise on his show. After that we need to communicate with these companies about the lies he spews on his show and also threaten to boycott all their products, if they continue to sponsor his show.
Remember, I can't make a difference, you can't make a difference. But both of us can certainly make a difference.

Easy Saimrathi. I am posting it for people who have just joined us.
Update from english_august
Siva tells me that the flowers are indeed being delivered to the USCIS office. It has created quite a stir.
Of course, we do need to keep the entire campaign in perspective. It is not something that Brian Williams is going to open his evening news with. In fact, he might not cover it at all. After all, when you compare it with the immigration rallies of last year - this is miniscule.
But we did generate quite a bit of media attention with this, we did prove that the skilled, legal immigrant community can take collective action and we did prove that the decisions made by US lawmakers and the beaureaucracies end up hurting real people behind the numbers.
I think all that was worth my 30 dollars.

Its not that I think I am smarter or have any additional insight...but I take things at face value. Of course the total number of pending cases in the chart and in the PDF should match - they both are exactly what they say they are "PENDING EMPLOYMENT BASED I-485 cases" If that's what the report title says, that's exactly what it means. No point in over-analyzing if this is just for pre-adjudicated or only primary applications etc....
I say stupid questions because people still ask "Does the PDF report contain numbers for dependents or only for primary applicants" - so you are telling me that this is not clear from the PDF report??
I and many others do not see the definition of "Pending" what is in our minds matching the definition of "Pending" by USCIS. We believe that it is not yet concluded. Even USCIS itself is not clear. In trend chart under "All other pending" its total figure for national level is 279031 till July 2009. Where as in the Excel worksheet it is 233816 till July 2009( Worksheet is produced for the time period till the December 2009 but for July to Dec 2009 all visa categories have zero value thus data is till July 2009)
So I would request you to keep patience till we get "authentic" feedback from somebody. Many people are working on this in background. If you want to see the signs they are there in many other threads including recently declared FOIA and USCIS data comparison thread published by Pappu.
We can't be just "innocently simple minded" when USCIS itself publishes different data sets at different links and start believing the only data of a particular worksheet is correct just because USCIS declared it. If you try to compare both of these trend chart and excel worksheet with the April operating performance report declared by USCIS (needhelp! has posted it on this thread) then you get into more confusion and start seeing clear discrepency.
So choice is yours , patiently watching the input of others on this thread and start contributing in analysis OR keep on doing what you are doing unnecessarily.

I do not have any number in Beneficiary box.
Does that mean I do not have an A#?
Is this an issue?
Will appreciate your response.
Well, I am no lawyer, but IMHO, it should not be an issue. Several people have posted comments regarding the A# and have found that some have it, some don't.
There is a post somewhere that explains different types of A#. I am still a bit fuzzy on this.

There are lot of people losing jobs because of L1. I totally agree with L1Fraud that we need to expose this racket and make sure everybody is following the rules, period....People like ganguteli must be on L1 and they will always support to continue this fraud. Bringing people on low wages on L1 is causing lot of pressure on salary and I have seen whole floors being replaced from this so called highly skilled people on L1. I'm not against immigration but against people/companies breaking the rules..
L1Fraud - Can you post on how to go about reporting this fraud. I know you mention about ICE? Do you have a format of letter and any suggestions on how to kick start the discussions and investigation....
Go to ICE.gov website or use the below link
"http://www.ice.gov/about/investigations/contact.htm"
Please find to which IO office your region is attached, call the investigations office and talk to investigator and they will direct you to the local officer/investigator. Call the local investigator and he'll arrange to have a face to face meeting and he'll direct you regarding all the petition process. Please PM me know if you need any specific details.

I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
Will this affect my GC process. I have no plans of buying a house in coming years.
What might be an outcome of foreclosure, keeping in mind that i am wiating for my GC process.
If anyone had an experiecne like this or may know someone, please share ur thought..
My suggestion is to explore short selling to avoid foreclosure. This will not affect your credit as foreclosure does. And mortgage lenders are going ahead with this option.

i do not understand how overstaying and transit visas are related.
the TV allows you to "walk from one gate to another" in the international transit area...that's all. you cannot walk OUT anyway without crossing immigration- and if you want to do that- you always need a visa. this new visa, confers (for 90 bucks per person) the right to walk to your plane- sometime the right to walk off and back on to your plane...what a joke!
even the US now requires this so the UK only did a copycat deal, but the issue here (besides money grubbing behavior) is the way people are treated. sorry lost in space...but you do not seem to understand. if you do not step on UK soil you cannot overstay. the purported reason for this "walking visa" is security. and we all know that "security" can these days be a euphemism for treating people pretty badly. personally if i had the choice when transiting i would not go through london...ever. if nothing else the taxes are astronomical and they make the tickets more expensive most times and walking from one gate to another involves serious hassles with new security checks and long lines. and i do hope that enough people vote with their feet so the UK govt pays attention. london is too wonderful a city to lose out like this....

Hello Logiclife,
The information you provided is very useful. Will go look for David Heenan's book.
Here is the book that I am trying to read - 'Flight of the Creative Class' by Dr. Richard Florida. Here is the extract from this book -
Chapter 4 – The Closing of America? - Page 112
The rejection rate of H-1B visas (also called “high-skilled visas”), which allow professionals who are not U.S. citizens to work in the country for up to six years, increased from 9.5 to 17.8 percent between 2001 and 2003.
Chapter 4 – The Closing of America? - Page 117
By 2003, antiterrorism measures began to catch up not just with visa applications but also with requests for more permanent U.S. residence. Thanks to delays in the processing of green-card applications, only 705,827 people became legal permanent residents that year, down from 1.06 million in 2002. This decline is the steepest since 1953, when Joseph McCarthy stoked fears that Communists were invading the government and general population. Nearly half of those affected by the government slowdown in 2003 were foreign students, workers, and others already residing in the U.S. and hoping to become permanent residents. Such figures may understate the extent of the problem-which were backlogged to more than 6 million by the end of the fiscal year 2003. Of these over 6 million people whose legal lives as residents were put on hold, roughly 3.6 million have had applications pending for more than six months.
The practical, everyday implications of such a wait can be exasperating. Without a green card, many immigrants are prohibited from traveling, denied the benefit of in-state tuition rates, or even put at risk for job loss and deportation if the wait goes on too long. These risks accrue not only to individuals and families but to the businesses that hire them and need their skills.
There is lot more to share but I am not able to put all this on the discussion forum thread. Will add more to this later.
